It has been 6rought to my attention that the senior citizen deferment for the
above referenced parcel is no longer applicable due to the death of the applicant.
Enclosed is a copy of Section 2.75 of the present City Code pertaining [o
"Deferment of Special Assessments". As you will note, subdivision #4 of that
code states that the defermen[ sha11 terminate upon death of the owner where there
is no spouse that is eligible for deferment.
In November of 1976, at the request of the property owner, the City deferred the
principle assessment of $2,760.00 for the 400 feet of water laCerial calculated
at $6.90 per fron[ foot. The rate of in[erest associated with the Bond was 8.0%.
Therefore, for the eigh[ years that this special assessment was deferred, it has
accrued $1,766.40 based on a simple interest formula. Consequently, [he total
special assessment obligation of the above referenced tax parcel now equals
$4,526.40.
Please be informed that the City will now certify this amount to the Dakota Covnty
audi[or for collection with the taxes in 1985.

restrictions as the Council may deem proper to protect the
City's interests, nor shall anything contained in this Sec-
tion limit any right or power possessed by the City over
existing franchises.
SEC. 2.73. ABSBNTHB BALLOT COIINTING BOARD. The
Council hereby authorizes an Absentee Ballot Counting Board
and further authorizes the election judges of such Board to
receive, examine, and validate absentee ballots. The
further duties of such board shall be those provided by
statute.
SEC. 2.74. SPSCIAL ASSESSNENT POLICY. The Council
may, by cesolution, adopt, from time-to-time amend, or
repeal a special assessment policy.
SEC. 2.75. DEFBRMENT OF SPECIAL ASSESSMSNTS.
Subd. 1. The Council may defer the payment of any
special assessment on homestead pcoperty owned by a person
who is 65 years of age or older, or who is retired by virtue
of permanent and total disability, and the City Clerk-
Treasurer is hereby authorized to record the defecment of
special assessments where the following conditions are met:
A. The applicant must apply for the defer-
ment not later than ninety days aEtec the assessment is
adopted by the Council
B. The applicant must be 65 years of age, or
older, o[ reticed by virtue of permanent and total
disability.
C. The applicant must be the ownec of the
property.
D. The applicant must occupy the property as
his principal place of residence.
E. The avecage annual payment foc all
asseasments levied a9ainst the subject property exceeds 18
of the adjusted gross income of the applicant as evidenced
by the applicant's most recent Fedeeal income tax return.
Rhe average annual payment of an assessment shall be the
total cost of the assessment divided by the numbec of years
over which it is spread.
Subd. 2. The deferment ahall be granted for as
long a period of time as the hardship exists and the condi-
tions as aforementioned have been met. However, it shall be
the duty of the applicant to notify the City Clerk-Treasurec
of any change in his status that would affect eli9ibility
for deferment.
Subd. 3. The entire amount of deferred special
assessments shall be due within sixty days after loss of
eligibility by the applicant. If the special assessment is

not paid within sixty days, the City Clerk-Treasurer shall
add thereto interest at 88 per annum from the due date,.
through December 21 of the following year and the total
amount of principal and interest shall be certified to the
County Auditor for collection with taxes the following year..
Should the applicant plead and prove, to the satisfaction of
the Council, that full repayment of the deferred special
assessment would cause the applicant particular undue finan-
cial hardship, the Council may ordec that the applicant pay
within sixty days a sum equal to the number of installments
of deferred special assessments outstanding and unpaid to
date (including principal and interest) with the balance
thereafter paid according to the terms and conditions of the
original special assessment.
Subd. 4. The option to defer the payment of
special assessments shall terminate and all amounts accumu-
lated plus applicable interest shall become due upon the
occurrence of any one of the following:
A. The death of the owner when there is no
spouse who is eligible for deferment.
B. The sale, transfer or subdivision of all
or any part of the property.
C. Loss of homestead status on the property.
D. Determination by the Council for any
reason that there would be no hardship to require immediate
or partial payment.
SEC. 2.76. PARTIAL PREPAYlSENT OF SPECIAL ASSESSMHNTS.
Subd. 1. Scope. Partial prepayment of assess-
ments in connection with any assessments adopted by the
Council and certified to the County Auditor for collection
may be made at any time.
Subd. 2. Payment. The ownec of any property so
assessed may, within 30 days of adoption of the assessment
roll by the Council, prepay any or all of his assessment to
the City. No interest will be charged on any portion of the
assessment paid within said 30 days. The remaining unpaid
balance of the assessment shall be spread at the same rate
of interest and Eor the same term of years as the original
assessment.
SEC. 2.77. BMERGENCY PRSPAREDNHSS PLAN. The Council
may, by resolution, adopt, froro time-to-time amend, or
repeal an emer9ency preparedness plan for the City.

the basis of not more than 400 front feet when such assessment is applicable
to frontage along County Road #26.
3. In the event any such assessment is made on a basis other than as
specified in paragraphs 1 and 2 hereof, then in that event the easement
hereby granted shall terminate and the rights hereby granted to Grantee shall
cease and be of aio further force or effect. At such time as Lake and Parcel A
are abandoned for the uses' herein contemplated, then said lands may again be
subject to special assessments.
The Grantors, for themselves, their heirs, executors, administrators
and assigns, do hereby release the Grantee, its successors and assigns, from
all claim f6r any and all damages to the Tract by reason of the exercise of
the rights and easement hereby conveyed .

It has been brought to my attention that the senior citizen deferment for the
above referenced parcel is no longer applicable due to the death of the applicant.
Enclosed is a copy of Section 2.75 of the present City Code pertaining to
"Deferment of Special Assessmen[s". As you will note, subdivision #4 of that
code states that the deferment shall [erminate upon death of the owner where there
is no spouse that is eligible for deferment.
In November of 1976, at the reques[ of the property owner, [he City deferred the
principle assessment of $2,760.00 for the 400 feet of water laterial calculated
at $6.90 per front foo[. The rate of interest associated with the Bond was 8.0%.
Therefore, for the eight years that this special assessment was deferred, it has
accrued $1,766.40 based on a simple interes[ formuLa. Consequently, [he total
special assessment obligation of the above referenced tax parcel now equals
$4,526.40.
Please be informed that the City will now certify [his amount to the Dakota County
auditor for collection with the taxes in 1985.

other good and valuable consideration to them in hand paid by Grantec, the

3. In Che event any such a5sessment is made on a basis oCher than as

cease and be of.no Eurther Force or efEect. At such time as Lalce and Parcel A
are abandoned for the uses herein coatemplated, then said Lands may again be
subject to special assessments.
The Grantors, fox themselves, Cheir heirs, executors, administrators
and assigns, do hereby release the Grantee, its successors and assigns, from
all claim for any and all damages eo the Tract by reason o£ the exercise oY
