THIS PONDING AND UTII,ITY EASEMENT, made and entered into this_&:61day of

hu6band'and wife, hereinafter referred to as "Landownee', and THE CITY OF EAGAN, a
municipal corporation, organized under the laws of the State of Minnesota, hereinafter referred to
as the "City".

WHEREAS, said Landowner is the owner of the tracts of land in the City of Eagan, Dakota
County, Muuiesota, legally descn'bed as follows:

thereof, Dakota County, Minnesota, described as follows: Commencing at
Point A which point is 425 feet southerly of the noRheasterly comer of said
Lot 9, thence from said point to Point B which point is northerly of and
406.5 feet distant from Point A on a straight line which extended intersects
with a point on the northerly line of Lot 9, ]ying 190 feet westerly of the
northeasterly comer of said Lot 9; thence southwesterly from said Point B
in a curved line, which at all points is northerly of, and 406.5 feet distant
from Point A to Point C which point is northerly of and 406.5 feet distant
from Point A, the point of beginning on a straight line which extended from
Point A through Point C intersects with a point on the northerly line of Lot
10, 29 feet easterly of the northwesterly corner of said I.ot 10; thence from
said Point C in a straight line southerly to Point A, the point of beginning.
Lying southeasterly of Line A described below.
Line A is described as commencing at the intersection of the west line of
said Lot 10 and a line 14425 feet northerly and parallel with the south line
of said Lots 9 and 10; thence easterly along said pazallel line a distance of
174.90 feet; thence deflecting to the left 90 degrees 00 minutes 54 seconds
a distance of 125.67 feet to the point of beginning of said Line A; thence

Together with a permanent drainage and utility easement over, under and
across that part of the above described property which lies northwesterly
and northeasterIy of a line described as beginning at the point of

Line A a distance of 24.46 feet; thence deflecting to the right 114 degrees
27 minutes 23 seconds a distance of 172.13 feet to the northwesterly line
of the above described property and said line there temunating.
Together with a temporary construction easement which lies southwesterly
of the above described drainage and utility easement, northwesterly of the
above described ponding and utility easement, and northeasterly of a line an
its ezctensions which lie 10.00 feet southwesterly of and pazallel with the
southwesterly line of said above described drainage and utility easement.
Said temporary construction easement expires October 31, 2004.

NOW, TBEREFORE, the said Landowner, in consideration of One Dollaz ($1.00) and other
good and valuable consideration, to it paid by the City, receipt of which is hereby acknowledged,
hereby grants an easement to the above premises to the City, its heirs and assigns, for ponding and
conservation purposes, including the normal practice of filling with water the above-described premises
from storm sewer runoff and for utility line purposes.
The City shall have the right to do whatever is necessary for the enjoyment of the rights herein
granted, including the right of clearing the easemern azea to allow for the use of the land as stated
herein, and also including the right to excauate within the easement azea and to install, lay, maintain,
operate and repair storm sewer pipes and utility lines and the right of ingess and egress to and from
said tract of land and over and across the easement azea for these purposes.
And the said Landowner, for itselt its heirs, eacecutors, administrators and assigns does hereby
release the said City of Eagan, its successors and assigns, from all claims for any and all damages
resulting to said land by reason of the location of lake, ponding azea or utility line.
By acceptance of these easements, the City agrees that it shall restore the property located
outside the anticipated perimeter of standing water to as near the existing grade as is reasonably
possible and further agrees to replace existing cultivated shrubs or sod and to seed all other azeas not
covered with standing water.
It is expressly understood that the City, its successors or assigns shall waive and release said
lands or that portion thereof used for permanent lake or ponding pwposes from any special assessment
levied on an azea basis on account of any improvement in the City of Eagan for such time as said lands
are used for permanent [ake or ponding puiposes, bat at such time as such uses or purposes are

abandoned then said lands may again be subject to such special assessments, as have been levied or
may hereafter be levied.

the day and year first above written.

OBSERVATIpN$ ANO RECOMMENDATIONS:
The initiaf site visit occurred on November 13, 2002 at approximately 8:00 AM to 9 30 PM. Infqrmation defined within this
report was either detertnined by myseli or presented to me by you. The following observations were made at that site
visit.
1 Present at site was youre,elf, Doug Fel! Seth Spychala of MGI, and your excavation conMactor Mark.
2. The weather was clear and approximately 25 degrees F.
3. The strueture being evaluated is an existmg home with a new addition under cortstruction.
4 The existing house is a single story house with a walkout basement.
5. For pUrposes of this report, the front of the house face5 the rwrth, which is Lone Oak Lane. The new addition is on
the 4ack of the house (south side). The existing walkout basement of the house is facing the south.
8. The new addition is a Mro story with a slab on grade abuttlng the south side of the existing house.
7 You currendy reside at the residence.
8. There are neighbors to the east and west of the reaidence and the backyard runs down to a wetland.
9. No existing building drawings, speciFication or any ather documents were available for our review for this evaluation.
Drawings prepared hy Design Solutions sheets A-1 arxt A-2, drawn by Susan Braun dated 10-19-2002, for the new
addition were made availa6le to MGt for review for this evaluatian.
10. Tne excavadon for the new aqdition was complete. The footings and CMU foundation walls have been placed arM
constructed.
The CMU foundation walls along the south side of the new addition are eccenuic to the new foottngs.
This concem was brcwght to your attention even thouph it is out of ffie acopa of services for this
contract You had stated that you had diacussed this wlth othens and are in agreement lhat it is
acceptabFe. WRh the CMU foundaGon wall being ecceniric, the effective footlng width has 6een
reduced eonsfdere6ly. This eondltion can incraase the potential for signlTlcant overall settlement,
differential settlement, and or soil failure. The determinatlon of the footing capacitiea is outside the
scope of service for thls sgreement,
11. The existing hpuse basement wdlls consist of concrete masonry units (CMU) an strip footings.
12 CuRently there are punched openings +n the CMU basement wall for a strip of windows and a man door along the
east side ot the basement wa11. The intent fvr the wall between the existing house and the new addition on the lower
level is that an exisGng vuindow opening will be replaoed with a door opening, not effectively changing the original
ioad path. The remainder of the blxk wall wil[ remain.
13. The existing soil along the south basement wall has been removed for the excavation vf the new addition.
observing the existing soil stains and waterproofing on the souttt basement wall it is apparent that the existing Soils
were high on the west side sloping down towards the easG The excavation reveled that the existing strip footing
along the south basement wall steps down at the mandoor approximatefy 6 feet for the corner of the house on the
east side.

OBSERVATIONS AND RECDMMENOATIONS CONTfNUED:
14, Due to the required frost cover for the new addition footings and the relative elevation difference between the new
addition footings and the exis6ng house strip footing along the south wall, the top of the new addition foundatiort wall
is approximately at the same elevation as the existing south wali strip footing.
It is MGI's recommendation to pravide proper frost cover for the exisdng south waii strip footfng near
the west side oi the neW addition by placing soil back to the originAl elevafion where It wag prior to the
excavation of the new additlon. Fhis witl require that the new addition CMU foundation wail along the
west side be extended up and out to the south approximstsly 4 feet fn both directiorts. This small
ex6ensinn of the wall w111 have to be designed to retain the soil at this Iceation. This will allow the
wood waFl framing of the new addltion remain above grade. See attached sketch for addiGpnal
information.
The close proxtmity af the existing mandoor to the east side o( the new addition foundatlon wall
prohibita any soil being retained in order to provide proper frost cover. Since the exlsting sMp footing
along the south basement wall has afready been undermined (It is now epanning approximately 3 faet,
bearing on undisturbed Soli and the new addition foundation Mrall) MGI fs recommending that it be
underpittned with a peitch fopdng. This can be accomplfshed by hand digging the rest of the soil out
from under the exlsting strip tpoting, as deep as the footfng is wide and from the new foundation wail
to where the exlsUng strip footing steps down at the existing mandow. Boih faces of the trench
footing can be fortned with a sheet of plywood, the new addition foundatFon wall and the exlsting step
of the atNp footing can fortn the sldes. See attached sketch for additional Fnformatian.
The euisting sauth hasement wa11 strip foofing between the Mro CMU foundaHan walls ot the new
addition la currently being aupported by undisturbecf soil. However the soil hae been cut vertieally
away from the strip footing leaying it vuinarahle ta cotlapse. Cautfon should be exerclsed as not to
disturbed any of the soii below the strip footing and undermina 8. Any soll that sloughs away should
be repiaced by carefully Compacting it back under the Strip fooqng. If thare is a delay kn Inclosfng the
new additlon the sttip footieg shouW be protected from the frost, molsture, and the possibilfty of
someone faiting in. Once the addi6on Is enelosed the footing will be an Interior strip footfng and the
heat 1088 from the house should koep the footlng from heaving.
15. The spread farting for the proposed cotumn of the new addition had also been cast, This spread footing runs under
the existing south basement watt strip fvoting.
My gap between the top of the new spread footing and the bottom of the existing strip footing shall be
filled with Compected soll or Iean concrete. It was observed and brought to your attention that it
appears that the proposed wlumn and column load on the new apread footlng wili be sccentria The
design of thls spread tooting, column, and any loads to them are not included in these scope of
services. MIGI inTormed you during a phone conversatlon that items should 6e deslgned and reviewed
by a Structurel Engineer.
16. During the site vesit there were no gutters or downspouts present on the house_
We recommend that gutEars and downspouts be iostalted to keep moisture away from the foundatian of
