We aqain ask youc suppoct for what is to us a serious problem
concecning the drainage of Whisperinq Woods.
On May 9th, we called Mike Foertsch to see if any developments
had occurred about the drainage. He said the city had accepted
a pcoposal from Scott Hilla and it would be approved at Lhe
next couttcil meeting on May 15th. We met with Mike late on the
5th to see what the proposal entailed.
We, as the public, do not think that five wocking days is a
ieasonable amount of time foi us to have an independent siting
sucvey done, tetain legal counsel, and contact an engineering
firm foc outside vecification. We have accomplished the first
two with Tti-land Co. Sucveying Secvices and Gary Fuchs,
attotney. It has taken Scott Hilla over a yeat to present this
pcoposal and we feel trie public should have adequate time to
respond.

Sn response to your April 14 letter and numerous contacts either
by phone or in person, there appears to be a disagreement of
opinion over the storm sewer requirements for the proposed
Whispering Woods 4th Addition.
First of all, to emphasize the point again, the existing outlet to
proposed Block 1 in the 4th Addition which was installed with
Whispering 3rd Addition is not of adequate capacity and depth to
accommodate the runoff qenerated by development of the 4th
Addition. You had suggested that because the City allowed you to
put in that outlet to that lower area on proposed Block 1 of the
4th Addition that the City has some liability as to the design of
that outlet pipe. The City assumes no responsibility for a system
which was designed by an engineer hired and paid for by the
developer. The developer's engineer is solely responsible for any
inadequacies in the design of his system.
As far as ponding requirements for the proposed low area on Block
1 of the 4th Addition, the development is limited to a high water
elevation of 56. . The pond is required to have 0.4 acre feet of
storage with a CFS outlet. Any changes in pond volume or outlet
rate affects th other accordingly. In regard to the ponding area
volume, the hig? water level and the outlet pipe to the proposed
ponding area, t ere are a couple of alternates which we have
previously disc sed. The City will not allow a"ditch" from a
supposed pondin area to a backyard area catch basin to alleviate
some inadequac' s in a previous design of a sewer system. The
"ditch" clear circumvents the responsibilities of designing an
adequate sto sewer system in the City's opinion.

Number two in your April 14 letter requests that Four Seasons Drive
be designed to drain water into the northerly adjacent Oak Cliff
Additions along James Street to a series of existing catch basins.
The storm sewer system in James Street is not adequately sized to
accommodate any additional runoff from the proposed 4th Addition.
If there was adequate capacity in the James Street storm sewer,
there would be no problem with directing the surface runoff from
Four Seasons Drive to the north to the James Street storm sewer
system.
In reference to point number three in your April 14 letter, if a
public improvement is initiated to correct the storm sewer
inadequacies in the oak Cliff and Whispering Woods Additions'
areas, the City will propose assessments to those properties which
benefit from the storm sewer systems which would be constructed.
If Whispering Woods 4th Addition by design contributes water to a
system which is designed under a public improvement, the
development will be required to pay its proportionate share of the
cost in this system.
I trust this letter satisfies your request for clarification of the
issues which are presently outstanding on the Whispering Woods 4th
Addition. I encourage you to meet with the appropriate engineering
staff to resolve the outstanding storm sewer issues.

A little over a year aqo, my husband and I appeaced at the city
council meetinq voicing concecn about the draiaaqe of the
Whisperinq Woods addition abuttinq our propecty Located in the
Oak Cliff section. Even thouqh it was aftet midniqht, the
council was attentive and sympathetic to our ptoblem. We left
the meetinq feelinq qood about our city council. They gave a
clear messaqe to the enqineecinq department about findinq a
pcoper solution.
As of this date, the dcainaqe problem still has not been
iesolved. We met on Apri1 ZOth with Mike Foertsch, city
engineet, to discuss the possibilities propcosed by the
developer, Mc. Hilla. At this time, it appears that stceet
water will be dumped into a newly formed pond in which the 100
yeat hiqh is inside ouc home. Currently truckloads of fill ace
beicig emptied around this depression, causinq floodiny thaC has
nevec before occurred. (Ylease see the pictures taken this
yeac durinq the snow melt.)
How to empty this newly fo[med pond is what is still beinq
negotiated between Mt. Hilla and the city engineer. Aftec
Calkinq with Mike Foertsch, we hope that the city will stand

rains. The drain•rthat is supposed to take water out of our yard, but
actually serves no purpose, brings sand from the street into the yard.
This photograph was taken after Dave raked the sand back, but you can
still see the damage that was done. Can't the city or Winkler move on
this? It doesn't seem like it should be a major project to get the
drain plugged up.
Also I would like to remind you the direction the City Council instructed
the City of Eagan to take concerning the Whispering L7oods addition.
Item 17 was added so that the drainage problems would be talcen care of
satisfactorily to avoid a future law suit. We ask you to keep us
abreast of any developments occurring there. Recently we've had more
people coming and looking in our backyard area.
