The conditions of the Variance required both U.S. West and Honsa Lighting to provide dumpster screening enclosures according to City Code provisions, and to install curb and gutter on Honsa Lighting's existing parking lot to bring that property up current codes. Niether of these improvements has been provided for Honsa Lighting, and the dumpster screening enclosure is not shown on U.S. WesYs plans. In addition to these rivo items, I will be asking them to enhance their landscape plan. Also earlier this year, the City approved a final ?plat combining Lots 2 and 3, Bell I,exington Addition into Lot 1, Block 1, Bell Lexington 2" Addition. That plat has not yet been recorded, and the applicant received an extension of time to record the final plat until sometime in June. With the final plat, cross-easements for shared access with Honsa Lighting to the west are supposed to be recorded. Check with Marilyn about the status of the final plat before releasing the building perxnit. They show a fuel tank west of the new building addition. I do not lmow what this is and I am not aware of any plans or approvals for any sort of above-ground fuel tank. ? Plans for said telephone equipment building shall be subject to approval of the Lessor. Approval shall not be unreasonably withheld. 2. All buried cables, conduits, manholes and appurtenants, and appliances shall be constructed within existing rights-of-way and withln the Leased Premises let and easement granted hereunder. 3 The survey of the Leased Premises and of the immediate surroundings shall be provided by Lessee at its expense. 4. The lease shall be for a term of Fifteen (15) years beginning September 1, 1986. As additlonal rent, Lessee shall pay all real estate property taxes levied against the Leased Premises for the land, and improvements erected on the Leased Premises by Lessee, and shall pay a pro-rata share of the annual installments of special assessments levied against Lot 3, Block 1, Bell Lexington Additlon. The Lessees prorata share of the aforementionied Lot shall be 2.3%. The lessee shall pay the taxes promptly upon receipt of billing by the Lessor. 6. The Lessee shall have the right at any time to terminate the lease agreement, but upon cessation of payment of rent Lessee must convey to the Lessor any and all interest it has in a permanently constructed building, if any and the building w111 then become the sole property of Lessor. 7. Upon termination of this lease Lessee's authority to use the Leased Premises and exercise the rights and privileges herein granted shall cease and Lessee shall promptly and in good condition, ordinary wear and tear excepted, surrender the Leased Premises to the Lessor. 8. The fixtures, appliances, and appurtenances constructed, installed or placed by the Lessee on or under the Leased Premises shall remain the property of the Lessee at all times and Lessee shall have the right to remove any such property and improvements from the Leased Premises, sub3ect to Lessee's obligation to repair all damage, if any, from such removal. 9. The Lessor shall have the responsibility of mowing and maintaining the landscaped area, maintaining the driveway-parking area, plowing snow and doing all malntenance on the site. 10. Lessee agrees to construct at its expense a driveway, as may be required by City or Local ordinances, in front of the proposed equipment building. 11. Lessor shall hold the Lessee harmless and, at Lessor's expense, defend any question of title raised against Lessor's property. 72. Lessee agrees to defend, indemnify and hold harmless the Lessor and the Lessor's employees from and against all claims, suits, liabtlities, judgments, costs, damages, and expenses, which may accrue against, be charged to or recovered from Lessor or Lessor's employees by reason of or on account of any personal injury or property damage arising from Lessee's use or occupancy of the leased premises. It is clearly understood and agreed that the foregoing indemnification and hold harmless agreement does not impose an obligation on the part of the Lessee to defend Lessor from its own negligence or failure to act or that of its employees. 13. Each sceel storage tank designed for underground storage purposes, fabricated in accordance with the applicable specifications, by a duly authorized Iicrnsee of the Stall2nk Institute, an Illinois not-for-profit corporation, and bearing the "sti-P? trademark label and embossed nameplate showing the "sti-Pi"" series number, is wartanted by the Licensee whose name appears below against non-corrosion failure due to defective materials and workmanship, for a period of one (1) year after date of delivery of the tank to the purchaser and by the Steel Tank Instimtt ("STPl against leaks due to structural failure which shall be defned as cracking, breaking or collapse for the life of the installa- tion. Each such limited warranty is subject to the following conditions: t. The tank must be properly ven[ed. original tank or delivery to the same ins[allation si[e of a repiacemen[ tank of approx- imately the same size, design, quality of material and workmanship as the original 2.
