This Escrow Agreement ("AgreemenY') is entered into as of thiV,,I71 day of
?i r?1! r'°Ma 0 0- I2? 2001 by and between the City of Eagan, a Minnesota municipal corporation
("City") and Crail E. McMahon, a single person ("McMahon").
WFIEREAS, McMahon is owner of Lot 1, Block 2, Kennerick Addition in the City of
Eagan, County of Dakota, State of Minnesota (the "Property"); and
WHEREAS, McMahon has requested the City to approve the proposed platting of the
Properiy;and
WHEREAS, in connection with the approval of the plat the City has required the existing
residence located on the Property be connected to City sanitary sewer and watermain systems;
and
? WFIEREAS, in connection with the approval of the plat, the City has required that all
septic systems located on the Property be abandoned in accordance with the City and
r? Dakota County standards; and
WHEREAS, McMahon has requested the City to allow her until January 1, 2004 to
J? complete the connection of City sanitary sewer and watermain systems to the eacisting home on
the Property and to abandon all wall and septic systems on the Property; and
WHEREAS, McMahon is willing to deposit in. escrow with the City, funds for
connecting the existing home on the Property to City sanitary sewer and watermain systems and
to abandon all ,. --•°'??d-septic systems on the Property.

NOW, TfEREFORE, in consideration of the foregoing and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the Parties hereby
agree as follows:
1. McMahon shall complete connection from the City's sanitary sewer and
watermain systems to the existing home on the Property prior to January 1, 2004.
2. If McMahon fails to fumish proof to the City by January 12, 2004 that the we6 ?
aftd septic systems on the Properiy have heen abandoned, the City shall retain the funds
deposited for that purpose.
3. McMahon shall abandon all avells-effd-septic systems within the Properry in
accordance with the City and Dakota County standards prior to 7anuary 1, 2004.
4. McMahon shall pay to the City, upon delivery of an executed copy of this
Agreement, a non-refundable connection fee of $2,922.00 as itemized on the attached Exhibit
«A>,
5. McMahon shall deposit $2,800.00 with the City, upon delivery of an executed
copy of this Agreement, which amount is two times the estimated cost of constructing and
connecting the sanitary and watermain utilities to the existing home on the Property.
6. McMahon shall deposit $8,000.00 with the City, upon delivery of an executed
copy of this Agreement, which amount is two times the estimated cost to abandon the we4-&M?
septic sysiems contained on the Properiy.

7. Upon McMahon furnishing proof to the City that the existing home on the
Properiy has been connected to the City sanitary sewer and watermain systems, the City shall
release the funds escrowed for this purpose.
8. Upon McMahon furnishing proof to the City that the •- -'-fteFseptic systems on ? i
the Property have been abandoned in accordance with the City and Dakota County standards, the ?
City will release the funds escrowed for this purpose.
9. If McMahon fails to furnish proof to the City by January 12, 2004 that: (i) the

systems; and (ii) the existing ARAPIlN and septic systems have been abandoned in accordance with
the City and Dakota County standards, the City shall retain the fixnds deposited as a forfeiture.
K 10. McMahon agrees that the City may enforce the connection of the eacisting house
to City utilities if such connection has not been made prior to January 12, 2004, which
enforcement may inciude legal action, if necessary. McMahon agrees that if the City is required
to enforce the connection through legal process, McMahon shall be responsible for all attomey
fees and court costs incurred by the City.

According to a document prepared by the Dakota County Environmental Management
THOMAS HEDGES Department, the use of broken and chipped battery casings were unofficially approved by the
University of Minnesota and the MPCA in the 1970's as an alternative to hard rock aggregate.

Dear Ms. McMahon:
The Dakota County Environmental Management Department has received the
resuits of the sampling done at the time of the excavation and cieanup of the
septic system at your house (copy attached). The results indicate that the lead
present was removed and recyGed properly.
Samples taken at the site indicate that the levels present in the soils left on-site
are not above the Soil Reference Values for unrestricted use as set by the
Minnesota Pollution Control Agency, and the levei of cleanup is consistent with
the draft MPCA guidelines.
All backfill and topsoil brought in and placed was non-contaminated material
Your well was tested by this Department and showed no lead contamination.
Surface soils were also tested for lead and found to be at background levels.
Based on the removal of battery casings and associated contaminated soils, and
the results of the analyses, the Department will close its file for this property.

Jon, attached you will find a letter from Bazry Schade, Dakota County Director of Environmental
Management. Bany has had a number of contacts with Gail McMahon regarding excavation of
battery casings on her property at 1429 Lone Oak Road.
As you can see by Bazry's letter, the County has identified ten sites in Eagan that used battery
casings in the construction of individual sewage treatment systems (I.S.T.S.). It appears that four
of ten sites aze still pending, or casings remain on-site. Based on this information, I believe we
should place a waming flag on lots containing battery casings that haven't been mitigated, as well
as place a copy of Barry's letter in the relevant patcel files. A warning flag on the PIMS system
would allow us to inform individuals requesting permits of this issue.
Barry has indicated that sites containing battery casings usually don't need to be mitigated unti]
they are disturbed. Once they aze discovered, it is Dakota County's policy to require the property
owner to record this information with the property data base at Dakota County.
If you need additional information or if you feel our plan of action needs to be modified, please
advise.

Enclosed are the analytical repoRs for the samples of water, house dust, and
soils collected from your residence on January 9, 2004. The results indicate that
the interior dusts and the well water supply are free of lead contamination. The
soils collected from the soil/6attery casing siockpile in your backyard contained
significant levels of lead.
This suggests that lead from the soil/battery casing stockpile has not been
transported into your house and has not impacted the weil water supply.
However, the lead in the soil/battery casing stockpile represents risk to human
health and measures should be taken to reduce the potential for exposure to this
lead source. While the plastic cover placed over the stockpile has served to
reduce the potential for direct contact with the lead, bare soiis contaminated with
lead are accessible to direct contact or through wind dispersal. We recommend
placing additional plastic sheeting on the stockpile to further reduce the exposure
to the lead contaminated waste and soiis. We also recommend that you limit the
use of the backdoor and install additional fencing around the stocicpile to prevent
inadvertent contact with the stockpile.
Also enclosed is the list you requested of other situations the County has
encountered where battery casings have been used in the construction of ISTS's
(individual sewage treatment systems).

concerning prior and current trunk charges to your pmperty. Based on that research it
was determined that your pmperty was charged for two water trunk and sanitary sewer
trunk charges. Therefore the City will refund the amounts paid by you for the second
water and sanitary sewer hunk charge and will remove those charges from your property.
In addition the City will process the necessary forms to remove those charges from the
Dakota County records so the chazges do not appear on future property tax statements.
