Dear Bob:
Recently, the City was served with a Summons To Conciliation
Court to defend a claim in the original amount of $2,017 for the
alleged incorrect location of the sewer and water services to Lot
4, Slaters Acres Addition.
On February 8, I requested Jerry Bourdon to defend the City on
this matter due to his extensive knowledge and involvement in
this particular project. On March 31, the City was informed by
the Courts that the City is liable for $1,017 of the original
claim submitted. As you will note, the judgement is stayed by
statute until April 18. 1988, to allow an appeal if appropriate.
I would like to have your response regarding your firm's position
of responsibility in light of the Courts determination of City
liability for the incorrect placement of these sewer and water
services. I would like to have your official response, with a
copy to the City Attorney's office, prior to the April 18
deadline so that a determination can be made whether to pursue
this finding through an appeal.
I will anxiously await your position regarding this matter.
