I have met with John Voss, Dakota County Commissianer, and he requested that
veri£ication procedure be expediated to assist me in this d:il.emma. Mr. Voss
rnat with Bernie Larson, Dakota County Surveyor, and both men recognize the
hardship on my £amily and have agreed to establish the corners in question.
I have been infoxmed that it is impossible to establish a time frame because
of possible complications of this work. I have been assured that efforts
wi.ll be made to remedy this problem as soon as humanly possible. It has been
suggested that I can start the prelimanary plat process simultaneous with the
restablishing with the section monuments. In consideration of this advise? I
have contacted my surve,yor and initiated this process. I sincerel,y hope that
this most recent action, and past actions shows my determination and com-
mitment to provide a final and lasting solution.

Dear Mr. Colbert:
I want to thank you for the time and assistance you gave me on October 22, 857
when I was in to see you regarding the assessments £or Parcel A and B.
I felt from our conversation you think it would be better for us to plat the
above property, but we have suffered through a severe and economic hardship
in the past year. My husband has been out of state for over a year, and we
have kept up 2 households all this time while I tried to sell tlie above
property. Also, I have moved out of the house, and the potential new owners
(Carl and Sally Wright) are living in the house, and I am living with friends
and relatives while I am trying to resolve this entire prohlem. I would like
to provide the new owners with some security as to a closiryg on the above
property. If I could be granted a waiver of plat, and then do the platting
it would certainly be financia]1y help£ul.
I met with Berni.e Larson, Dakota County Surveyor in his office in Hastings
on Friday, October 18, 8$ and he suggested I speak with John Voss, Dakota
County Commissioner, and he will be meeting with the Board on October 22, 85.

Dear Mrs. Wilson;
Please be informed thet at the November 6 Council meeting, the
Council formally approved the above referenced Waiver of Plat to
allow you to split this parcel in accordance with the legal
description submitted under the certificate of survey prepared by
Bradley J. Swenson dated 8/27/85. This waiver to the City code
tequiring platting of the property is subject to compliance with
the following conditions:
1. Compliance with all other City ordinance requirements.
2. No building permit will be allowed on the residual parcel
until the final plat has been approved by Council action.
3. The property involved with this lot split shall be final
platted in accordance with the City codes and recorded at
the County no later than August 1, 1986.
4. The applicant place a$10,000 "good faith" escrow with the
City to insure compliance with this platting process by the
referenced deadline.
5. All assessment related obligations that would be required
with the final plat (Exhibit A) shall be resolved as a
condition of this waiver or prior to connection to any City
utility, whichever occurs first.

The assessment obligations referenced under condition No. 5 above
can be resolved either through cash payment to the City or the
execution of the attached "waiver of hearing - special assessment
authorization" documents.which would allow these obligations to
be spread as a special assessment against each newly created
parcel as identified in Exhibit A to this letter.

It is understood that the "good faith" escrow referenced in
condition No. 4 above is not meant to guarantee the payment
of these assessment obligations, but rather, to guarantee that
the formal platting of this property will proceed in a diligent
