The grant of the foregoing permanent Easement Area for ponding purposes includes the right
to conduct the normal practice of filling the Easement Area with water from storm sewer runoff.
The City shall have the right to do whatever is necessary for the enjoyment of the rights herein
granted, including the right of clearing the Easement Area to allow for the use of the land as stated
herein, and also including the right to excavate within the Easement Area and to install, lay, maintain,
operate and repair storm sewer pipes and utility lines and the right of ingress and egress to and from
said tract of land and ovyr and across the Easement Area for these purposes.
The grant of the foregoing permanent easement for drainage and utility purposes includes the
right of the City, its contractors, agents and servants to enter upon the Easement Area at all
reasonable times to construct, reconstruct, inspect, repair and maintain pipes, conduits and mains;
and the further right to remove trees, brush, undergrowth and other obstructions. After completion
of such construction, maintenance, repair or removal, the City shall restore the premises to the
condition in which it was found prior to the commencement of such actions, save only for the
necessary removal of trees, brush, undergrowth and other obstructions.
And the Landowners, for themselves, their heirs, executors, administrators and assigns do
hereby release the said City of Eagan, its successors and assigns, from all claims for any and all
damages resulting to said land by reason of the location of lake, ponding area or utility be,
IN WITNESS WHEREOF, the Landowners have caused this easement to be executed as of
the day and year first above written.

I am writing this letter in response to your letter of December 6, 1999 to City
Administrator Hedges in which you among other things inquired about the proposal to
pay the assessments of approximately $160,000 over ten years on the above referenced
property. You requested the exact amount and the procedure to implement this plan.
The December 31, 1999 outstanding balance totals $149,939.86. That total consists of
$51,097.17 of deferred principal and $98,842.69 of interest. The general procedure is
that you as the property owner would sign a "waiver of assessment hearing form"
allowing the City to certify the assessments to the County Auditor to be collected with
your property taxes over a ten year period. The timing is such that the first payment with
the property taxes would be made in the year 2001.
There are two ways to accomplish the assessment from this point. First, we could
assess the $149,939.86 at this time and the first installment collected in 2001 would
include interest at the rate of 6.5% through the end of 2001. In other words the first
installment would have two years (2000 and 2001) interest included. The following table
illustrates the total annual installments under that scenario. Each annual installment
includes $14,993.86 of principal and the balance is interest.

In the event you determined it would be advantageous to you, a prepayment of any
designated amount in an agreed upon time frame could also be made during the year
2000 to reduce the principal amount ultimately certified to the County for collection.
In the event the property is subdivided, the assessments would be split on a pro-rata
basis between the newly created parcels.

Per discussions with your office, there are approximately $150,000.00 worth of Special
Assessments including interest due on the above property. In addition, there is an approximate 2-
acre area of the above property which contains the homestead and out buildings. We have been
directed by the City Council to prepare a proposal for possible deferral of payment on some or all
of the assessments. Based on our discussions, the following is a possibility:
The applicant may apply for a rezoning (to R-1) and a comprehensive guide plan and subdivision
of approximately 2 acres of property containing the homestead, out buildings, and access to the
homestead property. The proposed plat of the homestead should be designed such that it could be
subdivided in the future if need be. The applicant should pay all normal fees and costs associated
with the subdivision and pay the appropriate trunk area assessments, street assessments, and
lateral costs with respect to the homestead subdivision.
The residual approximately 8 acres of land would remain zoned R-4. Upon execution of an
agreement with the property owner, the remaining 8 undeveloped acres of R-4 land would be
subject to an appropriate spread of assessments, the payment for which would be deferred, with
or without interest upon such terms and conditions as the Council and the property owner may
agree.
This proposal would have the effect of retaining the 8 acres of land in an undeveloped state as R-
4 property for future development. The bulk of the cost for such development would be paid at
such time as the R-4 property was sold, platted, or otherwise developed. The remaining
homestead would pay all development costs for a single-family piece of property and would be
eligible for development and future subdivision as was necessary or desirable in the future.
Minnesota Statutes allow the payments from the assessment of undeveloped property to be
deferred by agreement of the parties recorded against the property.

I am writing this letter as follow up to our telephone conversation of April 6th during
which you asked for some information regarding the special assessments levied on your
property. The attached Special Assessment Search Summary shows in chronological
order the assessments levied against your property. The year of the assessment, the
term of the assessment, the interest rate and the original principal amount of the
assessment are all shown. I believe your specific question was directed at the rates of
the assessments on your property as those rates related to the specific zoning
designation. The levies designated with numbers 100195, 100281 and 101007
incorporate a higher rate based on the multiple zoning classification. By higher rate I
mean a rate higher than single family would have been, if the property had been so
zoned. The other five levies were either at full cost or there is no difference in the rate
based on zoning.
I have also enclosed the information that was presented to the City Council at the
Special City Council meeting held on April 30, 1998 at which time the consensus was
reached that at that time they did not want to further consider a rezoning of the property.
The request as outlined in Mr. Biersdorf's letter of April 17, 1998 was presented to them
for consideration. The request was processed in that manner to meet the timeline
outlined in the letter. Any formal action would have been placed on a regular City
Council agenda for action.
As we discussed yesterday, if you would like to have this request or some modification
again considered by the City Council, please send a letter outlining your specific
request(s) to City Administrator Hedges for his consideration for placement on an
agenda.

Acres/Special Assessments
am providing this information in response to Councilmember Masin's request
that was forwarded to me this morning. The questions about this issue and the
request for assistance are not new and in fact started in early 1997 with a series
of telephone conversations between Mr. Swenson and myself. In late 1997 and
early 1998 1 also had conversations with Mr. Swenson's attorney.
The property in question is located at Highway 13 and Four Oaks Road. It is
zoned R-4 and comp guided D-IV.
The problem for Mr. Swenson began when his property was no longer eligible for
green acres status as determined by Dakota County. The County notified him in
early 1997. The Assessor's Office made a determination that given the State
law and recent court cases, the property simply could not continue to benefit
from green acres status. Mr. Swenson wrote a letter to then Mayor Egan
explaining his situation and asking for relief from the City. Although Mr.
Swenson chose not to challenge that County determination, he expressed
concern to the City that the property had enjoyed the benefits of green acres
status for around 30 years and should not be required to pay due to the State
and/or the County making a new determination. Staff responded in a letter
dated March 19, 1997 again clarifying the responsible parties to the action. It
was also clarified that green acres status on a piece of property has the effect of
reducing ad valorem taxes, it does not reduce or eliminate any special
assessment obligation. The law provides for deferment with interest of the
special assessments not for forgiveness.
As a follow-up to the letters, in April of 1997 Administration, Finance and
Planning staff met with Mr. and Mrs. Swenson to go over the green acres
situation and to discuss other options including development of the property.
During that meeting it was mentioned that the City Council might entertain an
offer to down zone the property to a less dense classification in exchange for a
reduction in either the special assessment interest and/or principal. It was
clearly pointed out that the assessments were deferments and if the Swensons,
as the benefiting property owners did not pay them, they would have to be
picked up by the community at large. While that could be considered by the City
Council, there was no past practice indicating that the request would be
honored.
In April of 1998 1 was again called by the attorney inquiring about the idea of
trading zoning for some of the financial obligation. I suggested that he send the
City a letter including some sort of offer that could be considered by the City
Council, if his client wanted to pursue the possibility. The City received that
letter dated April 17, 1998 on April 20, 1998.
In advance of the staff doing any additional work, the matter was informally
forwarded to the City Council for their consideration in the context of the City's
review of the Comprehensive Land Use Plan. The consensus of the Council at
that time was that the property is properly zoned and comp guided at this time
and a change to single family zoning at that location would not be appropriate.
A reassessment including both principal and interest was offered as a possible
method of dealing with the deferred assessments. That information was
communicated to Attorney Biersdorf and Mr. Swenson in May of 1998.
Although I don't think the issue of assessments came up, there has been a
recent contact with the planning department regarding the possibility of
remodeling and expanding the single family home on this property.
To my knowledge there has been no other communication with anyone at the
City concerning this property.
To help follow this issue and to provide additional information, I am attaching the

Enclosed is a copy of a letter received from Dakota County
indicating policy changes with regard to the green acres tax
classification. In reviewing the attachment, it indicates that in
order for the property to be classified as agricultural and qualify
for green acre taxes, it must be determined that the primary use of
the property is agricultural.
I purchased this property in 1981 from a family member who had
previously purchased it in 1953. At the time of my purchase, I
contacted the Dakota County Tax Assessor, and was informed that as
long as I have an agricultural income that meets the requirements
and the proper size, I would not have to worry about any green
acres changes. I took this information in good faith and purchased
and improved the property from what it was prior to my ownership.
For many years, I have been complvina with the rules and
regulations that I believed necessary to keep my agricultural /green
acre status, and apparently this has been accepted for as long as
I have owned the property and going back many years prior to my
ownership. Now the rules have changed. This most recent
determination I feel is unfair and absolutely devastating
financially to myself and my family. I would think a more
equitable settlement could possibly be to change the classification
at this time to a residential classification and pay taxes on that
assessment.

Dear Mr. Severson:
Thank you for your recent letter concerning your property tax situation. Mayor Egan has
asked that I respond to you. Unfortunately, the situation that is impacting your property
is not under the control of the City. The County Assessor is responsible for determining
property tax classifications within the law as set by the State of Minnesota. The Green
Acres statute is passed by the State and implemented by the County. As explained in the
information notice, tax court decisions can also impact implementation of this law.
From time to time, the City has asked the County to review the status of parcels to ensure
that they remain eligible. This has been done to ensure that other properties in the
community are not unfairly subsidizing the benefiting properties. The City is impacted
directly by the Green Acres status because special assessments are deferred and not
collected currently.
It is important to note that from the beginning, Green Acres status has reduced the ad
valorem tax obligation; it has not reduced or eliminated any special assessment
obligation. The law has provided for the deferment with interest of the special
assessments.
Again, I have not reviewed the ad valorem tax situation on your property. That is
something that needs to be taken up at the County. I have reviewed with our staff the
situation with the special assessments. As the print-out which you provided shows, there
is a principal balance of $51,097.17 and an interest balance of $89,652.01 due through
1996. The large interest balance simply reflects the fact that this property has enjoyed the
benefit of the Green Acres status for a long time and interest has accumulated over that
time period.

In the past, most properties have lost Green Acres status through development and the
assessments are paid as part of that process. The community at large has had the
obligation of picking up costs for installation of infrastructure improvements which
benefited the property while the assessments have been deferred. Perhaps with your
property, there has been some confusion; however, there has never been an understanding
that these obligations would disappear completely or could be postponed past eligibility.
I cannot tell from your letter exactly what action you would like the City to take;
however, we cannot make things the way they were before the notice was received.
Given the fact that this is not a possibility, we would be happy to meet with you to sort
out payment and/or development options.

The property which is referenced above is owned by Michael Swenson. During the past year.
this office has assisted Mr. Swenson in negotiations with Dakota County regarding the Greenacres
classification that was recently removed from this property. Based upon recent developments in this
area of the law, Mr. Swenson has decided to accept this determination by Dakota County.
From correspondence which I have seen between you and Mr. Swenson, 1 realize that you
are aware that the removal of the Greenacres classification has had a significant impact upon Mr.
S,.enson's property in that certain special assessments, which had been deferred, are now due
together with accumulated interest. In your letter dated March 31, 1997, you noted that at that time
the outstanding principal balance was approximately $51,000 and the accumulated interest XNas
approximately $90,000. We understand that the accumulated interest currently will be some amount
larger than that.
Mr. Swenson has instructed me to explore any avenues that might be open for reducing the
liability that he must pay for this special assessment bill. To that end 1 have had some discussions
with Gene Van Overbeke in your offices. During those discussions, the idea was raised about having
Mr. Swenson agree to a down zoning of his property in exchange for the city waiving a portion of
the outstanding special assessment bill. Mr. Van Overbeke told me that any such proposal would
need to be made in writing and presented to you for deliberation by the appropriate staff and members

of the city council. This letter is intended to be such a proposal.
Mr. Swenson's property is currently zoned for multifamily development, although it is
presently improved with only one single family residence. Under Mr. Swenson's proposal, he would
agree to have the zoning changed so that his entire parcel would only allow the development of single
family residences. In exchange for agreeing to have his property's zoning changed to this less
valuable classification, he would ask that the city v: give the accumulated interest that has accrued on
this special assessment bill.
It is my understanding that the only meeting of the city council prior to the May 15 tax
deadline is on May 5. It is our hope that this matter could be placed upon the city council's agenda
for that meeting. Please have the individual who will be reviewing this request contact me if

As you requested in your letter of April 17, 1998 to City Administrator Hedges, staff raised the
issue of a reduction in the amount due for special assessments previously deferred through green
acres on the above referenced property with the City Council. The issue of a downzoning was
timely in that the Council is currently reviewing the City's Comprehensive Land Use Plan per
State requirements.
The consensus of the Council is that the property is properly zoned and comp guided at this time
and a change to single family zoning at this location would not be appropriate. With that avenue
closed, they did state that they would be agreeable to a reassessment of the amount due over a
period of ten (10) years. Essentially, that means that the total principal and interest now due
would become the new principal and would be assessed by agreement for a ten (10) year period.
I realize that that still involves a substantial cash obligation each year. As we have discussed
previously, the only other option is development, which does not eliminate the obligation but
provides the necessary cash to pay the balance.
I am sorry that I do not have better news, however there are no easy answers to this problem.

Swenson.

This letter is in response to your inquiry about remodeling and expanding your existing
home. As we discussed, your property is zoned R-4, Multiple Residential and has been
for many years. The city's comprehensive guide plan also designates the future use of the
property as D-IV, Mixed Residential (12+ units per acre). You also have indicated that
you wish to retain the potential to develop the property for multiple residential use at
some time in the future. The existing use of the property for a single-family residence is
not consistent with the R-4 zoning of the property and consequently, the existing use is
nonconforming. We have discussed the options that are available to you to pursue
expansion of your home and this letter attempts to summarize the issues related to each of
the options.
First, I would like to highlight some of the provisions of the city's nonconforming uses
ordinance. A copy of the ordinance is attached for your reference. A nonconforming use
is defined as a "use of land, buildings or structures which does not comply with all the
regulations of the City Code governing the zoning district in which such use is located
adopted subsequent to the initiation of said use." Provision A of the nonconforming uses
ordinance states "It is the policy of the city that nonconforming structures and
nonconforming uses in time be eliminated due to obsolescence, exhaustion or destruction
so as to insure a uniform use of and within the districts established within this chapter."
Provisions B, C and D essentially provide that a nonconforming use or structure may be
maintained and repaired, but cannot be expanded or enlarged. Provision F states "No
provision hereunder shall preclude a request for a variance, as governed by this chapter,
for the erection or reconstruction of a nonconforming structure. This provision does not
apply to any nonconforming uses."
Because the existing single family dwelling is a nonconforming use, it cannot be
expanded. One option for you would be to request a rezoning to a zoning district in
which single family dwellings are a permitted use -- R-1 (Single Family), Estate or
Agricultural. In addition, the city is prevented from rezoning property in a manner that is
inconsistent with its comprehensive guide plan. Therefore, an amendment to the
comprehensive guide plan would be necessary prior to consideration of a rezoning to R-1

or Estate. The Agricultural zoning district might appear to offer a rezoning option that
would not necessarily require a comprehensive guide plan amendment since the
Agricultural zone serves as a holding zone until urban development can occur and is
therefore, considered consistent with all land use designations in the comprehensive plan.
As a matter of public policy, however, rezoning property to Agricultural to circumvent
the comprehensive guide plan is not supportable. In any case, by rezoning the property,
the multiple residential zoning is lost and there is no guarantee that it could be obtained
again in the future. The case for rezoning is made more difficult to support because you,
the property owner, believe that the ultimate use of this property should be multiple
residential. Therefore, it would be contradictory for you to argue in support of rezoning
to a single-family district. Consequently, it is unlikely that a rezoning would be
approved.
We also discussed the possibility of an exception or variance from the city's
nonconforming uses ordinance that would allow the expansion of your home. As quoted
above, Provision F of the nonconforming uses ordinance does not allow the city to
consider a variance request where the request pertains to a nonconforming use. The
policy reasoning behind the ordinance is that the city does not want to encourage
continued improvement of and investment in a use that is anticipated to be phased out.
Therefore, if the City Council were to consider such a variance request, it would be
acting contrary to the city ordinance. The next question you might ask is whether the
ordinance can be changed to allow the council to consider such requests. The Council
could consider a request to amend the ordinance that would make a variance for
expansion of a nonconforming use an option. However, adoption of such a change to the
ordinance would have implications city-wide, resulting in a situation where any owner of
a nonconforming use could request a variance to expand. Again, this is contrary to the
stated policy and principles of nonconforming uses. For these reasons, adoption of such
an ordinance amendment is unlikely.

Dear Mr. Larson:
We are writing to request the support of the Dakota County Historical Society in preserving the
designation of use for our 10 acre farm. The address is 1650 Four Oaks Road, which is the corner
of Highway 13 and Four Oaks Road in Eagan. We have attached a map which locates our property.
Our farm was built in approximately 1885. The foundation was built with slate which was brought
up from the Minnesota River. The original brick has been covered with siding, but remains intact
underneath. We have a large barn which has a fieldstone foundation. The bam is constructed with
a tongue and groove interlocking system using wooden pegs.
At the current time, the City of Eagan is developing a comprehensive guide plan which designates
the future use ofthe property as R-4/HD, High Density Residential (attached housing units including
townhomes, condominiums, and apartments with densities greater than 8 units/acre). This is
consistent with the current zoning, but not the current use of the land. We would like to down zone
our property to R-l/LD, Low Density Residential. This would allow for the property to remain a
farm with no further development.
We would like to request your support in the form of a letter to provide to the Eagan City Council
regarding the above issue. Sandra Masin, our City Council Member, has indicated that the council
will be meeting about the Comprehensive Guide plan on May 6, 1999. It is our hope that we will
have a response from you prior to that date.

and requirements governing use, lot and size of building and premises are uniform.

Sec. 11.10. General provisions.
Subd. 1. Application.
A. In their interpretation and application, the provisions of this chapter shall be held to
be the minimum requirements for the promotion of the public health, safety, morals
and general welfare.
B. Where the conditions imposed by any provisions of this chapter are either more
restrictive or less restrictive than comparable conditions imposed by any other law,
City Code provision, statute, resolution or regulation of any kind, the regulations
which are more restrictive or which impose higher standards or requirements shall
prevail.
C. Except as in this chapter specifically provided, no structure shall be erected, converted,
enlarged, reconstructed or altered and no structure or land shall be used for any
purpose nor in any manner which is not in conformity with this chapter.

Subd. 2. Separability. It is hereby declared to be the intention of the council that the several
provisions of this chapter are separable in accordance with the following:
A. If any court of competent jurisdiction shall adjudge any provisions of this chapter to be
invalid, such judgment shall not affect any other provisions of this chapter not
specifically included in said judgment.
B. If any court of competent jurisdiction shall adjudge invalid the application of any
provision of this chapter to a particular property, building or structure, such judgment
shall not affect the application of said provision to any other property, building or
structure not specifically included in said judgment.
Subd. 3. Nonconforming structures and uses.
A. Policy. It is the policy of the city that nonconforming structures and nonconforming
uses in time be eliminated due to obsolescence, exhaustion or destruction so as to
insure a uniform use of and within the districts established within this chapter.

LAND USE REGULATIONS (ZONING) § 11.10
B. Expansion of use. The expansion of an existing nonconforming use shall not be
permitted, and no land shall be used by any person or in any manner which is not in
conformity with this chapter.
C. Alteration or enlargement of structure. Except as provided herein, no nonconforming
structure shall be erected, converted, enlarged, reconstructed, altered, or changed in
any manner which is not in conformity with this chapter. No structure shall be
erected, converted, enlarged, reconstructed, altered, or changed in any matter upon
any land upon which a nonconforming use is conducted.
D. Maintenance and repair. Routine maintenance and repair may be made to a
nonconforming structure or any structure upon land upon which a nonconforming use
is conducted, provided the market value of the structure does not increase as a result
of such maintenance and repair.
E. Abandonment. Any nonconforming structure or nonconforming use shall be deemed
abandoned and thereafter shall be discontinued, when any nonconforming structure
is not used or any nonconforming use is discontinued for a period greater than six
months for any reason.
F. Variances. No provision hereunder shall preclude a request for a variance, as
governed by this chapter, for the erection or reconstruction of a nonconforming
structure. This provision does not apply to any nonconforming uses.
G. Scope of application. The provisions of this subdivision shall apply to all existing
nonconforming uses or structures under the provisions of the Code in effect prior to
the effective date of Ordinance No. 189, which amended this subdivision to read as
provided herein.
Subd. 4. Lot provisions. A duly created lot of record shall be deemed a buildable lot,
provided all of the following are met:
A. The lot shall have a minimum of 60 feet of frontage on a public street or the lot shall
have been approved in platting a condominium project or an attached dwelling project
wherein a contiguous lot, owned in common, provides said frontage.
B. There shall be no more than one principal building on one lot except when approved
as a part of a planned development.
C. The lot shall be capable of supporting a building(s).
D. The lot shall be of sufficient size to accommodate a building(s) within the minimum
required building setbacks for the particular zoning district in which it is located.
Subd. 5. Accessory buildings and structures.
A. Accessory buildings and structures related to a farming operation and on a farm may
be located anywhere on the lot, except that a building for housing more than two
animal units shall be not less than 50 feet from lot line and all buildings shall conform
} to yard regulations.

I talked to Mike Dougherty about this. Once I started explaining, he remembered the
Swenson's. He said the nonconforming uses ordinance does not allow the Council to
entertain a variance request for expansion of a nonconforming use. So Swenson's do
not have the option of applying for a variance to do the addition to their home. They can
submit a letter explaining their situation to the Council, or be heard under the "visitors to
be heard" agenda. The Council would need to amend the nonconforming uses ordinance
to remove the provision prohibiting variances for nonconforming uses in order to consider
such a request from the Swenson's.
The reasoning is that, if decided on a case by case basis, expansion or establishment of
nonconforming uses is arbitrary. Granting a variance for expansion or establishment of a
nonconforming use is contrary to the idea and purpose of nonconforming uses which is to
phase out such uses over time. Swenson's can go to the Council with their plight, but if
the Council wants to allow them to bring a variance application, they will need to change
the ordinance, which then would allow anyone in the city to bring a similar variance
request and we don't really want to do that.
If the City and property owner agree that the property should be R-4, continued use as R-
1 can't be justified.

Dear Mr. Swenson,
It is the City of Eagan's intention to construct a dry pond for the purpose of
occasionally holding storm water within a permanent drainage and utility
easement on your property. Your property is zoned R-4-Residential Multiple.
We understand that at some point in the future your property may be developed
with apartment type buildings.
Because the pond constructed under Project 858 is located at the lowest point of
your property, we fully expect this area will be available to receive storm water
runoff from any future development of your property as well. Please be advised
that depending on the type of development and its density, the pond may not be
large enough to accommodate the additional runoff from your property. If that
situation arises, the City will be agreeable to allow the pond to be enlarged in
order to handle the additional required capacity of your developed property.
