Utility Easement
THIS INDENTURE, made and en[ered into this V-4 day of 'J40U.pav ,
1981, by and between Charles L. Bolstrum and Maxine Bolstrum, husband and
wife, as Grantor, and the CITY OF EAGAN, Dakota County, Minnesota, as Grantee,
WITNESSETH WHEREAS, said Grantor, in consideration of Seven Thousnad Five
Hundred ($7,500.00 Dollars and other good and valuable consideration, to them
in hand paid by the said Grantee, the receipt whereof is hereby acknowledged,
do hereby Grant, Bargain, Convey and Warrant to said Grantee, its successors
and assigns, the utility easements situate in Dakota County, Minnesota, as
follows:
9 permanent easement for utility purposes over, under and across that part of
Lot 6, SLATERS ACRES, according to the recorded plat thereof, Dakota County,
Minnesota. Said permanent easement being 20 feet wide, the northeasterly line
of which is described as beginning at the most northerly corner of said Lot 6;
thence 557°25'23"E along the northeasterly line of said Lot 6, a distance of
114.82 feet and there terminating. And said permanent easement being 30 feet
wide, the centerline of which is described as beginning at the point of
termination of the above 20 foot wide easement; thence 524°11'S1"W, a distance
of 95.93 feet; thence S20°04'42"E, a distance of 80.88 feet and there
terminating.
The sidelines of said Permanent easement are to be lengthened or shortened so
as to terminate on the northwestery and southwesterly lines of said Lot 6,
The Grantee shall have the right to do whatever is necessary for the
enjoyment of the rights herein granted, including the right of clearing the
right-of-way of ingress and egress to and froc¢ said tract of land and over and
across said easement only for the purpose of laying, maintaining, operating
and repairing said utility lines.
By acceptance of these easements, the Grantee agrees that it shall replace
any shrubs or sod removed by it in the exercise of its rights hereunder to as
near the condition which existed immediately before such rights were exercised
as is reasonably possible.
