To help explain the situation, I have enclosed a couple of topo maps showing contours prior to t he construction of Whispering Woods and after the project was completed. The first sheet identified as #1 shows the contours which existed prior to both Whispering Woods and your home on Lot 14. Identified in red is the approximate locations of property lines to show how the two subdivisions fit into these April, 1966 contours. Highlighted in blue is the low point in your backyard, which remained roughly the same after your home was built. Sheet #2 shows the result of the grading for Whispering Woods. In reviewing these contours, it is clear that the low area existed prior to the construction of Whispering Woods and your home. Your main concern, however, was the possible impact the grading may have had as far as contributing to the amount of runoff into your yard. Sheet #2 shows nearly 18' of the hilltop being removed which originally drained into your yard. In reducing this hill and providing streets and storm sewers, approximately 112 acre was reduced from draining into your yard and redirected to Slater Road. As a result, Whispering Woods did not contribute to the existing problem, - rather, it reduced the amount of water which now runs into your property. I realize that a drainage situation such as yours is a nuisance and is difficult to resolve economically. However, you may consider contacting a private landscaping firm who may be able to provide you with a couple of options. You have previously been in communication with my client with regard to this problem. I have reviewed the topographical maps that you have sent to my client, and your letter of March 8, 1988. My client appreciates your response to his concerns with the backyard drainage. However, your theoretical analysis of the problem does not fit with the actual facts that have occurred. The actual facts indicate that the Schaffert property post-Whispering Woods development is subjected to a significant drainage problem that did not exist prior to the Whispering Woods development. At times, the problem reaches the level of a small holding pond. Regardless of your analysis, my client knows that the drainage patterns in the area have been altered in such a manner to negatively impact his property. There is at least one erroneous assumption in the theoretical analysis that you have made. As my client advises me, one or more of the front yards of the properties on the cul-de-sac behind him drain downhill to the street. This is in conflict with the indication that the front yards of those properties drain to the cul-de-sac. While we have not ourselves performed an engineering analysis of the neighborhood, there may be other erroneous assumptions that have been applied. One fact remains clear to my client, and that is that he has seen an alteration of the neighborhood topography that has negatively impacted his property. Mr. Craig E. Knudsen March 23, 1988 Page 2 My client wishes to propose the solution of an installation of a catch basin at the low point of his property leading to the storm sewer system in James Court. Properly constructed, this would alleviate the holding pond effect of my client's backyard. While this would involve some expense on the part of the City, it is my client's hope that it is an amicable solution that will be less expensive for all parties than pursuing this matter in litigation. In doing so, I have taken into account runoff created by the new homes, driveways and other impermeable surfaces which now exist and compared the results to the conditions prior to the development of Whispering Woods. This evaluation supports the statements made in my March 8, 1988 letter to James Shaffert that the Development has not contributed to the problem but reduced the amount of runoff into your client's lot. In the event you are still concerned with "erroneous error" you should keep in mind that accuracy greater than .1 to .2 acres cannot be justified considering the results and cost of time. If you have further concerns with accuracy, I would recommend that you hire a private engineer to analyze the situation. I'm sure you can understand that it is not within the City's policy to provide private drainage systems. However, if you can provide the engineering analysis to support your claim, the City can then justify pursuing this issue. Another solution that you or your client may not be familiar with is petitioning for a public improvement. This option would allow the costs associated with the project to be assessed to the benefiting parties over a period of time which may be more financially feasible for Mr. Shaffert. Also, there may be shared costs if there are other properties which benefit in one way or another. Please feel free to contact me if you have any questions or need further information. Wescott Drive/Braatland's Property Apparently, there is some problem of acceptable work of the restoration on the Braatland property. However, we are unable to make contact with the property owner to find out specifically what his concerns are. Enclosed please find a letter sent to Mr. Braatland on May 4 requesting that he follow through on his concerns by contacting the appropriate City personnel. Any further contacts from Mr. Braatland should be addressed by requesting that he identify his concerns in writing so that we can properly respond to specific issues. Erosion Control/Byron Watschke With pressure from the City Engineering Division, it appears that lot restoration efforts have been initiated. However, we are skeptical as to whether it will be completed in a timely and acceptable manner. We will continue to monitor progress of this activity to ensure satisfactory results. Harvey's Heritage Addition All easements have been acquired necessary to allow the approval of the final plat for Harvey's Heritage Addition as well as the award of the contract for the construction of Braun Court. Bida-_ were received on May 24 with the low bid coming in under the- estimate contained in the Feasibility Report which should allow the contract to be awarded barring any unforeseen errors associated with the evaluation of the low bid received. It is anticipated that the final plat will be approved and the contract awarded at the June 7 Council meeting. South Widgeon Way/Boulter I am aware of the concerns of Barb Boulter regarding the construction traffic and her concerns regarding safety of the children in the neighborhood. I have spoken to her regarding this issue in response to her request for "Slow - Children Playing" signs and explained to her that the installation of those signs are not appropriate at non-city park locations. Her further concerns regarding "excessive" truck traffic are inappropriate as there are limited occasional trucks using Widgeon Way to complete the construction of the St. Francis Woods 4th Addition townhouse project. This is a very slow development THOMAS L HEDGES PAGE 2 with minimum construction activity. The term "excessive" is a relative term and in Ms. Boulter's case is being used to imply "more than one". There is nothing the Police Department could do as there are no restrictions for truck traffic for construction purposes. This has been explained to Ms. Boulter on a "neighborly" basis. Drainage On Slaters Road Attached you will find copies of correspondence regarding this issue. After personal evaluation of this situation, I do not feel it is appropriate that any further time or money be spent by the City pursuing this private drainage problem. The only time he has had a drainage problem is during the spring runoff with frozen ground conditions which quickly disappear and is not a permanent or long standing drainage problem. Unless directed to the contrary, we will not be providing any further involvement or response regarding this matter in relationship to other issues which have more merit. Safari Trail & Galaxie Monuments I am not aware of any concerns or problems regarding the monuments around Safari Trail or Galaxie Avenue. With more specific information, further investigation and reports can be provided. I hope this adequately addresses the concerns and issues raised by the Mayor through your memo of May 23.
