By acceptance of these easemerns, the City agrees that it shall restore the property located outside the anricipated perimeter of standing water to as near the existing grade as is reasonably possible and futther agrees to replace existing cukivated skuubs or sod and to seed all other azeas not covered with standing water. It is expressly understood that the City, its successors or assigns shall waive and release said lands or that portion thereof used for permanent (ake or ponding puiposes from any special assessment levied on an area basis on account of any improvement in the City of Eagan for such time as said lands aze used for permanent lake or ponding purposes, but at such time as such uses or purposes aze abandoned then said lands may again be subject to such special assessments, as have been levied or may hereafter be levied.
