the undersigned understand and agree that no vehicles will be pazked inside the building. The east
overhead door will be used for the delivery of equipment or equipment removal from time to time. The
dock door with the groposed ramp, if completed, will be protected from vehicle entry by concrete
bollard as noted on our final plans.
We understand and agree that if our use changes or that we violate the assurances given in this letter,
that the City of Eagan will immediately require that we meet the Intemational Mechanical Code for an
enclosed garage or building.

Lexington Avenue Postal Facility
Dear Pete:
The City has reviewed the County's on-street parking concern
adjacent to the postal facility on Lexington Avenue. The City
Police Department has received a number of complaints concerning
the parking on Lexington Avenue, and at least one accident has
occurred in the last six months as a result of the on-street
parking. In the past, the City Police Department has contacted the
postmaster of the postal facility and expressed some concern with
the lack of available parking for the post office patrons. The
postmaster had instructed his employees to park in the adjacent
commercial areas leaving the most possible available parking stalls
in the front of the building for the post office patrons.
Present City development codes require a business to provide
adequate off-street parking to accommodate the needs of the
particular development. The County is under no obligation to
provide on-street parking for the businesses in this area of
Lexington Avenue. Therefore, City staff is of the opinion that
a formal resolution from the City Council is not necessary for
County Soard consideration in this matter. Please advise us of the
County Board's decision on the matter so that notification can be
given to the appropriate City departments.

In reviewing your memo of November 6, I'm not surprised that the
County is receiving complaints and concerns regarding periodic on-
street parking. This issue has been brought to the City Council's
attention in the past with direction being provided to the Police
Chief to work with the manager of the postal facility to try to
minimize the occurrence of on-street parking. During that
discussion, it was noted that the City does not have the
jurisdiction to post No Parking signs on a County road and that
further concerns should be directed to the County's attention for
their action.
In reviewing your memo, it is apparent that the County Highway
Department concurs with the problems being experienced with on-
street parking. Due to the fact that this is a County road, they
certainly have the opportunity to take whatever remedial action is
necessary to restrict on-street parking. Present City development
codes require that businesses provide adequate off-street parking
to accommodate the needs of their facility. Therefore, there is
no need for the County to anticipate or provide any on-street
parking along this stretch of Lexington Avenue. Therefore, I feel
they have the ability to correct the situation and bring this issue
to the County-,Peard's attention without a formal resolution from
the City Coil.

I have received a number of complaints regarding the parking on
Lexington Avenue near the Postal Facility. I understand we have
had, at least, one accident in the last six months, as well as a
number of close calls, relating to customer parking near the
facility.
As you are probably aware, Councilman Wachter has expressed his
concern with the parking problem and asked that the Police
Department monitor it. It has been our feeling that parking
restrictions would be appropriate in that area for the safety of
the public.
Approximately 18 months ago I spoke with the Postmaster at the
Eagan Facility. They were going to have their employees park in
the adjacent commercial area. That helped for a short period of
time, but I see recently that parking on Lexington has increased.

Pete Sorenson, Dakota County's Traffic Engineer, has requested the
City review the parking requirements/traffic congestion which is
occurring adjacent to the postal facility on Lexington Avenue. The
County has received numerous complaints from post office patrons,
as well as the general public, regarding the overflow parking which
is occurring on Lexington Avenue adjacent to the post office. The
County is of the opinion that Lexington Avenue is a 4-lane roadway,
and traffic volumes indicate that parking along the 4-lane roadway
severely restricts the function and the safety of the traveling
public in that area.
As in the past, before the County posts parking restrictions along
County roads within the City, the City Council has passed a
resolution which requests the County to restrict the parking in
designated areas. The County staff, in turn, takes the City's
resolution to the County Board and the County Board authorizes the
parking restriction. County staff then posts the No Parking signs
at no cost to the City.
For your information, the County is planning to upgrade the Lone
Oak Road/Lexington Avenue intersection in 1991. The planned
intersection upgrade would include providing left-turn lanes on
Lexington Avenue similar to the Lexington Avenue and Yankee Doodle
Road intersection. The County is of the opinion that allowing
parking to continue in front of the post office on Lexington Avenue
would interfere with the safe function of the intersection when it
is upgraded.
If the City determines that a parking restriction is not necessary
in this area, a letter from City staff stating such would be
adequate. The parking restriction concern would then be addressed
in detail at the time of the intersection improvements.

STORM SEWER EASEMENT
THIS EASEMENT is made this 14-day of October, 1992, by and
between RYAN CONSTRUCTION COMPANY OF MINNESOTA, INC., a
Minnesota corporation ("Owner"), and the CITY OF EAGAN, a Minnesota
municipal corporaUon (the "City"), with reference to the following facts
and circumstances:
A. Owner is the fee owner of certain real property (the "Properiy")
situated in the City of Eagan, Dakota County. Minnesota, legally
described as follows:
Lot Fifteen (15), except the South 61 feet of the West 300 feet
thereof, in Eagandale Center Industrlal Park No. 2, according to
the recorded plat thereof.
B. The City requires an easement for storm sewer purposes over a
portion of the Property, and Owner has agreed to grant the same
upon certain terms and conditions hereinafter set forth.
NOW, THEREFORE, in consideration of the foregoing facts and
circumstances, and for other good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, the parties
hereto hereby agree as follows:
1. Owner hereby grants to the City a perpetual, non-exclusive
easement for storm sewer purposes over, across and under that portion
of the Property legally described on Exhibit A attached hereto and made a
part hereof (the "Easement Tract").
2. The easement rights herein granted shall include the right of
the City to enter upon the Easement Tract at all reasonable times, but
upon reasonable prior notice (except in the case of an emergency, in
which case no notice shall be required), to construct, reconstruct,
inspect, repair and maintain pipes, conduits and other facilities relating
to the City's storm sewer system, and, incident to the exercise of such
right, the further right to remove trees, brush, undergrowth and other
obstructions within the Easement Tract.
3. After completion of any of the work authorized by the terms of
Paragraph 2 hereof, the City shall promptly restore the Property to the
condition in which it was found prior to the commencement of such
work, all at the sole cost and expense of the City; provided, however, that
the City shall not be obligated to restore h-ees, brush or undergrowth
which aze destroyed as the result of such work.
4. The City shall, and does hereby, indemnify and hold Owner
harmless from and against any and all losses, claims, damages, liability,
attorney's fees and other expenses related to, arising from and/or
growing out of the exercise of the rlghts herein granted to the City.
5. Owner shall have the right to relocate the Easement Tract to
another portion of the Property, and upon receipt by the City of written
notice of the exercise of this right by Owner, the City shall cause all of its
improvements then located in the Easement Tract to be relocated to the
new azea of the Easement Tract, as speci8ed by Owner in such notice;
provided, however, that if Owner exercises this right. Owner shall
reimburse the City for the reasonable costs incurred by the City in
relocating such improvements promptly upon receipt by Owner of a
statement from the City in which such costs are itemized.
6. The terms and conditions of this agreement shall be binding
upon, and inure to the beneflt of, the parties hereto and their respective
successors, and assigns, and shall run with the Property.
