Oak Road, Eagan, Minnesota.
Dear Mr Rohleder:
On April 15, 1993, the Dakota County Environmental
Management Department (Department) received a complaint
regarding the above referenced matter. A site inspection by
Department staff confirmed the presence of waste tires and
rubber products at the site. This material is regulated as
solid waste by Dakota County ordinance and State law.
The waste rubher was encountered during the excavation o£ an
on-site septic system. The waste material, of unknown
depth, is buried under approximately six (6) feet of sandy
fill.
The origin, contents, and extent of the buried material is
unknown. Anecdotal accounts refer to the extensive burial
of tires and rublier products, collected as part of the war
effort, in the Eagan area following World War II. The
materials observed at the site are not inconsistent with
these accounts.
The Dakota County Solid Waste Management Ordinance No. 110
(Ordinance No. 110) which regulates the disposal of solid
waste, was not in effect prior to 1971, thus the burial of
waste at this site may not have been regulated. However,

the current activities necessitating the excavation of this
material excludes its return into the fill. Ordinance No.
110, Section II., Subsection 1. states:
" No person shall make nor allow his land or property
under his control to be used for intermediate or final
disposal of any solid waste except at a waste facility
for which a license has been granted by the County
Board, unless otherwise provided by this ordinance. No
person shall dispose of any solid waste on any
property, unless the County has granted a waste
facility license for that property, unless otherwise
provided by this ordinance."
Returning the waste tires and rubber to the property after
removal constitutes disposal of solid waste.
You are required to do the following:
All solid waste removed from the fill, as part of the
excava£ion for the sewer and water lines, must be
transported to a licensed sanitary landfill for disposal.
To avoid delays at the landfill, please contact the landfill
manager prior to the commencement of removal activities to
discuss any testing or assessment requirements the landfill
may have for the waste.
The Department will be completing a Disposal Site
Disclosure Record, to be filed with the Dakota County
Recorder's office. I have enclosed a copy of this form for
your reference and will submit to you a copy of the
completed form after further evaluation of the site.
This disposal site will be evaluated for possible
contamination. This does not presume that the site
represents a risk to public health or the environment. The
potential for contamination must be explored due to the
unknown character of the buried waste.
The Department will not require the complete removal of
buried waste at this time but reserves the right to require
abatement activities if warranted by adverse environmental
impacts or public health concerns arising from the materials
buried at this site.

The purpose of this letter is to bring you up to date on the Lone Oak Road disposal site
evaluation. We have now received the report from Braun Intertec on the results of the
borings, sampling and analyses done at 1534 Lone Oak Road, Eagan on October 10
and 11, 1995. Three temporary ground water monitoring wells were instalied to collect
samples that were then tested for possible contamination. After the sampling, all of the
wells were sealed. A separate vapor monitoring well was installed on the upper level of
the property for sampling any gas that was present in the waste. While drilling the
vapor monitoring well, waste at various levels and the soil below the waste was also
sampled.
We are currently reviewing the Braun report and the test results and will be sending you
a copy of the report with a summary when we complete our review.
Based on our initial review of the results, we have determined that the two issues of
immediate concern are the methane gas that was detected in the vapor monitoring well
and the high levels of lead in the waste material itself. We had previously informed you
that methane gas was found, and we tested all of the basements of the homes nearest
the disposal site in late October but detected no methane gas in the homes at that time.
We plan to test the homes for methane gas again in January 1996, and we will be doing
further investigative work to attempt to determine the extent of the methane, its possible
sources and impacts. It should take less than half an hour to do the re-test of your
basement. Please call Ray Erickson at 891-7543, to schedule a time that will be
convenient for you.
The high levels of lead in the waste are a concern because of the possibility that people
could be exposed to lead from waste that has come to the surface or from soils that
may be contaminated. We are planning to collect surface soil samples in the spring,

when eveather conditions permit, to determine if elevated lead levels are present and
will contact you prior to that sampling.
The shallow ground water samples tested low in volatile organic compounds, i.e., below
drinking water standards. Based on these and other analytical results, there is no
indication that industrial wastes other than rubber materiais were disposed on the site.
This is consistent with the finding of the earlier work done by Fromm Engineering. After
reviewing the test results, we are also convinced that there is not likely to be a ground
water problem caused by lead or other metais associated with the waste migrating from
the site. In addition, the water from this suficial aquifer is not used by area residents.
Therefore, we have no immediate concerns about the ground water and do not plan
any further testing or evaluation of it.

properties in this area, you should contact Jay Stassen of the Dakota County Attorney's
Office at 438-4564 if you have questions on the site or the proposed activities.

09 We have now completed our investigation of the Lone Oak rubber disposal site.
Enclosed is a copy of our final report, along with copies of the reports on the
various phases of the investigation done by the County's consultants. Although
the presence of the rubber disposal site may 6e an irritation and it may pose
problems related to land use, we find no major public health and safety concerns
or environmental impacts.
As noted in my most recent correspondence to you, the investigation had
focused most recently on potential health and safety issues related to the
presence of inethane gas and lead contamination. We extended our contract
with Braun Intertec, the environmental consulting firm that had conducted the
previous phase of the investigation, to study the distribution of inethane gas and
collect and analyze surface soil samples for lead contamination.
We concur with the findings and recommendations contained in the Braun
Intertec report, which are as follows:
1. Although the rubber waste in this area does appear to be serving as a
reservoir for methane gas due to its porous nature, it is unlikely that
rubber waste would produce explosive gas. The most likely source for the
methane gas appears to be previously used septic systems.
2. Although no methane gas was detected in the basement or adjacent to
the foundations of any of the homes, each of the owners of the six

residences on or adjacent to the disposal site should install a methane
gas detection and alarm system in the basement of the residence and
should also monitor for methane gas in probes installed outside the
foundation of the homes.
If you wish to have the probes that are now in place remain, please notify
us as soon as possible to arrange the transfer of these probes to you.
The County Environmental Management Department will not be doing any
further monitoring for methane gas at this site.
3. The lead in the buried rubber waste should not present a health risk if left
undisturbed. Residents can reduce exposure to any lead contamination
by maintaining a good grass cover and using wood chips on open soil as
necessary. Any excavation of rubber waste or contaminated soil should
be done in a manner that will reduce dust and water runoff. In addition,
the rubber waste exposed during excavation should be removed
completely from the site. Some restrictions regarding disposal may apply
to the rubber waste, and we suggest you contact us if you need
assistance in determining if this is the case. The County Environmental
Management Department will not be doing any additional testing for soil
contamination.
All of the other metals present in the soil samples were at concentrations below
those approved by the Minnesota Department of Health as recommended
standards and were consistent with naturally occurring levels of these metals.
