Basically we are asking for an explanation as [o why you have failed to respond to our lettas and what
your intentions are at tttis point Youu reluctance to address this situation is creating more of a problem not
to mertion tiard feelings.
We feel this still could be resolved rather simply, however, if you don't respond to this letter we will be
taking action to inwlve RHS Realty, file a complaint with [he Board of Realtors Ethics Committee, along
with commencing legal action for non performance.. If we are forced to go in that direction we will be
asking for all legal costs to be paid by you plus any other damages. We would also post signs throughout
our backyard and on aur top deck notifying any new owner of this easement problem and any pending
litigation.
It is clear that an easement has already been granted by the agreement signed on 12/12/0 1, though it is not
clear what is govemed in [his easement. As a Realtor you and RHS Realty may have an ethics violation if
this is not handled properly. AII we want is to be able to record ihe easement you have already granted us.

had an Easement Agreecnent prepared by our attomey for yaur review. In considaation for the Agreement,
we ranoved the lazge white oak on your propeRy at a cost of 5400, thus making the Agreement legally
binding. Both Greg Hove and Jcel Rausch from the Ciry of Eagan were present at the time this easement
was being discussed and the letter Agreement signed.
While the Easement Agreement that was prepared was consistart with the existing easemen[ of record, you
indicated that the new easement ageeutent be for the additional only and have limited provisions. Ta
address your conceans, on Friday, 12121/0 1, we faxed to your office a revised and gFwtly simplified
Easement Agreement. It has been over two weeks and we have not heazd anything from you•
One way or anrnher you are obliged to provide us with specific commenu regarding this so we may
address them and thea arrive at a recordable document We would appreciate receiving the comments in the
next week at the latest.

this area and can new sprinkler lines hvo times since August 2001, due to darnage done from conh'ac[ors

1'm sending you a copy of a?etYer to put m the file for Lot 1 Blk 1 Cliff Woods of Eagan. Jcel Rausch was
present on 12-12-01 along with Greg Hove (city forester) when at the above lots decisions and ageements
were made to resolve [he issues regarding the placement of the proposed house on Lot 1 Blk 1
Cliff Woods of Eagan, and that ihe builder/owner of this lot (Rick Lesch) would grant us a 2/1/2 ft x 150 ft
easement In exchange for us paying for and ranoving a large white oak an his property (which we did).
Aiter the tree was reinoved and ihe ciry approved his house plans he has smce chapged his mmd regarding
the easement. However, on 12-12-01 while Greg Hove and Jcel ltausch wae there and we were
discussing specifics about the removal of the hee, i asked the builder /owner Rick Lesch, to sign a Idter
stating what we agreed upon with the easement in eacchange for the removal of the tree and he did Though
it may not he a recordable document it is enforcabte
I do want to make strt e that the city is aware of this and the problems we ate auraitly having. With this
Letter agreemcnt for the easemcnt nM being of record it is certainly going to be probletns for the future
home owness and for us.
We have put a lot of good faith, time, money and effort into working with the development in our back
yard. We have continually received the shart end of the deal by both the first owner and now the second
owner. I don't Imow what we could have done differently. But, as homeownas & citizms oFEagan and not
to mention my husband provides the ciry with his services as a firefighter, we give a lot back to the city.
And we want to make si¢e that concems and rights as exis[ing homeowners are taken into consideration
during developments such as this.
This has been a long and painful experience for us and it is not over.
We are going to work an getting this builder to live up to his writlsn agceemeot and give us a recordad
easement document (2/12 ft x 150 ft) which we have already compensated him for.
Please be aware that his cement contractors have damaged ffie Souih carner of of grass and sprinkler
systetn. This being the same area the last builder damaged. Please le[ me know the cared procedure to

'Ihe full 12 1/2 ft x 150 ft. This easement gives us very speciSc rights and control over tlte plantings, and
trces in this area to ad as a buffer and minimize the impact this new development has made on our home.
We have worked very hard to get this finalized over [he last two years, to make things even more difficult,
we have had ro work out deals and pay two different buildas, and neither one ended up being fair or honest
with us. This has been a lang and emotional process and we have now paid a total of $ I5,000 for the
control over this easement (with the last $2,000 being handed over to Rick Lesch on Feb. 22, 2002 just to
get this issue resolved). Everyone has a right to build and develop the'v property and we never had a
problem with that, all we wanted was to be able to provide ourselves with a nice buffer for privacy and
keep or restore as much natural landscaping as possible and to protect the value of our home.
We are amazed that even with all our involvement and willingness to work with the development, that it
tirned to be such a mess and now it sticks out like a sore thumb. Our view from our home is destroyed
forever, the city initially approved a narrow rambler and the second developer crammed a huge 2 story
home there instead . So the importance and safety of the 7( seven ) 15' to 20' trees that we planted is
everything to us, it makes living with this somewhat bearable. We know there is nothing now that can be
done about what has happened , so our focus now is to prevent any fiuther tlueat to the value of our home
by this development and make the best out of this situation.
The builder,(Rick Lesch) still has to drain the south side of the house, and with his unannounced egress
windows on the south side he is going to have to use extreme care to do so and it might take a little exha
time to do this. We aze asking the Ciry's assistance in making sure he dces so responsibly and without
threatening our large trees ability to grow and flourish. Trces of this size can never be replaced in this
narrow area, and they are the only thing that is making that new house bearable to have in our back yard
and to view daily from our kitchrn and family room.
It does appear they will be grading soon and we arrn't siue what he is going to need to do with the grading
issue. If you could keep us informed on what they are going to be required to do for drain ing we would
apprecia[e it. We still have a lot of re- landscaping to do to clean up the backyard which has been a mess
now for over two years and lmowing how the drainage is going to go would be a big help.

thc luture, including the right to cfioose the types, style an.d dcnsity uf Plantings, the iiglit to plant
aither mature trees or plants or to plant seedIings, bulbs or 2ny other type of PlAntings; provided,
Grantees shall use reasonablc efforts to minimize the impact the activity associated witl, the
installation and maintenance of the Plantings has on the owner of Purcel A, in p.v iicu]ar, the
eventual residontial owner of Parcel A, e.g., not using loud inachinery forplanting or
maintcnance late at night.
4• Grantees shall make no material chtuigos to the grading ofthc Easement Arca or
any uthcr materiat changcs to the surface of the Easenient Aren which matetially iuterfcres with
the drainage plan for Parcel A. If Grantee disturUs the surface of Parcei A in Ureacli of the
foregoing, the owners of Parcel B shall reasonably restorc the surFace of Parcel A to substantially
the samo condition as cxisted priar to the disturbance.
5. If any of the Plantings plantcd by tlie owners of Pazcel B dies or, in the opinion of
a registered horticulturalist, should bc removed due to discase or dumagc, then the owners of
Pnrcel B shall bc responsible for removing said tree or plant.
6• Tfie riglus granted hcreunder shall be limited to Uie planting and maintenance of
trees and other foliage. In no event shall any permtincnt physical structure be conslructed in the
Eascment Area by either Party,
7• The owners ofpazccl B shall indemnify tho owners of Parce] A against any clann
for personal injury or damage to property wluch occurs within the Eascment A.rca ns u direc[

respective heirs, personal representatives, devisees, atlministrators, tenants, successors and
assigns, and any other persons who hereaftes acquire an interest in Pazcel A or Parcel B by
oparation of law or other legal means. Whenever a transfer of ownership of any oFthe pnrcels

10. The grovisiwis of this Agreement uro for the cxclusive bonefit oFflie Parlies
hereto and their successors and assigns and not for the beiic£it of any third person; and this
Agreeiilent confers no rights, e:cpress or implied, upon any such third person; and khere are no
"tliird party benaficiaries" to tlus A„rreement.
