This letter results from our meeting on July 19, 1985 when we
discussed the assessment impact regarding Project 447 on your
property. I also chpcked for past sewer and water assessments
on your property and your request for special assessment hearing.
The total pending assessments on your property based upon the
preliminary assessment report for this project amounts to
$12,451.20. Included in this amount is trunk area watermain
on Parcel 010-28, water service to Lot 12, Auditor's Subdivision
#38, and lateral benefit from trunk main along the frontage of
Lot 12, Auditor's Subdivision #38 and Parcel 010-28. These amounts
are as we discussed and I pointed out on the pending assessment
sheets I gave you at our meeting.
I checked the assessment records and your trunk area watermain
assessment for Parcel 010-28 was excluded from the assessment
roles in 1977. I was not able to research the reason for this
exclusion. Trunk sanitary sewer was assessed over Parcel 010-28
along with trunk storm sewer. However, the trunk storm sewer
is deferred under the Senior Citizen Deferment.
Finally, I spoke with Tom Colbert (PUblic Works Director) and
he indicated to me that he would be scheduling a Special A'ssessment
Committee Hearing sometime" this fall. You will be notified well
in advance of this hearing.

on October 6, 1981, this iten was oontinued for consideration until Octnbex- 20 for
the follaaing two reasons:
1. The Council directed the City staff to prepare an assessment roll directly
relating to benefit per existing City policy and cc¢pare it to the pro-
posed assessrent spread as requested by you during the preparatian of the
feasibility report.
2. The staff is tn work with you to obtain your understanding that there will
be £uture sanitary sewer lateral assessmPnts levied against both proFer-
ties in the future as extensions of the sanitary sewer way warrant depen-

The City will be performirig the analysis referenced in No. 1 above and will have

Pertaining to No. 2 above, the Council wants to be assured that you realize that
the assessments associated with this particu].ar project do . not prohibit future

APPLICATION SUMMARY: An application has been submitted requesting a Waiver of
Plat in order to separate an approximate 35' wide part of 4ot 3 with Lot 2 located along
the south side of Lone Oak Road, east of Pilot Knob Road. There will not be any
development as a result of this process.
Currently, a shared driveway seroes both lots and the subject area is maintained by the
owner of Lot 2. If the Waiver is approved, all of the lawn area east of the driveway will
be tied to Lot 2. The entire 4.2 acre subdivision was platted into three lots in 1981. At
that time, a concept plan was prepared to show how the area couid develop to a higher
degree by extending a cul-de-sac to the south from Lone Oak Road. The homes on Lots
1, 2, and 3 were built in 1962, 1960, and 1981 respectively. The 60' wide lot width was
provided for this reason. Code afso requires a 50' minimum 1ot width and a Variance to
that R-1 requirement will be necessary 'rf this Waiver of Plat is approved. This Waiver of
Plat will effectively eliminate tuture subdivision of the three lots.
FINANCIAL OBLIGATION - 10-W-5-7-91 Lot 2, Block 1, Tara Court
Based upon the study of the financial obligations collected in the past and the uses proposed
for the property, the tollowing charges are proposed. The charges are computed using the
City's existing fee schedule and connections proposed to be made to the City's utility system
based on the submitted plans.

1. a Variance to allow the lot width of 25' for Lot 3.
