l 2003, by and beriveen DALE M. NAATJES and SUZANNE NAATJES, husband
anwife, hereinafter referred to as "Landowners, and TBE CITY OF EAGAN, a municipal
corporatioq organized under the laws of the State of Minnesota, hereinafter reFerred to as the
"City."
WITNESSETH:
WHEREAS, said Landowner is the owner of the tracts of land in the City of Eagaq Dakota

An easement over, under and across that part of the following described
property:
That part of Lots 9 and 10, Zehnder Acres, described as follows:
Commencing at "Point A" which point is 425 feet southerly of the
northeasterly comer of said Lot 9, thence from said point to "Point C"
which point is northerly of and 406.5 feet distant from "Point A" on a
straight line which extended intersects with a point on the northerly line of
Lot 10 lying 29 feet easterly of the northwesterly comer of said Lot 10,
thence southwesterly from said "Point C" in a curved line, which at all
points is northerly of and 406.5 feet distant from "Point A" to "Point F"
which point is northwesterly of and 406.5 feet distant from "Point A", the
point of beginning, on a straight line which extended from "Point A"
through "Point F" intersects with a point on the west line of Lot 10, 144
feet southerly of the northwesterly corner of said lot, thence from said
"Point F" in a straight line southeasterly to "Point A", the point of
beginning, according to the plat thereof now on file and of record in the
office of the Register of Deeds within and for Dakota County, Minnesota.

straight line southeasterly to "Point A", the point of beginning.
Lying southeasterly of a line described as commencing at the intersection of
the west line of said Lot 10 and a line 14425 feet northerly of and parallel
with the south Gne of said Lot 9 and 10; thence easterly along said parallel
line a distance of 174.90 feet to the point of beginning of the line to be
described; thence deflecting to the left 90 degrees 00 minutes 54 seconds a
distance of 125.67 feet; thence deflecting to the right 43 degrees 45
minutes 59 seconds a distance of 120.00 feet and said line there
tertninating.

NOW, THEREFORE, the said Landovmer, in consideration of One Dollar ($1.00) and other
good and valuable consideration, to it paid by the City, receipt of which is hereby aclmowledged,
hereby grams an easement to the above premises to the City, its heirs and assigns, for ponding and
conservation purposes, including the normal practice of filling with water the above-described premises
from storm sewer cunoff and for utility line pucposes.
The City shall haue the right to do whatever is necessary for the enjoyment ofthe rights herein
granted, including the right of clearing the easement area to allow for the use of the land as stated
herein, and also including the right to excavate within the easement azea and to install, lay, maintain,
operate and repair stottn sewer pipes and utility lines and the right of ingress and egress to and from
said tract ofland and over and across the easemerrt azea for these purposes.
And the said Landowner, for itseK its heirs, eacecutors, administrators and assigns does hereby
release the said City of Eagan, its successors and assigns, from all claims for any and all damages
resulting to said land by reason of the location of lake, ponding azea or utility line.
By acceptance of these easements, the City agrees that it shall restore the property located
outside the anticipated perimeter of standing water to as near the existing grade as is reasonably
possible and fiuther agrees to replace existing cultivated shrubs or sod and to seed all other azeas not
wvered with standing water.
It is expressly understood that the City, its successors or assigns shall waive and release said
lands or that portion thereof used for pennanent lake or ponding purposes from any special assessment
levied on an area basis on account of any improvement in the City of Eagan for such time as said lands
aze used for permanent lake or ponding purposes, but at such time as such uses or purposes aze
