The following information is listed in tlte same order as your questions: 1. Eagan requires storm sewer to be installed in accordance with its Master P1an whenever therc is development. If new T.H. 36 were not being built, portions of the storm sewer would be constructed with each development in the area. 2. Cost estimates of the storm sewer system were initially prepared by the Minnesota Highway Dept. Their estimates were checked by our staff and, after a determination was made as to which parts were to be constructed by the Highway Dept. and which were to be constructed by Eagan, the revised cost estimates were used in our preliminary report dated December 15, 1976. Preliminary Report preparation is normally charged on an hourly rate 1>asis for the amount of time spent prepar.ing the report. No invoice has been submitted as the preliminary work is sti11 being carried out. There is no supervisory architect on this project. That portion to be con- structed under the direction of the Ptinnesota Department of Transportation will be handled by engi.neers irom NIDOT. That portion to be constructed by Eagan will be designed and the construction contract administration handled by engineers from our firm. 3. Interstate Highway 35E Interchange with Cedar Avenue is in the preliminary design stage. An allowance for drainage of this area has been made in the Master Plan. Details cannot be worked out until more information is received from rIDOT. 4. A special benefit assessment is k proposed. The standard rates for Trunk Storm Sewer Oversize are adopted annually by the Eagan Council based upon the Storm Sewer Master Plan. Rates vary between Single Family Residential, Mu1ti- family Residential and Commercial and Industrial. Benefited property includes all land within the drainage area that con- tributes runoff to the storm sewer system. 8. The well has a pump stuck in it, the top of the drop pipe is at about 50 fee. A licensed well contractor was unable to remove the pump without the use of a drill rig or larges equipment due to limited access. If at any time the well becomes accessible through house reconstruction, remodeling, demolition or if new technology becomes availabe the well must be cleared of the obstruction and permanently sealed. The well casing must extend above the basement floor and have a watertight vermin proof cap installed. This permit must be renewed annually with no permit fee. Some of these depressions are indicated as pondinq areas in Eagan's, Apple Valley's and Burnsville's overall drainage plans. We will attempt to secure positive outlets to these,ponds where possible." Page 6 The Mn DOT noise Analysis Report on T.H. 36 says: "The corridor through Eagan is bordered by mostly un_ developed land which presents a potential noise pro- blem. Design barriers will account for the existing residential areas, but projection of anticipated development is impossible. The jurisdiction of land zoning will be the only control of these adjoining areas, and this lies with local officials. The areas that lie adjacent to future T.H. 36 are presently open and are being purchased for sparse residential sites. Development of this nature is not compatible a??i ??,blA?? and will cause noise sensitive areas after all road- way is constructed. The solution is to zone areas within the contours as other than residential. Commercial, industrial or some open space type of zoning would be -zo a ? ? Project 198 assessment for oversize Storm Sewer all commercial/ industrial. I heard on April Sth was .025. It became .35/sq. ft. when I asked Tom. An error in the minutes. How could that happen? Then there are some other neat charges per front foot, per acre, etc. Kind of confusing. Page 13 What are the real "current.city rates?" They seem to vary for the same type projects - perhaps on area served, perhaps something else. We need some better definition. A different firm to supervise those projects after authoriza- , tion by the Council. An alternative would be to prohibit the City Engineer from being involved in any job recommended by his office. Do not misunderstand me. My remarks are not intended to be critical of Bob Rosene or any member of Bonestroo,'Rosene Anderlick and Associates, Inc. I've found Bob to be a patient, polite and responsible professional. I have nothing but respect for Bob Rosene the personor 'Fl.k PrJeSSmnaI .Q?V vk&Qr. So says the state board of Engineers. Police cars need bids - but not city engineers. How do you explain that? Without competition can anyone be sure that Eagan is getting the most economical (cheapest) solution? Gentlemen: You've said economics is "important" to you. Are you getting the cheapest deal on civil engineerinq - or is cheaper not always better? The reason I meaikn this is because cost seemed a major consideration on your storm sewer vote. Ertekson At the Council meeting of Tuesday, April 19, 1977, Mr. David Lindo made a pres- entation relative to the above. We have reviewed this presentation and have the following coimnents relative to the items mentioned by him. They are answered in the order presented. 1, Mr. Lindo does not have the only copy of the 1972 Storm Sewer Study. Other copies are on file and each Council member has had this report available to him. Because the report was published in 1972, all extra copes have been given to various organizations and individuals. Mr. Lindo had been given the use of the only extra copy which your Clerk, Mrs. Bolke, had available. 2. The costs quoted on the April 5, 1977 letter prepared by Mr. Lindo are unfortunately very mixed up. The 1972 Storm Sewer Report states that the average per acre assessment will be $877.00. Since that time, inflation has increased this figure to approximate- ly $1,140.00 per acre. 3. Mr. Lindo uses $845,000 for Eagan's share of this storm sewer system. The $845,000 figure supplied by the Minnesota Highway Department gives credit to Eagan in the amount of $273,000 for buying and excavating pond areas. This is based on what the cost would be if the Highway Department were acquiring these ponds. Because we do not anticipate that Eagan will have to pay for these natural ponds, our figure of $572,000 for Eagan's share as used in our report is consider- ed to be correct. 4. From the 1972 Storm Sewer Report, the total drainage area of Eagan is estimated to be 21,905 acres. The total assessable area in Eagan is estimated to be 14,893 acres. The difference between these two figures is Park land and State Highway right-of-way. The total assessable area for this storm sewer proj- ect is 530 acres and not 360 acres quoted by Mr. Lindo. For his figures, he has in effect deducted the highway right-of-way twice by using 68% of the 530 acres to obtain the 360 acre figure. The following information is listed in the same order as your questions: 1. Eagan requires storm sewer to be installed in accordance with its Master Plan whenever there is development. If new T.H. 36 coere not being built, portions of the storm sewer would be constructed with each development in the area. 2. Cost estimates of the storm sewer system were initiaZly prepared by the Minnesota Highway Dept. Their estimates were checked by our staff and, after a determination was made as to which parts were to be constructed by the Highway Dept, and which were to be constructed by Eagan, the revised cost estimates were used in our preliminary report dated December 15, 1976. .Preliminary Report preparation is normally charged on an hourly rate basis for the amount of time spent preparing the report. No invoice has been submitted as the preliminary work is still being carried out. There is no supervisor-y.arthitect on this project. That portion to be con- structed under the direction of the Minnesota Department of Transportation will be handled by engineers from NIDOT. That portion to be constructed by Eagan will be designed and the construction contract administration handled by engineers from our firm. 3. Interstate Highway 35E Interchange with Cedar Avenue is in the preliminary design stage. An allocvance for drainage of this area has heen made in the Master Plan. Details cannot be worked out until more information is received from MDOT. 4. A special benefit assessment is kproposed. The standard rates for Trunk Storm Sewer Oversize are adopted annually by the Eagan Council based upon the Storm Sewer Master Plan, Rates vary between Single Family Residential, Mu1ti- family Residential and Commercial and Industrial. The Czty of Eagan agrees with the necessity to construct this improvement and nrges that all possible effort be expended eo expedite its completion. Traffic Control and Accidents: Yart B of Section 1 sliows the marked increase in traffic accidents on present Cedar Avenue from 1969 through 1972. Data corupiled by the Eagan Public Safety Department shows an increase o£ ayproximately 30% more personal injury and 10% more property damage accidents in 1973 over 1172 on Cedar Avenue. llata has not yet been tabulated f.or 1974 but it will show significantly greater increases. 2. Life of the Yresent T3ridge: Tkie life of the present bridge is projected at 10 years. The closing of this bridge prior to the opening o£ the new Cedar Avenue bxidge would be disas- trous tu present and proposed development in Eagan. It would force the traffic to use other routes aud the already overloaded I35W and Mendota bridges. Secause the najor populaCion centers of Eagan are located in the western portion near Cedar Avenue, t}ie resulking delays and the disruption of traffic in other areas would be totally unacceptable. 3. Project Alternates: Alternate C as proposed by the HiPhway Department has been included in the Master Plan of Eagan since the early 1960`s. If the subject is a re-forestation program, one to help Eagan residents try to fix a real problem (dutch elm and oak wiit) the Eagan City Council isn't interested. They don't care if the state had a dollar matching program. In other words the state would pay 50% of the program. Other neighboring communities such as Burnsville partici- pated in this program. But not Eagan. On the other hand, if the subject is Storm Sewers for a maybe, it might happen, storm of the century, this same Council is instantly hooked. It says, "spend the money." Why if we really hurry we'll save money. We'll get the State to partially pay (30%) for a Eagan project we miqht need some day. The State says it needs it NOW. Hows this for a hurry. A document dated 15 December 1976, "Preliminary Report on Cedar Avenue Drainage Improvement Project 186 Eagan, Minnesota" was issued by the "City Engineer." No need to wait for a"Fir.al" report. "Lets hurry," says the Council. - A not.ice dated 4 Jar.uary 1977 was sent to Eagan taxpayers anr.ouncing that the City Council would have Project 186 as an aqenda item for a 1 February 1977 meeting. Is that enough time to fact-find the general "Preliminary Report?" On 1 February 1977, after a 30 minute presentation, B-2-N-G-0. A winner! Makes one wonder doesn't it? Pretty fast action. However, I consider those recommen- dations still open. Also some data being released to the public inconsistant. Please advise if you require anything further from me on them. If need be I'l1 entertain a nomination to the Assessment and/or Capital Improvement Committee. My notes for 5/26 show: 1) Currently undeveloped land, zoned commercial is assessed commercial. If zoned as any other, then later developed as commercial a special "connection" charge is used to adjust the earlier assessment. It is paid into the "Trunk fund" because projects seldom come out as estimated. Therefore, previously assessed parcels do not get ch&ges or credits for these inaccuracies or later adjustments. 2) The "zoning map of City of Eagan" you provided is not drawn to perfect scale.
