This letter will serve as a follow-up to the day-caze inspection at 1372 Jurdy Road on December 11,
1996 wherein you were advised that the bead boazd from the ceiling must be removed and re ln aced
with gypsum boazd, sheetrock, or a fire-resistive material such as ceiling tiles. I have since that
time talked with the Chief Building Official for the City regazding the replacement requirement and
he has informed me that Building Code minunum standards require only that the bead board be
removed.

During the week of August 13th, I made a safety inspection at 1374 Jurdy Road to check on
repairs required due to fire damage on April 7, 2001.
I discovered that Master Restorations was performing repairs without proper permits from the
City. I issued a Stop Work Order, rehuned to the office, and called Jerry Durham, Representative
for Master Restorarions, regarding this.
On August 30, 2001, Jerry came in to the office with two building permit applications signed by
Owner Arlene Armeli. In a discussion with Mr. Durham, Senior Inspector Craig Novaczyk
questioned if Ms. Armeli had indeed signed these applications. Mr. Durham stated that she had
signed the applications.
I called and informed Ms Armeli that the City would issue permits to her, but it was in her best
interests to have Master Restorations apply for, and sign the applications if they were doing the
work. Ms. Armeli told me that she had not signed any applications for building permits and if we
had applications containing her signature, they were forged signatures. For your information, I
am attaching a letter from Ms. Armeli to Jerry Durham, Master Restorarions, regarding
termination of the construction contract.

may exist or may be alleged to exist between you or your company and me, effective immediately.
This temunation is being made as a result of numerous breaches and defaults on your part, including
but not limited to your failure to be propedy licensed as a general contractor, yow failure to prosecute
the work in a diligent and timely manner, your failure to perform the work in accordance witt?

Dear Mr. Zelenka:
I am writing to inform you of the conclusion of our DepartmenYs investigation of your
complaint against Gerald Dunham, doing business as Master Restorations, Inc.
Enclosed is a copy of the Cease and Desist Order and Notice of Right to Hearing that our
Department issued December 21, 2001 against Gerald E. Dunham, individually and doing
business as Master Restorations, Inc. for engaging in unlicensed residential contracting
activity. Mr. Dunham does have the right to request a public hearing to contest our
action. Such a hearing must be requested within 30 days of service of the Order. In the
meantime, the Order is in effect until modified or vacated by the Commissioner or a court
of law and Mr. Dunham is thereby prohibited from acting as a residential contractor,
remodeler, or roofer until ]icensure is achieved.
Because we have taken the maximum administrative action against Mr. Dunham, doing
business as Master Restorations, Inc. in light of his licensing status, we are unable to
pursue this matter further and are closing our file. We will notify you in the event Mr.
Dunham does request a hearing to contest our action. Should a hearing be held, we will
likely ask you to provide testimony as a witness.

NOTICE OF RIGHT TO HEARING
Minnesota State law prohibits any person from acting or holding themselves out as a
residential building contractor, remodeler, and/or roofer for compensation without a valid license
issued by the Commissioner of Commerce as required by Minn. Stat. §§ 326.84, subds. 1 and lb
and 326.842 (2000), unless such person is exempt from said ]icensing requirements.
Pursuant to the above-referenced statutes, Commissioner of Commerce James C.
Bemstein has determined as follows:
STATEMENT OF CHARGES
1. Gerald Dunham, doine business as Master Restorations, Inc. ("Respondenr'), does
not hold a building contractor, remodeler, or roofer's license by the Department of Commerce,
nor does Mr. Dunham have a certificate of exemption.
2. In September 2001, the Department of Commerce opened an investigation based
on a]etter received from EaQan building inspector, Terry Zelenka, regardine a contract Mr.
Dunham entered into with homeowner, Arlene Armeli.
3. Accordine to Mr. Zelenka, Mr. Dunham (doing business as Master Restorations,
Inc.) was performing repairs on Ms. Armeli's home, required due to fire damage; during the
week of Auaust 13, without the proper permits. ConsequenUy, Mr. Zelenka issued a stop work
order.
4. On August 30, 2001, Mr. Dunham came to Mr. Zelenl:a's office with two building
permit applications signed by Ms. Armeli. Senior building inspector, Craig Novaczyk,
questioned Mr. Dunham if Ms. Armeli had indeed signed these app]ications. Mr. Dunham stated
that she had. Mr. Zelenka called Ms. Armeli and stated that he would issue the permits but it was
in her best interest to have Mr. Dunham apply for and sign the applications if he was doing the
work. Ms. Amieli told him that she had not signed any applications for pemiits. When the
Department of Commerce asked Ms. Armeli in a telephone conversation if she had signed the
applications, she stated that she did not believe she had but cou]d not be 100 percent certain.
5. Following the receipt of [he information from Mr. Zeletilca regarding the permit
applications, Ms. Armeli sent Mr. Dunham a certified letter dated August 30, 2001, stating that
she wanted to terminate their concract based on his unlicensed status and failure to perform work
according to applicable codes.
6. The Department called Ms. Armeli on November 21, 2001, to discuss the
situation with her. She stated that her insurance company paid Mr. Dunham $10,000 in advance
for the job. Furthermore, she has requested from Mr. Dunham on several occasions a copy of the
contract but has never received this from him. C.H. Carpenter Lumber provided Ms. Arme]i with
a pre-lien notice in June 2001, stating that they had been hired by Master Restoration to prox-ide
lumber and building materials for a job at her home for the amoimt of $35,000. In addition, a
lien has been filed against her home by Controlled Air in Farmington for the amount of
$8,139.00.

7. The Department wrote to Mr. Dunham on September 24, 2001 and on October 16,
2001, demanding a response regarding his unlicensed activity. No such response has been
received.
VIOLATIONS
COUNTI
By not responding to the Commissioner's requests io: information, Respondent violated
Minn. Stat. § 45.027, subd. la (2000).
COUNTII
By engaging in unlicensed residential remodeling activities on the Armeli home,
Respondent has violated Minn. Stat. § 326.84, subds. 1 and 1 a(2000).
COUNT III
Sy failing to use the proceeds of any payment made to him for the constniction of ar any
improvement to residential real estate for the payment of labor, ski]], material and/or machinery
contributed to the construction or improvement by Controlled Air, Respondent has violated
Minn. Stat. § 326.91, subd. 1(8) (2000).
8. Respondent, by the above conduct, has violated the provisions of Minn. 5tat.
§§ 326.83-326.991 (2000) and should therefore be ordered to cease and desist from further
violations thereof.
9. The following Order is in the public interest and is necessary to protect the public
health, safety, and welfare.
NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to Minn. Stat. §5 326.92,
subd. 3 and 45.027, subd. Sa (2000), that Respondent Gerald E. Dunham, doing business as

Master Restorations, Inc. shall cease and desist from engaging in the work of a residential
building contractor, remodeler, and/or roofer in the State of Minnesota until compliance with
Minn. Stat. §§ 326.83-326.991 (2000) is achieved, including licensure pursuant to Minn. Stat.
§ 326.84 (2000).
IT IS FURTHER ORDERED, pursuant to Miim. Stat. § 45.027, subd. Sa (2000), that
Respondent may request a hearing in this matter. Such request shall be made in writing and
served upon the Commissioner, whereupon the Commissioner shall set a date for hearin-, within
ten (] 0) days afrer receipt of the request unless Respondent and the Department of Commerce by
agreement waive the ] 0-day time period. If no hearing is requested by Respondent within thirty
(30) days of service of this Order and none is ordered by the Commissioner, this Order will
become permanent and will remain in effect until it is modified or vacated by the Commissioner.
IT 1S FURTHER ORDERED, that if a hearing is requested, this Order will remain in
effect until it is modified or vacated or made permanent by further order of the Commissioner
pursuant to Minn. Stat. § 45.027, subd. Sa (2000). The administrative proceedin?g provided by
Minn. Stat. § 45.027, subd. Sa (2000) and subsequent appellate judicial review of that
administrative proceeding, constitutes the exclusive remedy for determining whether the
Commissioner properly issued this Order and whether this Order should be made permanent.
IT IS FURTHER ORDERED, that notwithstanding the provisions of Minn. Stat.
§ 45.027, subds. 5 or Sa (2000) to the contrary, if Respondent requests a hearing under Minn.
Stat. § 45.027, subd. Sa (2000) Respondent may, within 15 days after service of this Order, brin-,
an action in Ramsey County District Court for issuance of an injunction to suspend enforcement
of this Order pending a final decision of the Commissioner under Minn. Stat. § 45.027, subd. 5a

(2000) to vacate or make permanent this Order. The Court shall determiue whether to issue such
an injunction based on traditional principles of temporary relief.
IT IS FURTHER ORDERED, that in the event a heanng is requested in this matter, it
will be held before an Administrative Law Judge to be appointed by the Chief Administrative
Law Judge for the State of Minnesota, 1700 Washington Square, ] 00 Washington Avenue South,
Minneapolis, Minnesota 55401-2138, Telephone: (612) 341-7600. Al] parties have the right to
represent themselves or be represented throughout the proceedings herein by legal counsel or a
person of their choice if not othenvise prohibited as the unauthorized practice of law. The
heaiing will be conducted pursuant to the contested case procedures as prescribed in Minn. Stat.
§§ 14.57-14.69 (2000), and the Rules of the Office of Administrative Hearings, Minn.
R. 1400.5100-1400.8401 (1999). Failure to attend a hearing in this matter may result in the
allegations of this Order being taken as true. Questions conceming the issues raised in Ihis
