The City shall have the right to do whatever is necessary for the enjoyment of the rights herein granted, including the right of clearing the easement azea to allow for the use of the land as stated herein, and also includin; the right to excavate within the easement azea and to install, lay, maintain, operate and repair storm sewer pipes and utility lines and the right of ingress and egress to and &om said tract of land and over and across the easement area for these purposes. 1) And the said Landowner, for itself, its heirs, executors, administrators and assigns does hereby release the said Ciry of Eagan, its successors and assigns, from all claims for any and all damages resulting to said land by reason of the location of lake, ponding azea or utility line. By acceptance of these easements, the City agrees that it shall restore the property located outside the anticipated perimeter of standing water to as neaz the existing grade as is reasonably possible and further agees to replace existing cultivated shrubs or sod and to seed all other azeas not covered with standing water. It is expressly understood that the City, its successors or assigns shall waive and release said lands or that portion thereof used for permanent lake or, pondiag piuposes &om any special assessment levied on an azea basis on account of any improvement in the City of Eagan for such time as said lands aze used for permanent lake or ponding purposes, but at such time as such uses or purposes aze abandoned then said lands may again be subject to such special assessments, as have been levied or mav hereafter be levied.
