THIS PONDING AND LTTII.ITY EASEMENT, made and entered into ttris,_j?tday of
2003, by and between ANNE M. MAAG, a single person, hereinafter refened to
as ` andowner, and TBE CITY OF EAGAN, a municipal corporation, organized under the laws
of the State of Minnesota, hereinafter referred to as the "City".
WITNESSETH:

NOW, TfMREFORE, the said Landowner, in consideration of One Dollaz ($1.00) and other
good and valuable consideration, to it paid 6y the City, receipt of which is hereby aclmowledged,
hereby grants an easemem to the above premises to the City, its heirs and assigns, for ponding and
conservation ptuposes, including the nonnal practice of Slling with watet the above-descnbed premises
from storm sewer nmoff and for utility line puiposes.
The City shall have the right to do whatever is necessary for the enjoyment of the rights herein
granted, including the right of clearing the easement area to allow for the use of the land as stated
herein, and also including the right to excavate within the easement azea and to install, lay, maintain,
operate and repair storm sewer pipes and utility lines and the right of ingress and egress to and fi-om
said tract of land and over and across the easement azea for these pwposes.
And the said Landowner, for itseY its heirs, e3cecutors, administrators and assigns does hereby
release the said City of Eagan, its successors and assigns, from all claims for any and all damages
resulting to said land by reason of the location of lake, ponding azea or utility line.
By acceptance of these easemerns, the City agrees that it shall restore the property located
outside the anticipated perimeter of standing water to as near the existing grade as is reasonably
possible and fiurther agrees to replace existing cuitivated shrubs or sod and to seed all other areas not
covered with standing water.
It is expressly understood that the City, its successors or assigns shall waive and release said
lands or that portion thereof used for permanent lake or ponding purposes from any special assessment
levied on an azea basis on account of any improvement in the City of Eagan for such time as said lands
aze used for permanent lake or ponding piuposes, but at such time as such uses or purposes aze
abandoned then said lands may again be subject to such special assessments, as have been levied or
may hereafter be levied.
IN WITNESS WHEREOF, the Landowner has caused this easement to be executed as of
the day and year first above written.
