Dear Mr. Watschke:
In discussions I have had recently with Ed Kirscht, you expressed the intention
of contacting Dakota Electric about installation of three street lights.
I have enclosed a reduced copy of the pla[ and indicate where two street
lights are to be placed. The third street light will be considered resolved
upon payment of [he street light at the intersection of Cliff Road and Lakepark
Drive. Due to the fact that these lights were to he installed by April
3, 1980, and have yet to be placed, the City of Eagan will not issue building
permits on the following lots until Dakota Electric has been paid: Lots 1, 2, 3,
8, 10 and il, of Block 1, Thomas Lake Addition.
Please have Dakota Electric contact me once they receive payment so the
hold on building permits can be removed.

Dear Tom:
You aeked that I explain our goal relating to a Notice that was received by
the Citq of a Land Title Summone relating to the three lota in Thomas Lake
Addition, mentioned above. Jean Parranto asked that we clear the title on the
three lots vhich were tax forfeited that he purchased about three or four
months ago. Thia meant that because the property is torrena, that we then
start a proceedings subsequent through the Torrene Examiner's office in Dakota
County. The next atep is for the Torrens Examiner to isaue a report which was
done several montha ago, and in the report, three parties vere named for
aervice, including Fortune Realty, the former fee owner of the property, First
National Bank of St. Paul, which was the former mortgage holder, and the City
of Eagan. The Land Title Summona has been served on each of those three
parties and each is given 20 days to respond if there is any objection to the
title clearance.
In the case of Fortune Realty, there is no basis for objection becauae the
real estate taxes were not paid and the taxes then became forfeited. In the
case of the Firet National Sank of St. Paul, likewise, the bank did not redeem
the land at the taa forfeiture eale and its mortgage would also not be
effective.
Ae to the City of Eagan, ita interest is as follows:
1. Lot 2, Block 1, Certificate of Title No. 54535 - There would only be
aeseaementa that would be iavolved in [hat lot. When Jean purchased the
lot, he paid, what I understood were some delinquent taxea but primarily
all of the epecial assesamenta levied againse the property, and Che County
in turn will pay the City, if it hae not already done eo, for the apecial
asaeeemente. We will check to determine the atatue of thoee aeeeesmente.
2. Lot 3, Block 1, Certificate of Title No. 54536 - The aeaeeemente ie the
only iesue that is outstanding on that lot aiso.

Eagan.

There will also be asaeasmente againet this lot, which would be handled
the same as the previoua two lota.
I did no[ work with Jean when he purchased the lota and he had title to them
when he first came into [he office by deede thai he had received from the
Dakota County Auditor. Mark Parranto, of course, hae taken over the interest
of his father and ia proceeding to clear the title to the lots. I am sending
him a copy of this letter so that he underatande the question that the City
staff had concerning the status of the three lota, and also our intereat as
attorneys. We are representing J. E. Parranto S Associates, Inc. and in no
way ahould it be conetrued ae advice to the City regarding ita interest in the
ponding easemente or in the assesaments.
The ponding easements will be retained intact without any change, due to the
proceeding subeequent, and we will work through the County Auditor and through
Jean's office to determine whether the assesaments have been or will be paid'
in full to the City.

Variance to the required 30' setback off of Ciry street right-of-way (R.O.W.) The lot in
question is located at 1478 Lake Park Circle.
BACKGROUND: The City Council approved a 15' Variance for this lot on August 24, 1987.
The 1987 application requested a setback Variance necessary to accommodate a 76' wide
home. The Variance was never acted upon and therefore, became void one year from the
approval date.
COMMENTS: The cunent application is for a Variance of 5' to the required 30' setback
from City R.O.W. or the north boundary of the lot. The house proposed for this site is 62'
wide and encroaches into the setback area approximately five feet. As proposed, the house
meets all setback requirements except for a 16' wide portion of the house that extends five
feet into the front setback area. The odd shaped lot has street frontage on the west and a
portion of the north side. The driveway will load into a garage from the cul-de-sac on Lake
Park Circle. .
If approved, this Variance shall be subject to the following conditions:
1. No other Variances shall be granted for this lot
2. All other applicable Ordinances.
