SUBJECT: betached Garage at 1573 Lone Oak Road
As requested by the property owners, Dakota County approved a lot consolidation for tax
purposes for the property at 1573 Lone Oak Road in 2009 (see attached Real Estate report).
The owners did not notify the City of the consolidation and a survey was not received. While
the lot consolidation was approved by the County, it does not remove interior property lines.
The property owners are now interested in constructing a detached garage on the
northernmost parcel. Although the City of Eagan does not have a survey of the property,
based upon the finding of the lot pins, the proposed garage will not be located over the
interior lot line.
Since this property was consolidated, a subdivision would be required if there is a future
desire to separate the lots. The northern most parcel would need a principal structure located
upon it as a detached garage/accessory structure, cannot be the principal use/building, on the
property.

Dear Mr. and Mrs. Baker:
Mr. Schwab called the office this morning and stated that you
threatened Roger Weierke of Weierke Trenching & Excavating with
a Lawsuit if his company went upon the southeast corner of your
lot for purposes of making a sewer service connection. I am also
advised that you claim such an easement is not of record.
I represented Mr. and Mrs. Buchan in 1969 when you purchased
your property from them. Therefore, Mr. Schwab has asked me to
check my file.
My file would clearly demonstrate that you purchased the
property with the full knowledge of the easement and its
intended purpose.
The property you purchased on January 7, 1969, was as per
Exhibit "A" attached to the Purchase Agreement. The exhibit
shows that the City of Eagan installed two service connections
on Lone Oak Road for purposes of servicing three of the four
lots in the subdivision of Lot 20, Zehnder Acres.
At the time of your purchase, you obtained financing through the
First National Bank of Minneapolis. Daphine McAlister of the
bank's Real Estate Loan Department made inquiry of ine as to the
location of the service connections. In my letter to Ms.
McAlister dated January 20, 1969, I did forward to her a copy of
the Certificate of Survey. The information forwarded is attached
to a copy of my Sanuary 20 letter and delineates the sewer and
water service connections in Lone Oak Road.
Also, your deed of conveyance contains a statement as to the
location of the easement over and across the property you
purchased for the purpose of connecting to the service
connections. (See photocopy enclosed.)

It is my understanding that you have firewood piled along the
east property line, and this would have to be moved. In addition,
I am informed that there is a wire fence along the south
property 1ine. Obviously, in proceeding to construct the sewer
and water connection in the area of the easement it will be
necessary that both of these items temporarily be moved.
I have advised Mr. and Mrs. Schwab that 'they are legally
entitled to proceed to hookup to the sewer and water main across
the easement which is located upon the southeast corner of your
property. This is the very purpose for which the easement was
reserved.
The City of Eagan made the determination as to the location of
the municipal service connections in Lone Oak Road. The
Buchan's, of necessity, had to reserve an easement over the
southeast corner of your property because of the grade of Lone
Oak Road and the actual placement of the service connection.
The Schwab's are now ready to hookup their new home to municipal
services, and they have every right to do so upon receiving the
necessary permits and approval from the City of Eagan.
