Hedges City Administrator 3830 Pilot Knob Road Eagan, MN 55122 May 21, 1985 Re: Project #113 - Martin and Myrtle Shielde Assessments Dear Mr. Hedges: AueA Cooe 612 TELEPMOHE 4546224 This letter is for the purpose of summarizing the City's legal position with regard to assessments which will be discussed by the City Council this evening at an assessment hearing relating to the Martin and Myrtle Shields property north of Towerview Drive. The proposed assessments relate to sanitary sewer and water laterals, services, and grading and gravel base restoration relating to the installation of the sewer and water. The assesements were originally proposed to be asseased on May 7, 1974, and at approximately that time the City deferred the assesaments to be levied against the Shielda property for a period of three years. An additional three-year deferrment was requested and granted by the City Council on August 16, 1977, with the understanding that when the property was assessed it would be at the rate in effect at the time of the assessment and with the futher understanding that Mr. Shields would enter into a written agreement, if necessary, agreeing to the assessment at the rate to be in effect at that future time. Aa you are aware, despite repeated attempts to obtain such an agreement, no such agreement wae ever aigned by Mr. Shields. Because no agreement was ever signed by Mr. Shields putting into effect the resolution of the City Council of August 16, 1977, it is unclear whether the City may legally Levy the assessmente at the rates currently in effect. Our office feels confident that the City can assess [the original proposed' assessment of $13,365.13 plus interest at 5.0311% from October 1, 1973, the interest rate on bonds used to finance the improvements and the date of issuance of the bonds. As a compromise, City staff originally proposed that the aesessments be determined at the original assessment rates plus 8% eimple interest. Apparently this is not acceptable to Mr. Shields and his attorney. Because the matter is very likely to be contested, we wanted to bring to your attention and to the City Council's attention the possibility that the assessment would not be approved upon an assessment appeal if interest above the 5.0311% bond interest is used between October 1, 1973, and the date of actual levy of the assessment. I have discussed this matter with Gene VanOverbeke, the Finance Director, and he ia in agreement that the safest way to handle these assesaments would be to use the 5.0311% interest rate rather than the 8% interest rate. ? Mr. Hedges May 21, 1985 Page ltao With regard to interest commencing on the date of levy of the assessment, we are not as restricted. If the assessments are levied in May of 1985, the maximum interest rate allowable would be 12%. If the assessments are levied in June of 1985, the maximum interest rate would be 11%, atarting on the date of levy of the assessment. This is pursuant to Minn. Stat. 3475.55 which allows for a floating intereat rate on special asaeaements. The typical assessment rate for 1985 for special assessments has been 11%, and a deviation from the use of that percentage might be challenged by Mr. Shields. However, because of the apecial circumstances involved here, our office believes that the 12% interest rate could very well be justified and accepted by the Court upon appeal. (If the City Council does levy the assessments_and usea the bond interest (rate for interest from October 1, 1973, through the date of levy, that amount df interest would be considered a cost of the improvement and would be (included in the principal which would then draw interest_at_a rate of up to 12% commencing from the date of levy. If the approximately 5% interest rate were to be used, the amount to be levied would be $21,097.88. If the SX interest rate originally recommended by City staff were to be used, the assessment would be $25,126.44. Assessment would then draw interest at a rate up to 12%. MARTIN SflIELDS PROPERTY - PROJECT #113 - TOWERVIEW ROAD - UTILITIES Mayor Bea Blomquist convened the public hearing regarding the assessmenta on the Martin Shields property along Towerview Road under Project #113. Mr. Hedges briefly reviewed the history of the assesaments, noting that they originally were proposed to be assesaed in 1973 and had been deferred several timea. City Attorney Paul Hauge submitted a letter to the City Council and recommended that the original assessments be increased by the amount of the bond in[erest rate paid for the sale of improvement bonds for the project at approximately SX, with a total assessment of about $21,000.00. This would conatitute a reduction of about $4,000.00 from that originally proposed, but recommended approval based upon both the benefit test and the coat analyeis rtest. ?an Beeaon, attorney, and Martin Shields were present and indicated o ?v that they had agreed wi[h the proposed reduction in assessments and would not appeal the assessments. No action was taken. ? WSSTBIIRY 3RD ADDITION - PBOJECT #441 The next public hearing convened by the Mayor concerned Project #441 regarding utility and street improvements in Westbury 3rd Addition. The hearing had been continued from the May 7, 1985 council meeting because the developer was not present at that hearing. Mr. Gabbert wae present at the May 21, 1985 meeting and stated that the developer favored the project. There were no objections to the project. EAGANDALE OFFICE PAR& - EASSMENT VACATION . The next pu6lic hearing convened by the Mayor concerned the vacation of the existing utility and drainage easements for Lots 1 through 3, Block 4, Eagandale Office Park. Al1 noticea were publiahed in the legal newspaper and sent to all potentially affected utility companies. The easementa should be vacated before the filing of the Eagandale Office Park 2nd Addition plat. There were no objections to the vacation. City Administrator Tom Hedges announced that because of the School Board Elections, no official decisiona will be made by the City Council until 8:00 p.m. However, informal discussion will take place before that time. PARR 6 RECREATION DEPARTMENT 1, Northview Elementary School. Mike Ravich, a fifth grader, and Bo6 Ferguson, the Principal at Northview School, appeared on behalF of Northview Elementary School expressing their thanks to the Park and Recreation Dept. for the cooperation in installation of playground equipment. Mike Ravich read a statement on behalf of the etudents of Northview School. 2. Gang Mower Purchase. Ren Vraa was present and stated that the City has been offered the right to purchase a Gang mower from School District #191 for the sum of $14,000.00. He atated that a Gang mower was identified as a capital purchase for 1987 and although the Ci[y Park Department does not need the size mower proposed [o be purchased at the present time, that it was a good value. No action was taken. Councilman Smith suggested that the Council authorize the purchase and that the funds be included in the 1986 Capital Budget for the Park and Rec. Department. SLATERS ACRES EASEMENTS - CONTRACT #85-3 Mr. Hedgea and Mr. Hefti discuased with the Council several alternates: regarding the construction of utility easements in the Slaters Acres area under Contract #85-3. The alternates included 1) approving the contract and ordering the condemnation of the two necessary easements tha[ have not been acquired, 2) proceed only with a part of the contract within James Court and exclude the parcels where easements have not been acquired, and 3) to drop the project for the time being. 1 . There was a question as to what [he variance would be at the setback of the residence and it vas noted that the plat was not approved with removal of the eyebrow. The staff recommends approval of the eyebrow where poesible for maintenance purposes. The total, proposed assessment is in the amount of $25,126.55 for certain improvements installed in Towerview Road in 1974. After the installation of these improvements, the City Council de- ferred the levy of the assessments until the property was developed. That was done on two occasions, once in 1974 and again in 1977. The property is still undeveloped. In the intervening time, the Shields` property has been subjected to special assessments, largely for the upgrading of Pilct Knob Road, which have a current balance in excess of $50,000.00. If the pro- posed assessments are adopted, the total of special assessments on the Shields' property will be almost $76,000.00. The Shields own approximately 13 acres of property, meaning assessments of about $6,000.00 per acre. With respect to the proposed assessments, we object to them on the basis that they do not specially benefit the Shields' property by the amount of $252126.55. I do not have any knowledge of any formal appraisal being performed against this property in relationship to the improvements installed under Project 113. Please be informed that these original assessments were adopted in 1974 and at the request of Mr. Shields, they were deferred for three years. Enclosed is a copy of a letter from the City dated June 8, 1977, informing Mr. Shields that the three-year deferrment had expired and that it would be certified to the County Auditor. The enclosed letter of June 13, 1977, was Mr. Shields' response requesting continued deferrment consideration of this assessment. This second request was considered by the Council at their meeting on August 16, 1977. Enclosed is a copy of the minutes of that meeting which deferred the assessments for an additional three years. There was an option for the assessments to be deferred until the property developed with the understanding that Mr. Shields would enter into a written agreement agreeing to the assessments at a rate in affect at said future time if it were to be indefinitely deferred. The City does not have any record of Mr. Shields entering into such an agreement as required by that action. Subsequently, the second three-year deferrment expired on August 16, 1980. The City is now requiring that these assessments be certified and levied so that they are a matter of record for all potential and future purchasers of the property. In addition, during this ten-year period, the City has had to assume the liability of the annual installments to pay off the bonds sold to finance this project. Due to the fact that the City can no longer afford to finance this deferrment at the original 8% interest, it will be necessary for Mr. Shields to agree to have this assessment levied in accordance with Option #1 or #2 as identified in my previous letter of June 11, 1984. . You may remember that at your request the City Council deferred the assessments and again extended the deferrment on April 16, 1977, .. for an additional three years. - < ti Neither the City nor you arranged for a later extension or deferrment and the original assessments, which were in the sum of $13,365.16, have not been levied and have not been paid. We have calculated that at 8% simple interest which was the assessment interest factor in effect at that ticne, would now result in a principal balance, including the interest, of approximately $24,000. It is our recoumendation that due to the fact that the original assessment was to be spread over 20 years, that the principal now be spread over ten remaining years and that the assessment be levied. This could be done in one of several ways: 1. The City could commence a new hearing and levy the assessments at the rate in effect at the present time. 2. The City could commence the assessment process and levy the assessments based upon the 1974 rates plus 8% interest to the present time. 3. You, as the property owners, could waive notice of any hearing requirements and allow the assessment to be levied at one of the two rates that are included in the two options mentioned above. The first being the granting of a 30-foot easement on the south and west side of the property if in fact they have not been dedicated already. The second contingency being the paymnt of $120.00 to the City of Eagan for park and open space use. If a 30-foot easement has to be given to the City on the south and west side of thi.s property, my client will not purchase the property :rnr] Plartin Shields would have a hard time finding anybody to purchase the property. The future'street will destroy the tree line presently exisL- ing and detract greatly from the lot.
