northeasterly of a line described as beginning on the west line of said Lot 10 a
distance of 27425 feet north of the southwest comer of said Lot 10; thence East,
at right angles, a distance of 30.00 feet; thence southeast to a point on the east line
of said Lot 10 distant 22235 feet north of the southeast corner; thence southeast
to a point on the east line of Lot 9 distant 425.00 feet south of the northeast comer
of said Lot 9 and said line there teaninating. And lying southwesterly of a line
described as beginning at said point on the east line of Lot 9 distant 425.00 feet
south of the northeast corner of said Lot 9; thence northwesterly to a point on the

NOW, TEIEREFORE, the said Landowner, in consideration of One Dollar ($1.00) and other
good and valuable consideratioq to it paid by the City, receipt of which is hereby aclmowledged,
hereby grants an easement to the above premises to the City, its heirs and assigns, for ponding and
conservation purposes, including the normal practice of filling with water the above-described premises
from stoan sewer runoff and for utility line purposes.
The City shall have the right to do whatever is necessary for the enjoymern of the rights herein
granted, including the right of clearing the easement uea to allow for the use of the land as stated
herein, and also including the riglrt to excavate within the easement azea and to install, lay, maintann,
operate and repair stonn sewer pipes and utility lines and the right of ingress and egress to and from
said tract of land and over and across the easement azea for these purposes.
And the said Landowner, for itself, its heirs, executors, administrators and assigns does hereby
release the said City of E3g3A its successors and assigns, from all claims for any and all damages
resulting to said land by reason of the location of lake, ponding area or utility line.
By acceptance of these easemerns, the City agrees that it shall restore the property located
outside the anricipated perimeter of standing water to as near the existing grade as is reasonably
possible and futther agrees to replace existing cukivated skuubs or sod and to seed all other azeas not
covered with standing water.
It is expressly understood that the City, its successors or assigns shall waive and release said
lands or that portion thereof used for permanent (ake or ponding puiposes from any special assessment
levied on an area basis on account of any improvement in the City of Eagan for such time as said lands
aze used for permanent lake or ponding purposes, but at such time as such uses or purposes aze
abandoned then said lands may again be subject to such special assessments, as have been levied or
may hereafter be levied.

Dakota County, Minnesota, legally described as follows:

described as follows: Commencing at a point on the west line of Lot 10,
RECEIVED distant 274.25 feet north of the southwest comer thereof; thence on a
tangential curve to the right having a radius of 400 feet and a central angle
of 21 degrees 00 minutes, 146.7 feet to a point on a straight line drawn

northwest comer thereof to a point on the east line of Lot 9, distant 425

NOW, T'HEREFORE, the said Landowner, in consideration of One Dollaz ($1.00) and other
good and valuable consideration, to it paid by the City, receipt of which is hereby aclmowledged,
hereby grants an easement to the above premises to the City, iu heirs and assigns, for ponding and
conservation purposes, including the normal practice of filling with water the above-descnbed premises
from storm sewer runoff and for utility line piuposes.
The City shall have the right to do whatever is necessary for the enjoyment of the rights herein
granted, including the right of clearing the easement azea to allow for the use of the land as stated
herein, and also including the right to excavate within the easemern area and to install, lay, maintain,
operate and repair storm sewer pipes and utility lines and the right of ingress and egess to and from
said tract of land and over and across the easement azea for these purposes.
And the said Landowner, for itsel? its heirs, eacecutors, administrators and assigns does hereby
release the said City of Eagan, its successors and assigns, from all claims for any and all damages
resulting to said land by reason of the location of lake, ponding azea or utility line.
By acceptance of these easemerns, the City agrees that h shall restore the property located
outside the anricipated perimeter of standing water to as near the existing grade as is reasonably
possible and further agrees to replace existing cuitivated stuubs or sod and to seed all other azeas not
covered with standing water.
It is expressly understood that the City, its successors or assigns shall waive and release said
lands or that portion thereof used for pennanerrt lake or ponding purposes from any special assessment
levied on an area basis on account of any improvement in the City of Eagan for such time as said lands
aze used for pennanent lake or ponding pwposes, but at such time as such uses or purposes aze
abandoned then said lands may again be subject to such special assessments, as have been levied or
may hereafter be levied.
