In December of 1998 a$S,OOO landscape security deposit was submitted to the City of
Eagan in conjunction with issuance of the building permit for construction of the building
at the above referenced location. These funds are eligible for release to the depositor at
this time.
Please note that the property owner continues to be responsible for maintaining the health
of ali plantings on the property. In accordance with section 11.70 of the Eagan City Code,
the property owner must maintain all landscaped areas, and install healthy replacement
plants for any plants that die or aze removed due to disease. Maintenance shal] inc]ude
removal of litter, dead plant materials, unhealthy or diseased trees, and necessary
prunmg.
An inspection will be conducted by city staff next spring/summer to verify that the
condition of the landscaping is acceptable under city code. Thank you for your attention

APPLICATION SUMMARY: Separate Special Use Permit applications have been
submitted requesting three temporary marketing signs exceeding the City Code allowed
height of 7'. All three proposed signs measure 8' x 8'.
COMMENTS: The three signs in question were mistakenly installed by the company Opus
hired to design and install each sign. The applicant offered to remove the signs until Council
action if staff felt it was necessary. Because staff received the three Special Use Permit
applications and the item would go before the City Council on January 15, dismantling the
signs did not seem necessary. The Counci] should act on each location/application.
If approved, these Special Use Permits shall be subject to the following conditions:
i. All signs shall be subject to the one-time sign fee of $2.50 per square foot.
2. The signs shall be allowed as long as they are well maintained.
3. All other applicable Ordinances are complied with.

The Minnesota Elevator Safety Code provides that the Minnesota Department of Administration, Building
Codes and Standards Division, Elevator Safety Section issue a letter of approval for all elevators,
dumbwaiters, escalators, moving walks, wheelchair lifts and maniifts (endless belt lifts) before they can
be legally put into service in Minnesota. ,
We received a letter stating that all recommended corrections have been addressed. We will
acknowledge that certifcation. This letter will serve as official approval for you to operate your elevator.
If at any time we find that the recommendations were not corrected, we will take action to assure
compliance with statute, rules and adopted codes.
NOTE: Compliance with Minnesota Rules and the ANSI/ASME A17.1, Safety Code for Elevators
and Escalators does not necessarily assure compliance with the Americans With Disabilities
Act of 1990.

LANDOWNER retains the right to use the easement property for any
lawful purpose, provided such use does not interfere with the

We have completed our review of the construction documents submitted in pursuit of obtaining a
building permit for the above-referenced project. This review is not intended to be an exhaustive
and comprehensive report. It is our goal that, this review will help you in complying with the
applicable codes and we are, therefore, requesting that the following items be addressed. Unless
otherwise noted, all references are to the 1994 U.B.C.
Sheet #2
1. Show on the site plan and supply details of signage for accessible pazking, van accessible
parking, and "No Pazking" at van accessible aisles. Minnesota State Building Code
(MSBC) 1340.1120.
Sheet #3
2. At wall type 92, please add the following comment: "All gypsum boazd joints must be
staggered." Also, supply the U.L. or gypsum association listing (number) that this wall
type is - Section 703.
Sheets 6 and 6.1
3. Combine these two plan sheets into one reduced plan and indicate 2"d floor exiting
patterns and all proposed exit signage. Chapter 10 and instructions at the top of our
commercial building application.
4. Provide verification that all openings in the azea separation walUhorizontal exit have 90
minute fire-resistive, self-closing, smoke control assemblies (i.e a door and hardware
schedule). Sections 504.6.2 and 1008.

5. Section 1/8: The area sepazation wall must run throueh the second story floor system.
The intent of the code in allowing area separation walls to be used to increase allowable
azea amounts is that the area separation walls be constructed such that the building be two
completely structurally independent units. If one unit or bui[ding suffers structural
failure, in a fire for example, it should be able to collapse and not take the other unit or
building with it. T'here aze several tested/approved systems that use break-away clips to
accomplish the above. Please supply connection details along with the revised drawings.
Section 504.
6. I have several concerns with this building being proposed as a"floating" or "thickened"
slab construction such as:
a) As the elevator shaft is supported on frost footings, won't it anchor the first and
second floor systems, thereby causing significant problems as these two systems
react to frost heave? (NOTE: The plans indicate an elevation difference of 6'0"
between the first floor and the elevator pit, but only scale out at 4', plus the ladder is
dimensioned at 7' which is relative to a 4' deep pit. What is the correct depth for the
elevator pit?)
b) Is the structural engineer aware of the soils report dated 12/5/97? My reason for
asking is that this report was completed with the understanding that five separate
sinale-storv wood frame buildings were to be constructed on the site. Also, it
required soil correction in the form of non frost soil be placed to a minimum of 3'0"
below the building pad and extend a minimum 5'0" beyond the building perimeter.
What is actually being proposed is a two-storv building and no soils correction/fill is
called out for on the drawings that I have.
c) Has the soils engineer reviewed the proposed building plans? We need a revised
soils report with comments and recommendations relative to the actual building
being proposed. Ellis, it is imperative that both the structural and soils engineer
approve the proposed construction and all of their recommendations/directives are
included in the construction of said building.
d) Civil and structural drawings should reflect soils report (i.e. soils correction)
requirements.
7. Section 3/8: The guardrail system must be designed such that a 4" diameter sphere
cannot pass through. Also, minimum handrail height is 34" with ma7cimum height being
38". Sections 509 and 1006.9.
Sheet #IO
8. Section 1/10 and Elevation 8/10: From the center line of the toilet to the edge of the sink
must be 42" cleaz (not 2'9" as indicated on the plan). Also, the horizontal grab baz
behind the toilet should be 36" in length. MSBC 1340.1170 and CABO/ANSI A117.1 -
1992.
GENERAL
9. The owner's and contractor's signature are required on the Special Inspections and
Testing Schedule. Please copy a[l test results/reports to me for review. Also, as a
reminder, the Special Inspector Fina1 Report must be completed by all applicable
personnel before a Certificate of Occupancy will be issued.

building permit for the above-referenced project. This review is not intended to be an exhaustive
and comprehensive report. It is our goal that this review will help you in complying with the
applicable codes and we aze, therefore, requesting that the following items be addressed. Unless
otherwise noted, ail references are to the 1994 U.B.C.

1. Show on the site plan and supply details of signage for accessible parking, van accessible
pazking, and "No Pazking" at van accessible aisles. Minnesota State Building Code
(MSBC) 1340.1120.

2. At wall type #2, please add the following comment: "All gypsum boazd joints must be
staggered." Also, supply the U.L. or gypsum association listing (number) that this wall
type is - Section 703.

?5. Section 1/8: The area sepazation wall must run throueh the second story floor system.
The intent of the code in allowing azea separation walls to be used to increase allowable
area amounts is that the azea sepazation walls be constructed such that the building be two
completely structurally independent units. If one unit or building suffers structural
failure, in a fire for exampte, it should be able to collapse and not take the other unit or
building with it. There are several tested/approved systems that use break-away clips to
accomplish the above. Please supply connection details along with the revised drawings.
Section 504.
J6. I have several concerns with this building being proposed as a"floating" or "thickened"
slab construction such as:
a) As the elevator shaft is supported on frost footings, won't it anchor the first and
second floor systems, thereby causing significant problems as these two systems
react to frost heave? (NOTE: The plans indicate an elevation difference of 6'0"
between the first floor and the elevator pit, but only scale out at 4', plus the ladder is
dimensioned at T which is relative to a 4' deep pit. What is the correct depth for the
elevator pit?)
b) Is the structural engineer aware of the soils report dated 12/5/97? My reason for
asking is that this report was completed with the understanding that five sepazate
sin Ig e-storv wood frame buildings were to be constructed on the site. Also, it
required soil correction in the form of non frost soil be placed to a minimum of 3'0"
below the building pad and extend a minimum 5'0" beyond the building peruneter.
What is actually being proposed is a two-storv building and no soiis conection/fill is
called out for on the drawings that I have.
c) Has the soils engineer reviewed the proposed building plans? We need a revised
soils report with comments and recommendations relative to the actual building
being proposed. Ellis, it is imperative that both the structural and soils engineer
approve the proposed construction and all of their recommendations/directives are
included in the construction of said building.
d) Civil and structural drawings should reflect soils report (i.e. soils correction)
requirements.
J7. Section 3/8: The guazdrail system must be designed such that a 4" diameter sphere
cannot pass through. Also, minimum handrail height is 34" with maximum height being
38". Sections 509 and 1006.9.

8. Section 1/10 and Elevation 8/10: From the center line of the toilet to the edge of the sink
must be 42" clear (not 2'9" as indicated on the plan). Also, the horizontal grab baz
behind the toilet should be 36" in length. MSBC 1340.1170 and CABO/ANSI A117.1 -
1992.
GENERAL
9. The owner's and contractor's signature are required on the Special Inspections and
Testing Schedule. Please copy aU test results/reports to me for review. Also, as a
reminder, the Special Inspector Final Report must be completed by all applicable
personnei before a Certificate of Occupancy will be issued.

Demr Mr. Ridley:
In accordance with our conversation June 4, I am proposing to enhance our previously submitted
landscaping plan by planting additional evergreen trees. The attached freehand drawing shows a
total of nine, six foot tall Black Hills Spruce trees 15' on center to be located on the southern and
southeastern edges of the building area. I believe this additional landscaping will serve to screen
the sides of the facility.
As you are no doubt aware, the proposed buitding will be situated over 600' north of Lone Oak
Road and over 450' east ofHighway 35. The 600' between Lone Oak Road and the building has
many existing trees. Of the 13 plus-acres we are purchasing, less the 3.5-acres is developable. It
cannot be developed in the future because of wetlands 1nd city ponding easements. This area is
currently covered with many trees that will screen the building from Lone Oak Road. The
additional spruce trees will provide additional screening.
It is my understanding that the City will allow the south side of the building to utilize metal
components in accordance with our previously submitted plans provided the nine aforementioned
trees are added to the Iandscaping plan.
