DRAINAGE AND UTILITY EASEMENT
THIS EASEMENT, made this 17rh day of nr+..har , 1991, between
Arthur R. Shields and Frances C. Shields, husband and wife, herein
referred to as "Landowners" and the CITY OF EAGAN, a municipal
corporation, organized under the laws of the State of Minnesota,
hereinafter referred to as the "City".
W I T N E S S E T H:
That the Landowners, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, do hereby grant and
convey unto the City, its successors and assigns, tiie fuilowing
easement:
A 30.00 foot permanent easement for drainage and
utility purposes over, under and across that part
of Lot 3, Block 1, Tara Court, according to the
recorded plat thereof, Dakota County, Minnesota,
lyinq 15.00 feet on each side of the centerline
described as follows:
Commencing at the northeast corner of Lot 2, Block
1, Tara Court, thence south 00 02' 16" west a
distance of 298.26 feet, thence north 860 11l 40"
west a distance of 15.84 feet to the point of
beginning, thence south 680 431 39" west to a
point on the west line of said Lot 3 and there
terminating. The side lines of said easement are
prolonged or shortened to terminate at said
westerly property line.

The grant of the foregoirig permaaent easement fcr drainage znd
utility purposes includes the right of the City, its contractors,
agents and servants to enter upon the premises at all reasonable
times to construct, reconstruct, inspect, repair and maintain pipes,
conduits and mains; and the further right to remove trees, brush,
undergrowth and other obstructions. After completion of such
construction, maintenance, repair or removal, the City shall restore
the premises to the condition in which it was found prior to the
commencement of such actions, save only for the necessary removal of
trees, brush, undergrowth and other obstructions.

APPLICATION SUMMARY: An application has been submitted requesting a Waiver of
Plat in order to separate an approximate 35' wide part of Lot 3 with Lot 2 located along
the south side of Lone Oak Road, 'east of Pilot Knob Road. There will not be any
development as a result of this process.
Currently, a shared driveway serves both lots and the subject area is maintained by the
ownar of Lot 2. If the Waiver is approved, all of the lawn area east of the driveway will
be tied to Lot 2. The entire 4.2 acre subdivision was platted into three lots in 1981. At
• that time, a concept plan was prepared to show how the area could develop to a higher
degree by extending a cul-de-sac to the south from Lone Oak Road. The homes on Lots
1, 2, and 3 were built in 1962, 1960, and 1981 respectively. The 60' wide lot width was
provided for this reason. Code also requires a 50' minimum lot width and a Variance to
that R-1 requirement will be necessary 'rf this Waiver of Plat is approved. This Waiver of
Plat will effectively eliminate future subdivision of the three lots.

FINANCIAL OIiLIGATION - 10-W-5-7-91 Lot 2, Block 1, Tara Court
Based upon the study oE the Gnancial obligations collected in the past and the uses proposed
for the property, the following charges are proposed. The charges are computed using the
City's existing fee schedule and connections proposed to be made to the City's utility system
baced on the submitted plans.

This easement, made this 6 q day of (H f} 1Z , 2006, between STEVEN M.
WACHTLER, a single person, (kereinafter referred to as "Landowner"), and the City of Eagan, a
Minnesota municipal corporation, organized under the laws of the State of Minnesota (hereinafter
referred to as the "City").
WITNESSETH:

That the Landowner, in consideration of the sum of One Thousand Five Hundred Eighty-
five and no/100 Dollars ($1,585.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, does hereby grant and convey unto the City, its
successors and assigns, a temporary construction easement for site grading purposes over and
across the following descrihed premises, situated within County, Minnesota, to-wit:
Parcel8 as shown on Dakota County Road Right of Way Map No. 310.
This temporary easement shall expire on September 30, 2007.
The grant of the foregoing temporary construcrion easement for site grading purposes
includes the right of the City, its contractors, agents and servants to enter upon the premises at all
reasonable times to consriuct, reconstruct and inspect site grading and the fiirther right to remove
trees, brush, undergtowth and other obstructions. After completion of such construction,
maintenance, repair or removal, the City shall restore the premises to the condition in which it was
found prior to the commencement of such actions, save only for the necessary removal of trees,
brush, undergrowth and other obstructions, subject only to permanent easement alterations.
The Landowner, his heirs and assigns, does covenant with the City, its successors and
assigns, that he is the owner of the premises aforesaid and has good right to grant and convey the
easement herein to the City.
