'8 2005 i The purpose of this correspondence is to address the issue of the doorway leading from the addition to the existing outside balcony. We are aware of the IRC restriction of 1- 1/2 inches threshold height. Due to the particular circumstances involved in Yhis doorway, we are requesting a variance to the IRC. The reason for this request is as follows: This doorway is located below a major roof valley which spills copious volumes of water into this area during the type of rainstorms which have been typical of this summer. The doorway was constructed with a 1-1/2 inch concrete curb to prevent water from entering the addition during such conditions. This problem is further exacerbated by the fact that the interiar floor elevation is slightly lower than that of the balcony. This results in a threshold height of 3 inches from the interior and 2-1/2 inches from the exterior. Our concern is that setting the threshold lower will contribute to moisture problems at this doorway. We feel that the present construction represents the best compromise between safety and practicality. Thank you far your consideration of this request. Applications i nclude foundation, basement, retaining walls and above grade walls. PolySteelO Forms are hollow core forms of expanded polystyrene face shells connected with galvanized steel cross ties. The expanded polystyrene (EPS) foam plastic blocks have a standard length of 48 inches (1219 mm). The outer faces of the EPS blocks present a continuous flat surface of polystyrene ready to receive exterior and interiorwall fin ishes. The steel cross ties provide a mechanism for attaching interior and exterior wall coverings since each tie has a minimum 1 inch (25.4 mm) wide steel furring strip recessed no more than 0.50 inches (12.7 mm) below the block surface The PolySteel@ Forms are available in hvo styles, wafFle-grid wall forms and flat-wall forms. W hen stacked, the EPS Waffle-grid blocks form oval-shaped vertical cores spaced 12 inches (305 mm) on center, and oval-shaped horizontal cores spaced 16 inches (406 mm) on center. The EPS flat wali blocks consist of two expanded polystyrene foam boards with a thickness of 2.5 inches (64 mm) . Held together 6y steel cross 4es spaced 6 inches (153 mm) on center. See Figure 2 for EPS flat foam block dimensions. 3.2 Materials 3.2.1 Expanded Polystyrene: Form units are molded from expanded polystyrene beads manufactured hy BASF Corporation (ICGES Legacy NER-479), Styrochem@ U.S. Ltd. (ICC-ES Legacy NER-238), Huntsman Chemical Corporation (ICC-ES Legacy NER-384), or AFM Corporations's R-Control Perform Guard EPS (ICC-ES Legacy NER-551). Each end of the cross tie is bent with a 1 inch (25.4 mm) 90° retum. A hot dipped galvanized steel strip complying with ASTM A 653 having a minimum yield strength of 33 ksi (228 MPa) that is 2 inches (50.8 mm) wide, 10 inches (254 mm) long, and having a minimum thickness of 0.013 inches (0.33 mm) is sandwiched around the 1 inch (25.4 mm) returns of the expanded steel cross tie to provide a 1 inch (25.4 mm) wide by 10 inch (254 mm ) long furring strip having a double [hickness of galvanized steel totaling a minimum thickness of 0.026 inches (0.66 mm). Galvanizing complies with ASTM A 924 having a minimum coating class of G90 (Z180). 3.2.2.2 Galvanized steel welded wire cross ties 3 inches (76 mm) shorter than the height of the block. Steel wire is welded in a rectangulargrid pattern wilh spacing dimensions ranging trom 1.65 inches to 4 inches (42 mm to 102 mm). Each end of the cross tie has a galvannealed steel strip 1.75 inches (45 mm) wide which is bent length-wise forming an L-shaped member 0.25 inch by 1.5 inches (6 mm by 38 mm) providing a 1.5 inch (38 mm) wide furring strip. All welds atwire-to-wire and wire-to-strip connections are resistance welds in accordance with AW S c.1.3. W ire complies with ASTM A 641, soft temper with a Class 1 zinc coating (galvanized) having a minimum diameter of 0.120 inch (3 mm) and having a minimum tensile strength of 60 ksi (413 MPa). Steel strips comply with ASTM A 653 and have a minimum thickness of 0.030 inch (0.76 mm) with a minimum yield stress oi 25 ksi (172 MPa). The steel s[rip is zinc-iron alloy coated (galvannealed) by the hot-dip process having a minimum coating class of A60 (ZF 180). 3.2.3 Concrete: Normal weight concrete complying with Chapter 19 of the Code, with a minimum compressive strength 02500 psi (17250 kPa) at 28 days and a maximum aggregate size of 3/8 inch (9.53 mm) when using the 6" and 8" Waffle-Grid Forms and 3/4 inch (19.05 mm) when using lhe 10" waffle-Grid form and 6" and 8" Flat W all Forms. 3.2.4 Reinforcement: The concrete is reinforced with deformed steel reinforci ng bars, complying with [he applicable Code with a minimum yield strength ofeither40 ksi (275 kPa) or 60 ksi (413 kPa) depending on the structural design. 4.0 INSTALLATION 4.1 General The PolySteel@ Forms are installed as formwork for either load bearing or non-loadbearing walls for residential and commercial construction. These walls include toundations, basements, retaining walls and above grade walls. Structural calculations and de[ails of concrete shail be prepared in accordance with the manufacturer's instructions, ACI 318, the applicable model Code and shall be approved by the building official, and is outside the scope of this evaluation report. The manufactu rer's published installation instructions and this report shall be strictly adhered to and a copy of these instructions shall be available at all times on the job site during installation. 4.7.7 Interior Finishes: Forms exposed to the interior shall be finished with an approved 15 minutes thermal barrier such as 1/2 inch (12.7 mm) thick gypsum wallboard as required by the applicable code. The interior gypsum wallboard is attached to furring strips on the PolySteelOO Forms, wilh minimum No.6 by 1-1/4 inch (31.75 mm) selftapping screws. Spacing of the screws is a maximum 12 inches (304.8 mm) on center in the horizontal and vertical directions. Adhesives in accordance with ASTM C 557 are permitted for attaching the interior finishes to the forms in conJunction with the mechanical fasteners. 4.7.2 Exterior Finishes: Forms exposed to the exterior shall be finished with an approved exterior wall covering installed in accordance with the applicable code. The wall covering shall be attached to the PolySteelO Forms furring strips with approved corrosion-resist2nt, coarse-threaded, self-tapping screws, having sufficient length to penetrate the furring strips a minimum of 114 inch (6.4 mm). No. 6 and No. 8 screws in forms using expanded steel cross ties have an allowable pullout capacity of 23 pounds (102 N) and 27 pounds (120 N) respectively. No. 6 and No.B screws in forms using welded wire cross ties have an allowable pullout capacity of 49 pounds (218 N) and 59 pounds (262 N) respectively. For portland cement stucco f nishes, an approved metal or wire fabric lath shall be attached to the PolySteelB Forms furring strips with minimum No. 6, lath-head screws or 1 inch (25.4 mm) long galvanized self-tapping sheet metal screws The screw spacing shall be 8 inches (203.2 mm) on center vertically and 12 inches (304.8 mm) on center horizontally. The stucco finish shall be applied in accordance with the applicable code. An EIFS finish system shall be installed in accordance with its current ICGES Legacy Evaluation Report. Other approved exterior finishes are permilted and shall be installed as required by the applicable code. 4.1.3 Installation: The PolySteelO Form units shall be constructed with vertical cavities alig ned. Reinforcement shall be installed as required by lhe approved construction documents. The forms shall be assembled and braced, and concrete placed as described in the detailed procedures approved by the manufacturer. For basement installation, walls shall be constructed as noted above and drainage system around the basement wall shall be provided as noted in the manufacturer's instructions. Waterproofng and damproofing of basement walls shall be as required by the manufacturer's instructions and as approved by the building official. No backfill is permitted applied against the wall unlil the complete flooring system or bracing is in place. Backfill of the basement wall shall be free of construction debris, sharp objects, or large rocks. 4.2 Attic or Crawl Space Installation In jurisdictions that have adopted the Standard Building Code 0and the BOCA National Building Code, the PolySteelO Forms shall be permitted to be installed exposed in an attic or crawl space without a tharmal barrier under the following conditions: 4.2.1 entry to the attic or crawl space is limited to service of utililies; The instructions within this report govern if there are any conflicts belween the manufacturer's instructions and this report. 4.2.2 there are no interconnected attic or basement areas; 4.2.3 air in the attic or crawl space is not circulated to other parts of the building; Page 3 of 7 NER-515 4.2.4 ventilation of the attic or crawl space shall be provided in accordance with the applicable Code. 4.5 Wood Construction in Areas of Very Heary Termite Infestation 4.2.5 Attic or Crawl space installation shall be limited to forms expanded from beads manufactured by BASF Corporation, Huntsman Chemical Corporation or Styrochem U.S. Ltd. 4.3 Allowa6le Concrete Lift Rates Concre[e shall be placed in the forms at a rate noted in the table below with a maximum rate of 5 feet per hour (1.5 m/hr). Design calculations and details for specifc applications shall be furnished to the code official verifying compliance with this report and the applicable Code. The individual preparing such documents shall possess the necessary credentials regarding competency and qualifications as required by the applicable Code and the professional registration laws of the state where the construction is undertaken. 4.4.2 Prescriptive Design ICF: PolySteel@ Forms are defned as Waffle Grid and Flat insulating concrete form wall systems and may be designed and reinforced using the load tables for either Waffle Grid or Flat ICF forms in Sections 1916 and 1804.6.2 of the Stattdard Building Code@ or Sections R404.4 and R611 of the Internationaf Residentia! Code@ provided the building conforms to the applicability limits defined in Sections 1916.2 and 1804.62.1 of the SSC or Sections R404.4.1 and R611.2 of the lRC. When using this prescriptive design method, the wall thickness is limited as noted in the applicable code sections referenced above. 4.4.3 Non-Prescriptive Design: W hen the ICF forms are installed on buildings that do not conform to the applicability limits of Sections 19162 and 1804.6.2.1 of the SBC or Sections R404.4.1 and R611.2 of the lRC, the structural analysis and design of the concrete shall be prepared in accordance with ACI 318 and Chapter 19 of the Standard Building CodeV, lntemational Building CodeOO, BOCA NationaJ Suilding Code or Uniiorm Building CodeTM or Section R61 i of the lnternational Residential CodeO, as applica6le_ 4.4.4 Prescriptive Design of ICF by PCA Pub. Any of the forms described in this report are permitted to construct the fire-resistive wall. The concrete shall be normal-weight concrete traving a minimum compressive strength of 3000 psi (20700 kPa) at 28 days, and shall be designed in accordance with Section 4.4 of this evaluation report. Ordinance 52.05, subd. 2, subsection RR defines a "Lot of Record" as either a plat or parcel of land the deed to which has been recorded prior to adoption of the Ordinance and which met the minimum requirements of city and state law in effect on the date of recording. 2.) The North 300 feet of Lot 17, Zehnder Acres, together with an easement for roadway purposes over the West 15 feet of that part of Lot 17 lyinq South of the North 300 feet is a "Lot of Record." 13 3.) The subject lot contains approximately 12"F Acres. 4.) The subject lot is platted as part of Zehnder Acres. 5.) The North 300 feet of the lot became a separate lot or parcel approximately 14 years ago when it was separated from the South part of Lot 17. The deed of conveyance was on or about April, 1964. 6.) Thus, because this parcel was platted and was a separate entity or indentifiable lot prior to enactment of Ordinance No. 52, this tract became under Ordinance No. 52 a"Lot of Record" as so defined by the Ordinance. 7.) Be mindful that this "Lot of Record" contains, in addition thereto, an easement for roadway purposes over the South part of Lot 17. 8.) Prior to adoption of Ordinance 52, I understand that the subject lot was in all respects a buildable lot. 9.) Consequently, when the lot was bought and sold, it was done so with the easement for roadway purposes. 10.) In short, I understand that prior to Ordinance No. 52 the / owner could have built on this "LOt of Record" in light of ? the fact that the owner had the roadway easement. 11.) What must be understood is that prior to Ordinance No. 52 was buildable; now according to the literal reading of Ordinance No. 52 the lot has become unbuildable. 12.) Certain other facts about the subject should also be noted: a.) the lot is zoned R-l; b.) a single-family dwelling is proposed to be constructed on the lot; 1-3 c.) the lot does have approximately Acres of land; d.) water service has been stubbed to the subject lot from Lone Oak Road; e.) sanitary sewer is available to the subject tract; f.) the subject lot has been assessed for water area and sewer trunk line in 1972; g.) the orientation of the homes to the west of the subject lot indicate that the most orderly and logical manner of developing the subject lot would be to "mirror" the development to the west. Directinq your attention to the attached lot sketch, you will note the Huntley and Marich residences are oriented so that their garage and driveway access is to Whitby Drive leading to Lone Oak Road. The subject lot would have its garage and driveway access to the 15 foot roadway easement leading to Lone Oak Road; the 15 foot roadway easement for the subject lot would run parallel to and adjacent to Whitby Drive, which a private roadway of 10 feet in width; h.) in viewing the subject lot and given the location and orientation of the adjacent residences, it is obvious that this particular lot is the last and only remaining lot to be developed in an overall tract comprising the Huntley, Marich, Brauer and Olson residences. Given the orientation of the Huntley and Marich residences and given the fact that Whitbey Drive is in place, the logical develop- ment of the subject lot requires a"mirroring" of the residences to the west, both in terms of structure location and roadway location. i.) the subject lot meets all zoning requirements save and except frontage for 60 feet on a public street, although it should be noted that the South part of Lot 17 has frontaqe of 200 feet on Lone Oak Road. - 2 - 13.) What the owners are applying for is a variance because of Ordinance 52.06, subd. 4 which states in part: A duly created lot of record shall be deemed a buildable lot provided all of the following are met: A,) The lot shall have a minimum of sixty (60) feet of frontage on a public street or the lot shall have been approved in platting a condominium project or an attached dwelling project wherein a contiguous lot, owned in common, provides said frontage. 14.) Under Ordinance 52.09 and amendments thereto, the Council has the authority to qrant a variance where "practical difficulties" or "particular hardships" exist. If the Council determine (1) that "soecial conditions" apply to the subject lot which conditions do notapply generally to other land in the area, (2) that the variance is necessary so that the owner thereof may enjoy the full and beneficial uses of the property and (3) that the variance will not: (a) Impair an adequate supply of light and air to adjacent property. (b) Unreasonably increase the congestion in the public street. (c) Increase the danger of fire or endanger the public sa£ety. (d) IInreasonably diminish or impair established property value within the neighborhood. (e) Disrupt the traditional practices or social cohesive- ness of the community. (f) Or in any other way be contrary to the intent of this ordinance or other applicable ordinances of the City of Eagan. then the Council may grant a variance. 15.) I respectfully suggest that all the ingredients for granting a variance exist in the instant case: a.) without a variance, the lot is unbuildable under a literal reading of Ordinance 52.06, subd. 4; - 3 - b.) without a variance, the subject lot has no practical or beneficial use; c.) a variety of "special circumstances" or "special conditions" exist: l.) the lot is a lot of record 2.) the lot has been bought and sold with the 15 foot roadway easement; 3.) water service has already been stubbed to the lot; 4.) the lot is the last and only remaining lot within a tract comprising the Huntley, Marich, Brauer and Olson residences; 5.) given the location of the Marich and Huntley residences and given the existence of Whitby Drive, the most logical development of the subject tract is to "MIRROR" the structure and roadway locations existing to the west; 6.) the "mirroring effect" will enhance the values of adjacent property because this effect is orderly and commensurate with what now exists. d.) a variance will not cause any of the problems listed in Ordinance 52.09, subd. 3(B) (4). e.)
