In discussions I have had recently with Ed Kirscht, you expressed the intention
of contacting Dakota Elec[ric about installation of three street lights.
I have enclosed a reduced copy of the plat and indicate where two street
lights are to be placed. The third street light will be considered resolved
upon payment of the street light at the intersection of Cliff Road and Lakepark
Drive. Due to [he fact that these Lights were to be installed by April
3, 1980, and haveliyet to be placed, the City of Eagan will not issue building
permits on the following lots un[il Dakota Electric has been paid: Lots 1, 2, 3,
8, 10 and 11, of Block 1, Thomas Lake Addition.
Please have Dakota Electric contact me once they receive payment so the
hold on building permits can be removed.

Dear Tom:
You asked that Iiexplain our goal relating to a Notice that was received by
the City of a Land Title Summons relating to the [hree lots in Thomas Lake
Addition, mentioned above. Jean Parranto aeked that we clear the title on the
[hree lots whichlwere tax forfeited that he purchased about three or four
montha ago. This meant that because the property is torrens, that we then
etart a proceedings subsequent through the Torrens Examinex's office in Dakota
County. The next atep ie for the Torrena Examiner to issue a report which was
done eeveral montha ago, and in the report, three parties were named for
aervice, including Fortune Real[y, [he former fee owner of the property, First
National Bank oflSt. Paul, which was the former mortgage halder, and [he City
of Eagan. The Land Title Summona hae been served on each of those three
partiea and each is given 20 daya to respond if theze ie any objection to the
title clearance.
In the case of Fortune Realty, there is no basie for objection becauee the
real estate taxea, were not paid and the taxes then became forfeited. In the
case of the Firat Na[ional Bank of St. Paul, likevise, the bank did not redeem
[he land at the tax forfeiture sale and ite mortgage would also not be
effec[ive. ?

aesesamen[a that would be involved in that lot. When Jean purchased the
lot, he paid,'iwhat I underatood vere aome delinquent taxee but primarily

him a copy of this letter so that he underatands the queation tha[ the City
etaff had concerning the etatue of the [hree lots, and also our intereat as
attorneys. We are repreeenting J. E. Parranto 6 Asaociates, Inc. and in no
way should it be conatrued as advice to the Ci[y regarding ita interest in the
ponding easemente or in the assessments.
The ponding easemente will be retained intact without any change, due to the
proceeding subsequent, and we will vork through [he County Auditor and through
Jean's office to detexmine whether the aseeasments have been or will be paid
in full to the City.
