the above address.
There appears to be two specific areas of concern. One is the
intended use of the dock area and the other is the use of our shop
structure. I will comment on each of these areas individually.
The dock area is used more as a transfer area of general
merchandise from trailer to trailer, rather than a storage area.
Any merchandise sitting in this area while waiting to be loaded is
typically only 3 to 4 feet high. We do not have any high stacking.
We also do not palletize/rack material for storage. At no time

I hope this letter accurately summarizes our telephone conversation of November 23, 1994,
regarding the status of the Trans X site in relation to the conditions placed on the Conditional
Use Permit (CUP) for a truck and freight terminal approved by the City Council on May 7, 1991.
My November 23, 1994 site inspection revealed that, currently, the northern portion of the
property that is not paved is now being utilized as part of the terminal operation, the new cyclone
fence along the west property line is not opaque and there are slats missing/damaged on the
fencing south of the new fence, and the trash/recycling containers are being stored outdoors.
CUP conditions currently not being met require: all areas of the site being utilized for
tractor/trailer parking or movement must be surfaced with bituminous or concrete and the
perimeter of the areas must be constructed of concrete curb & gutter, the fence along the western
par property line must be opaque, and all trash and recycling containers shall be stored indoors.
(I have attached a copy of the 5/7/91 Council minutes)
In addition to those items above, which are regulated by your CUP, ground cover on the berm
along the north property line has not been fully established, there were a large number of pallets
piled up outdoors, and two movable storage containers had been placed near the shop area.
Storage of these items requires a separate CUP for outdoor storage.

April 23 meeting and they had recommended approvaL Director of Community Development Runkle desert-bed
the application and its location. He said all lots meet the requirements for width and the applicant is in

Gustafson moved, McCrea seconded a motion to approve the preliminary plat for Skyvkw Addition for
Lahner-Dtmn, consisting of three lots in approximately 16.4 (Agricultural) acres located in the southwest quarter
of Section 36 and subject to the following conditions.
1. These standard conditions of plat approval as adopted by Council action on July 10, 1990 shall
be complied with: 111, B2,84, Cl, C2, D1, El, Fl, G1, Hl.
2. A variance to the minimum lot width for Lot 3 shall be approved
3. No direct access shall be permitted from Highway 3.
4. The development shall construct a ditch along the east side of Dodd Road Driveway culverts

3 and Farm Road

CONDITIONAL USE PERMIT/TRANS X/TRUCH AND FREIGHT TERMINAL
Mayor Egan introduced this item as a Candit+M,l Use Permit for Trans X to Allow a Trod and Freight
Terminal in an LI (Light Industrial) District on Lot 6, Eagandale Center Industrial Park #2 Located Along Lone
Oak Cin]e in the Southwest Quarter of Section 2. Director of Community Development Risible then deserted
this conditional use permit and its location. He described the number of trips proposed to be generated at this
site, however, the City's traffic consultant did not feel it would overburden the traffic system at this location.
He added that one additional issue unrelated to the conditional use perms and involving the storm drainage
system will have to be resolved. He said it was an issue that would iinvolve a amber of Giber properties also
in this area.
Mr. Mike Greaser, of Eagan Construction, and Mr. Bob Vanney, an architect with Vaaoey Associates,
warn present to answer any questions.

1. Motor fuel operation shall be approved by the City Fire Marshal.
2. A landscape plan shall be reviewed and approved by staff prior to building permit isstuance.

Current City code requires that parking lots shall be surfaced with bituminous or concrete and
the edge of the parking lot shall be constructed with a concrete curb and gutter.
The parking lot shall be constructed with concrete curb and gutter to contain all vehicles and
to convey sud4cx water runoff to the proposed storm sewer.
11. The developer shall protect the ecsting 18 foot sanitary sewer force main that runs along the
south property line of this site. The developer will be responsible for any damage done.
12. The driveway connection to the site at Lone Oak Circle will be required to be constructed with
a concrete apron.
Director of Public Works Colbert said that with the upgrading of Lane Oak Road, the drainage in the
general area would be studied and he suggested that the study be expanded to include Lone Oak Circle, became
some modifications may need to be made at that intersection.

Dear Mr. Feider:
We have completed our review of the plans and specifications submitted in pursuance of
obtaining a building permit for the above-referenced project. The construction documents
may contain certain deficiencies which may not be included in this report, but this shall not
be construed as an approval of such deficiencies nor relieve the responsible parties from
complying with any applicable provision of the Minnesota State Building Code or other state
or local codes, laws, and ordinances.
1. Provide recycling space in accordance with Minnesota Rules, part 1350.1775. Please
note that such space must also comply with Article 11.201(d) of the Fire Code.
2. Provide a janitor's service sink on each floor level of the office/terminal building. See
Minnesota Rules 1305.1795, table 5-E.
3. Please verify that toilet compartment walls are finished with materials consistent with
the provisions of section 510(b) of the building code.
4. Bollards should be provided to prevent blockage by lifts, etc. of doors 0-209A, 0-209B,
and 0-216.
5. Goosenecks should be provided over the parapet on the ladder (of detail 3/A-5).
6. The structural drawings and specifications should be reviewed by the structural engineer
of record and revised, as necessary, to accommodate the proposed change of grade at
the main entry of the office building.

7. Section 302 of the building code was recently amended to include a provision
requiring that applicable "Section 306 Special Inspections" be specified in the
construction documents. Please have the engineer of record complete and return to
this department the enclosed "Special Inspection and Testing Schedule" (guidelines for
its use accompany the schedule). Each special inspector must submit a final
inspection report to our department before a Certificate of Occupancy will be issued
for either building. Also enclosed is a sample "Special Inspector Final Report" which
may be used to fulfill this requirement.
8. Because the Code requires the project to be built in conformance with the approved
plans and specifications, the structural specifications must specify the appropriate
Uniform Building Code standards applicable to the project. Wherever other
nationally recognized standards have been adopted (or amended) by reference in a
building code standard, such other standards, when specified in the construction
documents, should be cross-referenced to the specific UBC standards.
9. Provide handicap parking signage as required by Minnesota State Statute 169.346.
10. Rooms that connect with the maintenance shop (such as offices, lunch room, toilet
rooms, etc.) must be supplied with conditioned air under positive pressure. See
section 705 of the building code.

We have completed our review of the plans and specifications submitted in pursuance of
obtaining a building permit for the above-referenced project. The construction documents
may contain certain deficiencies which may not be included in this report, but this shall not
be construed as an approval of such deficiencies nor relieve the responsible parties from
complying with any applicable provision of the Minnesota State Building Code or other state
or local codes, laws, and ordinances.
1. Provide recycling space in accordance with Minnesota Rules, part ].350.1775. Please
note that such space must also comply with Article 11.201(d) of the Fire Code.
2. Provide a janitor's service sink on each floor level of the office/terminal building. See
Minnesota Rules 1305.1795, table 5-E.
3. Please verify that toilet compartment walls are finished with materials consistent with
the provisions of section 510(b) of the building code.
4. Bollards should be provided to prevent blockage by lifts, etc, of doors 0-209A, 0-20913,
and 0-216.
5. Goosenecks should be provided over the parapet on the ladder (of detail 3/A-5).
The structural drawings and specifications should be reviewed by the structural engineer
of record and revised, as necessary, to accommodate the proposed change of grade at
the main entry of the office building.

7. Section 302 of the building code was recently amended to include a provision
requiring that applicable "Section 306 Special Inspections" be specified in the
construction documents. Please have the engineer of record complete and return to
this department the enclosed "Special Inspection and Testing Schedule" (guidelines 16r
its use accompany the schedule). Each special inspector must submit a final
inspection report to our department before a Certificate of Occupancy will be issued
for either building. Also enclosed is a sample "Special Inspector Final Report" which
may be used to fulfill this requirement.
& Because the Code requires the project to be built in conformance with the approved
plans and specifications, the structural specifications must specify the appropriate
Uniform Building Code standards applicable' to the project. Wherever other
nationally recognized standards have been adopted (or amended) by reference in a
building code standard, such other- standards, when specified in the construction
documents, should be cross-referenced to the specific UBC standards.
9. Provide handicap parking signage as required by Minnesota State Statute 169.346.
10. Rooms that connect with the maintenance shop (such as offices, lunch room, toilet
rooms, etc.) must be supplied with conditioned air under positive pressure. See
section 705 of the building code.

APPLICATION SUMMARY: An application has been submitted requesting a Conditional
Use Permit to allow a truck and freight terminal in a Light Industrial zoning district.
BACKGROUND: Trans X began operation in Winnipeg in 1957 and has been operating
in the United States since August 1990 when they purchased M.W. Ediger Trucking. The
applicant is currently leasing terminals in Chicago and Dallas. The Eagan facility will be the
U.S. headquarters and will be run independently of the Canadian operation.
Of the 140 people employed by Trans X in the United States, one hundred will be based
in Eagan. The Eagan site will have approximately 75 trucks and 100 trailers, however 25
trucks and 50 trailers will actually be on site on average at one time.
COMMENTS: The site is surrounded by E-Z Air Park on the north, Villaume Lumber on
the east, warehouse leasing on the south, and City park land on the west. The City Code
states that when any Industrial district abuts a residential, agricultural, or public facility
(Parks) district, a fence or compact evergreen hedge not less than 6' in height shall be
erected and maintained. The applicant will provide an opaque fence not less than 6' tall
along the west property line. Should the applicant wish to construct a fence over 6' tall, the
City Council will have to approve a Special Permit.
The site in question has a total size of approximately 6.1 acres. The applicant is proposing
a total building coverage of approximately 6%. The City Code allows a maximum of 35%.
The site plan calls for a 3,250 sq. ft. office attached to a 6,500 sq. ft. terminal and a separate
shop building of 6,600 sq. ft. Light Industrial building setback and parking requirements are
met.
The proposal also includes a motor fuel pump island. This activity and location will have
to be approved by the Fire Marshal. The building will be constructed with decorative
concrete block that will include brick trim and accents throughout all buildings on site.
GRADING DRAINAGE/EROSION CONTROL: A grading, drainage and erosion control
plan was not submitted as part of this application. The development will be required to
submit detailed plans for staff review with the grading permit or building permit submittal.
City staff will review the grading, drainage and erosion control plan to ensure compliance
with City requirements for minimum and maximum slopes, protection of adjacent properties,
construction of temporary and permanent vegetation to control erosion and construction of
silt fence to control erosion.
According to the City's Comprehensive Storm Water Management Plan, this site is proposed
to drain to the south to an existing 18" storm sewer in Lone Oak Circle. The capacity of
the 18" storm sewer is approximately 15 cubic feet per second. With full development of
the 7.91 acres of this site, the surface water runoff during a 5 year storm would be 24 cfs.
The three existing developments on Lone Oak Circle currently drain to the 18" storm sewer
and the runoff from these three developments is 54 cfs. So, if this applicant is allowed to
develop this site and convey its surface water runoff to Lone Oak Circle, the total flow
during a 5 year storm will be 78 cfs. The excess flow of 63 cfs would drain overland on
Lone Oak Circle to Lone Oak Road and pond in the low point of Lone Oak Road.
Two options for this development have been analyzed to provide for storm water drainage
of the site. The first option for this site is to convey all site generated storm water runoff
to a new pond prior to discharge into the existing City storm sewer system on Lone Oak
Circle. The runoff from this site will require a pond with storage volume of 2.0 acre feet
and a surface area at the normal water level of 0.5 acres to meet 100 year design standards.
The flow out of the pond would be limited to a 1.0 cfs flow rate to the existing 18" storm
sewer.
The second option for this development is to petition the City to upgrade the storm sewer
on Lone Oak Circle and provide ponding off-site. The City would prepare a feasibility
report and then hold a public hearing to discuss the new storm sewer layout for the area and
the proposed assessments for the tributary drainage area. If the second option is the
preferred alternative for the development, then the public hearing would have to be held
and the storm sewer improvement project approved by the City Council before a building
permit could be issued.
WATER QUALITY: The proposed site was analyzed for water quality requirements in
accordance with the City's Comprehensive Water Quality Management Plan. The site is
located within Watershed District E and the downstream pond is EP-1 which is classified
as a nutrient trap.
If the surface water runoff from the 7.91 acres of this site was conveyed to a new pond, then
the pond should be constructed to the following parameters:
Wet Pond Volume = 2.95 acre feet
Minimum surface area of pond = 0.5 acres at NWL
If these parameters are met, the water quality treatment requirements for this site will be
met.
UTILITIES: Sanitary sewer service of sufficient depth and capacity is readily available to
the site in Lone Oak Circle. The sanitary sewer in Lone Oak Circle is a 9" VCP (clay) line
that was constructed in 1969. A 6" sewer service line has been stubbed to the site off the
9" line in Lone Oak Circle.
The developer shall protect the existing 18" sanitary sewer force main that runs along the
south property line of this site.
Water main service of sufficient pressure and capacity is readily available along the south
property line of the site. An 8" (cast iron) CIP water main was constructed along the south
property line in 1969 and the 8" line can be connected to provide water supply and fire
protection to the site. The water main layout shall provide hydrants in locations that meet
the City requirement of 250' radius for fire protection for an industrial site.
STREETS/ACCESS/CIRCULATION: Street access to this site is readily available from
Lone Oak Circle which is a 44' wide bituminous street with concrete curb and gutter. The
driveway connection to this site at Lone Oak Circle will be required to be constructed with
a concrete apron.
City code requires that parking lots shall be surfaced with bituminous or concrete and the
edge of the parking lots shall be constructed with a concrete curb and gutter.
EASEMENTS/RIGHT-OF-WAYIPERMITS: The development will be required to provide
the appropriate ponding easement for the new pond to incorporate the required high water
level and storage volumes required.
The City is requesting that a ten foot permanent easement over the existing 18" sanitary
sewer force main be dedicated along the north side of the line. The location of the line
should be field verified prior to the preparation of the easement.
All regulatory agency permits shall be acquired within the appropriate timeframe as
required by the affected agency.
FINANCIAL OBLIGATION - 2-CU-3a-91 Trans X
Based upon the study of the financial obligations collected in the past and the uses proposed
for the property, the following charges are proposed. The charges are computed using the
City's existing fee schedule and connections proposed to be made to the City's utility system
based on the submitted plans.

If approved, this Conditional Use Permit shall be subject to the following conditions:
1. Motor fuel operation shall be approved by the City Fire Marshal.

3. All trash and recycling containers shall be stored indoors.
4. Fences taller than 6' will require a Special Permit from the City Council.
5. All signage shall be subject to the one-time sign fee of $2.50/sq.ft.
6. All other applicable City Codes shall be adhered to.
7. A detailed grading, drainage, erosion and sediment control plan must be prepared
in accordance with current City standards and approved by staff prior to issuance
of a grading permit or building permit.
8. The storm sewer layout for this site shall be designed in accordance with the City's
Stormwater Management Plan.
9. Current City Code requires that parking lots shall be surfaced with bituminous or
concrete and the edge of the parking lot shall be constructed with a concrete curb
and gutter.
10. The parking lot shall be constructed with concrete curb and gutter to contain all
vehicles and to convey surface water runoff to the proposed storm sewer.
