The attached letter was sent to you on October 31, 2002, in regazds to the
retaining wall constnxcted in public right-of-way. This wall is not permitted to
be in its present location as stated previously as it can be a safety hazazd for
pedestrians and also a potential for damage of maintenance equipment. As is
shown on the attached letter, the resident was in our office on November 4, 2002,
and said the wall would be removed in the Spring. I am assuming this was the
Spring of 2003.

At the request of Mayor Geagan, I will summazize our discussions and
conclusions from our meeting held on Wednesday morning, Apri121, 2004.
You, as property owners, have two options regarding yout retaining wall located
on City right-of-way. The first option, and definitely the City's choice, is the
complete removal of the wall, slope the yard to a very maintainable slope, lower
your. urigation system, then topsoil and sod. This option would provide for ease
of yard maintenance, and certainly take away the possibility of future claims due
to accidents.
Option two is to relocate the retaining wall onto your property and have the face
of the wall a minimum of 12 inches from the back side of the bituminous trail.
Also, the completion time was discussed and the City has agreed to extend the
time from May to July 1, 2004. All work is required to be completed by that
date.

City staff have discussed your retaining wall constructed within public right-of-
way. The answer is the same - the wall will not be permitted to remain in its
present location. It will be either relocated or removed completely as soon as
possible. Due to winter approaching, it may not be very easy for the removal
prior to freeze-up so the City will give you until May of 2004 for its removal. As
I stated at our meeting at your home last Friday, any damage to snow removal
equipment due to hitting the wall will be billed directly to you as homeowners.
Attached is a copy of the approved grading plan for the Oakbrooke 5`h Addirion
which your lot is included in. The plan does not show a wall nor is a wall even
needed in this location.
Please be advised that the City of Eagan will remove this wall themselves if it is
not completed in the specified time. All associated costs for the removal would
become the responsibility of the homeowner.

I am writing this letter to inform you that City staff has recognized that a retaining wall
was built adjacent to the bituminous trail at the above-referenced address along Johnny
Cake Ridge Road. The wall is literally touching the trail and, since the City right-of-way
is bne foot beyond the edge of the trail, this would indicate that the retaining wall is on
City property.
The wall's close proximity to the trail is a potential safety hazazd to any citizen using the
trail. Also, City crews will be removing snow from the trail so there is the potential for
damage to personnel, equipment, or the walt itself.
This letter will serve as notice that the City of Eagan will not pernvt the placement of this
private retaining wall on pubiic property or within public easement. It is the City's
preference to have the property owner remove the wall. If the owner does not remove the
wall, the City may remove the wall without any compensation to the property owner and
assess the cost of removal and disposal of said wall to the property owner.
