This letter is to inform you that the assumptions made in my
letter to you dated August 13, 1985 were invalid_ Your property
is currently zoned Agricultural and not Light Industrial as shown
on the City's zoning map. Therefore, the pending assessment
on your property for trunk area storm sewer is for the amount
of $742.50. I have enclosed a copy of the revised final assessment
roll for Project No. 410 showing the new figures. I regret any

1. Three (3) bedroom home has a daily flowage of 450
gallons per day.
2. The Average Perc Rate is 1 M.P.I. This will require
.83 sq. ft. per gallon per day or 374 sq. ft. w/6"
rock under the pipe.
3. Using 3' wide trenches and 12" rock under pipe, we
can reduce the sq. ft. of trench area to 100 lineal
ft. or two (2) 50' trenches.
4. Use existing septic tank and cesspool and add a pump-
ing station. The pump is to be set to pump 4 times a
day and pump 110 gallons per cycle.
5. An alarm is to be installed inside dwelling in case
of pump failure.
6. The septic tank haffles are to be checked and new ones
installed if necessary.

of $742.50. Z have enclosed a copy of the revised final assessment

Dear Mr. Schindeldecker:
This letter is to inform you of the possibility of reducing the
assessment to be levied against Parcel 020-76 of the S.E. ; of
Section 3, Township 27, Range 23, commonly known as 2875 Lexington
Avenue South.
Enclosed is an Assessment Agreement along with an explanation
of City policy for assessments where land use differs from current
zoning. City Council approval is required for all such variations
in assessments. Your signature on the Assessment Agreement will
allow the Council to consider the variation.
Also enclosed is part of the assessment roll which shows your
parcel and the amount that will be levied against it under current
conditions. The present zoninq classification of Light Industrial
will result in an assessment of $2,754.75. Under the Assessment
Agreement you would be assessed for the amount of $742.50.
If you wish to obtain the assessment variation please sign and

Agricultural/R-1 2onitlg. NOW THEREFORE, upon consideration of the mutual covenants herein, the
parties agree as follows:
1. The City agrees to assess said property for the Project and purposes
described above as if it were zoned AQricultural/R-1 at the rates now in
existence for property so zoned.
2. The Owner agrees for himself, his heirs, executors, administrators,
successors, and assigns, that if the actual use of said property is changed in
the future to a use or zoning category which is assessable at a higher rate
than the rate for the present use, the City may reassess or levy a supple--
mental assessment at such time equal to the difference between the assessment
for the new land use and the assessment for the present land use at the
assessment rates, according to City policy, in effeet at such future time.

RE: Garage as Accessory to Business Park Use
You had inquired whether a residential garage could be built on property currently zoned as
Business Pazk. The property was recently rezoned from Agricultural Dish-ict to a Business Park
District. There is a single family residence on the property. The answer is yes.
Under a permitted accessory use in the Business Park district, a garage or similar structure to
store vehicles and equipment shall be permitted when incidental to and cleazly subordinate to the
permitted principal use. The code is silent as to a situation wherein the principal use has not
changed, but rather the zoning designation has changed. While the present use is now non-
conforming, the principal use, a residence, is still permitted. Additionally, the garage, would be
allowed under the Business Park zone or the Agricultural pre-existing zone as supportive to a
single family residential home or to an office building.
Therefore, it is our opinion that flie construction of a residential type garage on a property which
has been re-designated as BP, Business Park under the City's zoning ordinance is still allowable
under the City Code.
