This letter is for the purpose of summarizing the City's legal position
with regard to assessments which will be discussed by the City Council this
evening at an assessment hearing relating to the Martin and Myrtle Shields
property north of Towerview Drive. The proposed assessments relate to
sanitary sewer and water laterals, services, and grading and gravel base
restoration relating to the installation of the sewer and water. The
assesements were originally proposed to be asseased on May 7, 1974, and at
approximately that time the City deferred the assesaments to be levied against
the Shielda property for a period of three years. An additional three-year
deferrment was requested and granted by the City Council on August 16, 1977,
with the understanding that when the property was assessed it would be at the
rate in effect at the time of the assessment and with the futher understanding
that Mr. Shields would enter into a written agreement, if necessary, agreeing
to the assessment at the rate to be in effect at that future time. Aa
you are aware, despite repeated attempts to obtain such an agreement, no such
agreement wae ever aigned by Mr. Shields.
Because no agreement was ever signed by Mr. Shields putting into effect
the resolution of the City Council of August 16, 1977, it is unclear whether
the City may legally Levy the assessmente at the rates currently in effect.
Our office feels confident that the City can assess [the original proposed'
assessment of $13,365.13 plus interest at 5.0311% from October 1, 1973, the
interest rate on bonds used to finance the improvements and the date of
issuance of the bonds. As a compromise, City staff originally proposed that
the aesessments be determined at the original assessment rates plus 8% eimple
interest. Apparently this is not acceptable to Mr. Shields and his attorney.
Because the matter is very likely to be contested, we wanted to bring to your
attention and to the City Council's attention the possibility that the
assessment would not be approved upon an assessment appeal if interest above
the 5.0311% bond interest is used between October 1, 1973, and the date of
actual levy of the assessment. I have discussed this matter with Gene
VanOverbeke, the Finance Director, and he ia in agreement that the safest way
to handle these assesaments would be to use the 5.0311% interest rate rather
than the 8% interest rate.

With regard to interest commencing on the date of levy of the assessment,
we are not as restricted. If the assessments are levied in May of 1985, the
maximum interest rate allowable would be 12%. If the assessments are levied
in June of 1985, the maximum interest rate would be 11%, atarting on the date
of levy of the assessment. This is pursuant to Minn. Stat. 3475.55 which
allows for a floating intereat rate on special asaeaements.
The typical assessment rate for 1985 for special assessments has been 11%,
and a deviation from the use of that percentage might be challenged by Mr.
Shields. However, because of the apecial circumstances involved here, our
office believes that the 12% interest rate could very well be justified and
accepted by the Court upon appeal.
(If the City Council does levy the assessments_and usea the bond interest
(rate for interest from October 1, 1973, through the date of levy, that amount
df interest would be considered a cost of the improvement and would be
(included in the principal which would then draw interest_at_a rate of up to
12% commencing from the date of levy. If the approximately 5% interest rate
were to be used, the amount to be levied would be $21,097.88. If the SX
interest rate originally recommended by City staff were to be used, the
assessment would be $25,126.44. Assessment would then draw interest at a rate
up to 12%.

MARTIN SflIELDS PROPERTY - PROJECT #113 - TOWERVIEW ROAD - UTILITIES
Mayor Bea Blomquist convened the public hearing regarding the assessmenta
on the Martin Shields property along Towerview Road under Project #113. Mr.
Hedges briefly reviewed the history of the assesaments, noting that they
originally were proposed to be assesaed in 1973 and had been deferred several
timea. City Attorney Paul Hauge submitted a letter to the City Council and
recommended that the original assessments be increased by the amount of the
bond in[erest rate paid for the sale of improvement bonds for the project at
approximately SX, with a total assessment of about $21,000.00. This would
conatitute a reduction of about $4,000.00 from that originally proposed, but
recommended approval based upon both the benefit test and the coat analyeis
rtest. ?an Beeaon, attorney, and Martin Shields were present and indicated
o ?v that they had agreed wi[h the proposed reduction in assessments and would not
appeal the assessments. No action was taken.

WSSTBIIRY 3RD ADDITION - PBOJECT #441
The next public hearing convened by the Mayor concerned Project #441
regarding utility and street improvements in Westbury 3rd Addition. The
hearing had been continued from the May 7, 1985 council meeting because the
developer was not present at that hearing. Mr. Gabbert wae present at the May
21, 1985 meeting and stated that the developer favored the project. There
were no objections to the project.
EAGANDALE OFFICE PAR& - EASSMENT VACATION
. The next pu6lic hearing convened by the Mayor concerned the vacation of
the existing utility and drainage easements for Lots 1 through 3, Block 4,
Eagandale Office Park. Al1 noticea were publiahed in the legal newspaper and
sent to all potentially affected utility companies. The easementa should be
vacated before the filing of the Eagandale Office Park 2nd Addition plat.
There were no objections to the vacation.
TflOMAS LARE HSIGHTS 2ND ADDITION - EASEMENT VACATION
Mayor Blomquist then convened the hearing regarding the vacation of
drainage and utilitp easements in Thomas Lake Heights 2nd Addition. Mr.
Hedges reviewed the proposed vacation and there were no ohjectiona voiced at
the hearing. No action wae taken.

A regular meeting of the Eagan City Council was heid on Tuesday, May 21,
1985 at 6:30 p.m. at [he Eagan Municipal Center. Present were Mayor Bea
Blomquist and Councilmembers Smith, Egan and Wachter. Councilman Thomas was
excuaed. Also present were Consulting Engineers Mark Hansen and Bob Rosene,
City Administrator Hedges, Assistant City Engineer Hefti, City Planner Runkle,
and City Attorney Hauge.
City Administrator Tom Hedges announced that because of the School Board
Elections, no official decisiona will be made by the City Council until 8:00
p.m. However, informal discussion will take place before that time.
PARR 6 RECREATION DEPARTMENT
1, Northview Elementary School. Mike Ravich, a fifth grader, and Bo6
Ferguson, the Principal at Northview School, appeared on behalF of Northview
Elementary School expressing their thanks to the Park and Recreation Dept. for
the cooperation in installation of playground equipment. Mike Ravich read a
statement on behalf of the etudents of Northview School. 2. Gang Mower Purchase. Ren Vraa was present and stated that the City
has been offered the right to purchase a Gang mower from School District #191
for the sum of $14,000.00. He atated that a Gang mower was identified as a
capital purchase for 1987 and although the Ci[y Park Department does not need
the size mower proposed [o be purchased at the present time, that it was a
good value. No action was taken. Councilman Smith suggested that the Council
authorize the purchase and that the funds be included in the 1986 Capital
Budget for the Park and Rec. Department.

SLATERS ACRES EASEMENTS - CONTRACT #85-3
Mr. Hedgea and Mr. Hefti discuased with the Council several alternates:
regarding the construction of utility easements in the Slaters Acres area
under Contract #85-3. The alternates included 1) approving the contract and
ordering the condemnation of the two necessary easements tha[ have not been
acquired, 2) proceed only with a part of the contract within James Court and
exclude the parcels where easements have not been acquired, and 3) to drop the
project for the time being.

Egan moved, Wachter seconded the motion to approve the application for
final plat aubmitted by the developera of the Windtree 4th Addition, subject

#437 for the installation of streets and utilities within the subdivision and
close the public hearing and to authorize the preparation of plans and

Smith moved, Egan seconded the motion to approve the final plat of the

members voted yes.
HAHPTON HEIGHTS - PRELIMINA&Y PLAT
The Council again conaidered the application of Frontier Midwest for
approval of the revised preliminary plat for Hampton Heights and for rezoning
to Planned Development and Limited Buainess. It was no[ed that a 4/5th vote
of the entire Council is necessary to approve the application for rezoning,
and after diacussion, Egan moved, Smith seconded the motion to recoasider the
mo[ion made earlier in the meeting for approval of the application for
rezoning. All membera voted yes.
Blomquist then moved, Egan seconded the motion to approve the application
for rezoning based upon the conditions provided in the earlier motion,
including the exclusion of the Limited Business designation, which will remain
Agricultural zoning and to forward the application to the Advisory Planning
Commisaion for review and comment. AL1 councilmembers voted yes.
SUNSET 4TH ADDITIOH - VARIANCE
An application wae submitted by Tri-Land Properties, for 20 foot setback
variance from Yorktown Place for Lot 2, Block 3, Sunaet 4th Adaition. The
application was firat considered at the regular May 7, 1985 council meeting
and the Council asked for further information as to the reason why the
eyebrow, or bubble, wae eliminated and not formally approved by the City
Council. There was a question as to what [he variance would be at the setback
of the residence and it vas noted that the plat was not approved with removal
of the eyebrow. The staff recommends approval of the eyebrow where poesible
for maintenance purposes. After discussion, Smith moved, Wachter seconded the
motion to approve the variance, subject to the following conditions:

This letter is intended as written notice of objection to the levy
of the above special assessments on the property owned by Martin
and Myrtle Shields. The total, proposed assessment is in the amount
of $25,126.55 for certain improvements installed in Towerview Road
in 1974.
After the installation of these improvements, the City Council de-
ferred the levy of the assessments until the property was developed.
That was done on two occasions, once in 1974 and again in 1977.
The property is still undeveloped.
In the intervening time, the Shields` property has been subjected
to special assessments, largely for the upgrading of Pilct Knob Road,
which have a current balance in excess of $50,000.00. If the pro-
posed assessments are adopted, the total of special assessments on
the Shields' property will be almost $76,000.00. The Shields own
approximately 13 acres of property, meaning assessments of about
$6,000.00 per acre.
With respect to the proposed assessments, we object to them on the
basis that they do not specially benefit the Shields' property by
the amount of $252126.55. A levy of special assessments in that
amount would be arbitrary and unreasonable, particularly in light
of the special assessments already on Che property of over
$50,000.00.

Dear Mr. LeVander:
On June 11 of this year, the enclosed letter was forwarded to
Mr. and Mrs. Shields' attention informinq them of their outstanding
financial obligation for special assessments associated with
Project 113 which provided for the installation of utilities,
grading and gravel base along Towerview Road adjacent to their
southerly property line of the above-referenced parcel.
On July 23, you responded requesting additional information
before deciding which course of action the Shields would decicle
upon regarding those assessments. I apologize for not responding
sooner. However, upon receipt of your letter, the City was
heavily involved in all of the final assessment hearings for
various other projects which precluded the research and,response
that you had requested. However, I will address your questions
in the manner that they were presented as follows:

A. I do not have any knowledge of any formal appraisal
being performed against this property in relationship
to the improvements installed under Project 113.
Please be informed that these original assessments were adopted
in 1974 and at the request of Mr. Shields, they were deferred
for three years. Enclosed is a copy of a letter from the City
dated June 8, 1977, informing Mr. Shields that the three-year
deferrment had expired and that it would be certified to the
County Auditor. The enclosed letter of June 13, 1977, was Mr.
Shields' response requesting continued deferrment consideration
of this assessment. This second request was considered by the
Council at their meeting on August 16, 1977. Enclosed is a
copy of the minutes of that meeting which deferred the assessments
for an additional three years. There was an option for the
assessments to be deferred until the property developed with
the understanding that Mr. Shields would enter into a written
agreement agreeing to the assessments at a rate in affect at
said future time if it were to be indefinitely deferred. The
City does not have any record of Mr. Shields entering into such
an agreement as required by that action. Subsequently, the
second three-year deferrment expired on August 16, 1980.
The City is now requiring that these assessments be certified
and levied so that they are a matter of record for all potential
and future purchasers of the property. In addition, during
this ten-year period, the City has had to assume the liability
of the annual installments to pay off the bonds sold to finance
this project. Due to the fact that the City can no longer afford
to finance this deferrment at the original 8% interest, it will
be necessary for Mr. Shields to agree to have this assessment
levied in accordance with Option #1 or #2 as identified in my
previous letter of June 11, 1984.

them of June 11 regarding the assessments on the above project.
Memories are somewhat hazy on this matter, and we would like
the following information before deciding which course of action
to take regarding these assessments:

that are the basis of these assessments?
2, How i.s the assessment sum of $13,365.16 computed?
3, What would the assessment be if it is levied against
the propexty at the current rates?
4. Does the City have an appraisal indicating that the

It has come to our attention that the improvements, including utilities and
street improvements under Project 11113 originally commenced in 1974 including
improvements along Towerview Road under Project #113, have not heen assessed
against your property. You may remember that at your request the City Council
deferred the assessments and again extended the deferrment on April 16, 1977,
.. for an additional three years. -

Neither the City nor you arranged for a later extension or deferrment and the
original assessments, which were in the sum of $13,365.16, have not been levied
and have not been paid. We have calculated that at 8% simple interest which
was the assessment interest factor in effect at that ticne, would now result
in a principal balance, including the interest, of approximately $24,000. It
is our recoumendation that due to the fact that the original assessment was
to be spread over 20 years, that the principal now be spread over ten remaining
years and that the assessment be levied.
This could be done in one of several ways:
1. The City could commence a new hearing and levy the assessments at the rate
in effect at the present time.
2. The City could commence the assessment process and levy the assessments
based upon the 1974 rates plus 8% interest to the present time.
3. You, as the property owners, could waive notice of any hearing requirements
and allow the assessment to be levied at one of the two rates that are included
in the two options mentioned above.

I would ask that you get back to me as quickly as possible because the City
Council, at its meeting on June 5, instructed the staff to proceed with the
assessments at the earliest possible time.
We will proceed to file a Notice with the County Recorder that there is an
assessment that was deferred in 1974 so that any potential purchaser would be
clearly aware of the deferred assessment.

At the public hearing for the abwe-referenced project held before the City Council
on October 6, 1981, this itr=nvias amtinued for wnsideraticn until Octnber 20 for
the follaaing two reasons:
l. The Council direcFed the City staff to prepare an assessttient roll directly
relating to benefit per existing City policy and ccapare it to the pro-
posed assesszrent spread as requested by you during the preparation of the
feasibility report.
2. The staff is t:o work with you to cbtain your Lmdexstanding that there will
be future sanitary sewer lateral assesmients levied against both proper-
ties in the future as extensicns of the sanitary sewer way warrant depen-
dent upon proposed future developnents.
The City will ke perfozming the analysis referenced in No. 1 above and will have
this i.nformation available for the October 20 oontinued public hearing. I will re-
view this information with you on Octcber 19 prior tn that Council meeting.
Pertaining to No. 2 above, the Council wants to be assured that you realize that
the assessments associated with this particular project cka . not prohibit future
assessrmts to be levied against both paroels. This proposed project should not
be considered as a one time sanitary sewer lateral assessment against your property.
Future projects and developments may dictate extensions of the sanitary sewer which
would precipitate additional assessments if you request their installation by the
City. 7herefore, if you amcur and agree with this tmderstancling, please sign
where indicated on this letter and return to my attention prior tn October 15, 1981.
Your anticipated oooperation will be greatly appreciated and will help tn insure
that this project receives the proper authorization from the City Cotmcil.

Dear Mr. and Mrs. Shields:
It has come to our attention that the improvements, including utilities and
street improvements under Project 11113 originally commenced in 1974 including
improvements along Towerview Road under Project 1F113, have not been assessed
against your property. You may remember that at your request the City Council
deferred the assessments and again extended the deferrment on April 16, 1977,
for an additional three years.
Neither the City nor you arranged for a later extension or deferrment and the
original assessments, which were in the sum of $13,365.16, have not been levied
and have not been paid. We have calculated that at 8% simple interest which
was the assessment interest factor in effect at that time, would now result
in a principal balance, including the interest, of approximately $24,000. It
is our recommendation that due to the fact that the original assessment was
to be spread over 20 years, that the principal now be spread over ter. remaining
years and that the assessment be levied.
This could be done in one of several ways:
1. The City could commence a new hearing and levy the assessments at the rate
in effect at the present time.
2. The City could commence the assessment process and levy the assessments
based upon the 1974 rates plus 8% interest to the present time.
3. You, as the property owners, could waive notice of any hearing requirements
and allow the assessment to be levied at one of the two rates that are included
in the two options mentioned above.

I would ask that you get back to me as quickly as possible because the City
Council, at its meeting on June 5, instructed the staff to proceed with the
assessments at the earliest possible time.
We will proceed to file a Notice with the County Recorder that there is an
assessment that was deferred in 1974 so that any potential purchaser would be
clearly aware of the deferred assessment.

Mr. Hedges indicated that building inspections have increased substan-
tially in 1984 and recommended that additional assistance be acquired for the
Building Znspection staff. Blomquist moved, Waehter seconded the motion to
retain John Vu,jovich as part-time building inspector during the heavy building
inspeetion period during 1984 in order to assist in helping to enforee com-
plianee with the building ord'.nanees. All voted in favor.

A special City Council meeting will be held on June 18, 1984 to interview
consultants for ,job evaluation purposes for City staff persons.

There was discussion concernirg the proposal to hire a consulting planner ?
or a staff planner with a sunset provision to assist in implementing the 1984
Parks Bond Program. No decision was made concerning the issue. Mr. Hedges
stated that the plan by the Park and Recreation Commission is to proceed with
the planning Por the improvements under tKe Park Bond issue with a maximum of
four construction seasons anticipated for construction purposes.

In 1974, under Projeet #113 coneerning Donnywood Addition utilities and
Towerview Road improvements, the Martin Shields property was assessed for
sanitary sewer, water lateral and street improvements. The assessments were
not formally adopted or certified because of Mr. Shields' request to have the
assessments deferred. In 1977 the Couneil again deferred the assessments for
an additional three years but no further deferral was done in 1980. Staff now
recommends that the Council formally adopt the original assessments in the
amount of $13,365.13 for the installation of the improvements and that 8$
simple interest per year be attached with the present balance due of
$24,057.23• After discussion, Smith moved, Thomas seconded the motion to
accept the recommendation and approve the recertification of the special
assessments for the parcel under Pro,ject l/113 in the amount of $24,057.23 to
be spread over 10 years at 8% interest conditioned upon the proper method of
proceeding on the project. All voted in favor.

On June 11 of this year, the enclosed letter was forwarded to
Mr. and Mrs. Shields' attention informing them of their outstanding
financial obligation for special assessments associated with
Project 113 which provided for the installation of utilities,
gradinq and gravel base along Towerview Road adjacent to their
southerly property line of the above-referenced parcel.
On July 23, you responded requesting additional information
before deciding which course of action the Shields would decide
upon regarding those assessments. I apologize for not responding
sooner. However, upon receipt of your letter, the City was
heavily involved in all of the final assessment hearings for
various other projects which precluded the research and,response
that you had requested. However, I will address your questions
in the manner that they were presented as follows:

for three years. Enclosed is a copy of a letter from the City
dated June 8, 1977, informing Mr. Shields that the three-year
deferrment had expired and that it would be certified to the
County Auditor. The enclosed letter of June 13, 1977, was Mr.
Shields' response requesting continued deferrment consideration
of this assessment. This second request was considered by the
Council at their meeting on August 16, 1977. Enclosed is a
copy of the minutes of that meeting which deferred the assessments
for an additional three years. There was an option for the
assessments to be deferred until the property developed with
the understanding that Mr. Shields would enter into a written
agreement agreeing to the assessments at a rate in af£ect at
said future time if it were to be indefinitely deferred. The
City does not have any record of Mr. Shields entering into such
an agreement as required by that action. Subsequently, the
second three-year deferrment expired on August 16, 1980.
The City is now requiring that these assessments be certified
and levied so that they are a matter of record for all potential
and future purchasers of the property. In addition, during
this ten-year period, the City has had to assume the liability
of the annual installments to pay off the bonds sold to finance
this project. Due to the fact that the City can no longer afford
to finance this deferrment at the original 8% interest, it will
be necessary for Mr. Shields to agree to have this assessment
levied in accordance with Option #1 or #2 as identified in my
previous letter of June 11, 1984.

I am representing Lynn Thiele, the purchaser of the lot described
above which is on the city council agenda for your approval this coming
Tuesday.
The Planning Conmti.ssion gave their approval subject to two contin-
gencies. The first being the granting of a 30-foot easement on the south
and west side of the property if in fact they have not been dedicated
already. The second contingency being the paymnt of $120.00 to the
City of Eagan for park and open space use.
If a 30-foot easement has to be given to the City on the south and
west side of thi.s property, my client will not purchase the property
:rnr] Plartin Shields would have a hard time finding anybody to purchase
the property. The future'street will destroy the tree line presently exisL-
ing and detract greatly from the lot. It has been the past experience that
once an easement is given, the future road becomes a reality and the adjoin-
ing property owners' wishes are ignored.
Enclosed please find a page xeroxed from the Abstract for the prop-
erty in question. The lot which is the subject matter of this request
has been exPmpted from any future additional land requirement because
of the virtue of the conveyance of 10 dcres from Martin and Myr'tle to
the City of Eagan in 1975. This additional assessment seems to be con-
trary to my sense of fairness whereby the property had already been
assessed.
LeMay Lalce is located to the north and east of this lot and it
looks inconceivable from viewing the site location that the City would
extend Towerview to service Alphy LeMay's old place in the need to
tuck the road between the lake and the existing houses.
I would appreciate it if you could drive out and view the site in
question before the meeting and realize that the Planning Corrnni.ssion's
requests are superfluous and not needed for this particular lot.

At the public hearing for the above-re£erencecl pmject held before the City Council
on Octdber 6, 1981, this iten was cvntinued far consideration tmtil OctAber 20 for
the follaaing iwo reasons:
1. The Coimcil directed the City sta£f to prepare an assessment roll directly
relating to benefit per existing City policy and oca[pare it tn the pro-
posed assessaient spread as rnquested by you during the preparation of the
feasibility report.
2. The staff is to work with you to dbtain your imderstanding that there will
be future sanita,-y sewer lateral assessments levied against both proper-
ties in the future as extensions of the sanitasy sewer way warrant depen-
dent upon proposed future developirents.
The City will he performing the analysis referenced in No. 1 above and will have
this inforniation availaUle for the October 20 continued public hearing. I will re-
view this in£orniation with you on October 19 prior to that CoLmcil meeting.
Pertaining to No. 2 above, the Coimcil wants to be assured that you realize that
the assessments associated with this particular project da . not prohibit future
assessments to be levied against both paroels. 'I'his proposed project should not
be considered as a one time saru.taz_y sesaer lateral assessmrtt against your property.
Future projects and develoFmients may dictate extensions of the sanitarv seaer which
would precipitate additional assassments if you request their installation by the
City. Theiefore, if you ooncur and agree with this tmderstanding, please sign
where indicated on this lettex and return to my attention prior to October 15, 1981.
Your anticipated cooperation will be greatly appreciated and will help to insure
that this project receives the proper authorization fran the City Coi.mcil.

THIS RIGHT-OF-WAY EASEMENT is made this 3`d day of February, 2006, between
ANTHONY E. MAHOWALD and NANCY C. MAHOWALD, husband and wife, (hereinafter
