1 Carol Lindo, Rings Road".-;Mrs. Lindo was present and requested that she be
permitte o 0o up o ity?er only claiming financial hardship if she is required
to hook up to the sanitary sewer because of the distance from the City sewer system to
her home access location. Noting it was customary that the City require hookup to
both according to City policy, the staff indicated that administratively the issue
could be handled for future assessment purposes. Blomquist moved, Wachter seconded
the motion to allow the policy variance to Mrs'. Lindo on the basis of hardship due to
cost and further understood that the staff will review the policy and report its
findings to the Council. All members voted in favor.

I am in receipt of a letter fram ZWin City Federal to your attention dated Januasy
11, 1982 wherein they outlined several items that must he answered before they will
process your request. Although I am not aware of the specific conditions of your
request to TCF, I assimie that it pertains to the selling of any one of Ir.ats 9, 10
and 11, Block 2, Vienna Woods. In relating to the items requested by Twin City Fed-
eral, items no. 1, 2 and 3 of their January llth letter must be provided by you.
The City can make availatile a oopy of the plat that was remrded at Dakota County
shawing the dimensions, oonfiguration and location of any o£ the lots under your
current ownership. Hawever, a registered survey would have to be perfonred by you
verifying that the land in question as it presently exists confoxms to tke Vienna
Woocls plat of record. You might check with r7arvin Bunp tn see if a certificate of
survey has been performed for these lots in question. At this time, the City does
not have this registered certificate of survey for your lots. Haaever, when a
building nP„n;t is requested, a registered certificate of survey will be required
as a condition of issuance of the building uPrm; t.

following information which we will need to consider your request.
1. A written requcst from you indicating the purpose for which the
land will be used.
2. A Registered Survey and written description that shows: ,
a. the land presently mortgaged by Twin City Federal,
b. the land to be released,
c, easements as they nay affect our retained security,
d, the location of buildings, including their dimensions

f. the legal description as to "a" and "b" above.
3. A copy of the executed Purchase Agreement i.f the released land
is to be sold.
4. Evidence from your city or local government as to'approval of the
new lpt size to be certaiq of its future acceptability as to size
and intended use.
To issue a partial release TCF wi1l request a repaymer.t of pazt of *_Fe exietir.g
loan balance. The payment to the loan must either be the net proceeds from the
portion that is sold or the appraisal value if the appraisal is higher. If there
is no sale, the TCF current appraisal will be the amount that must be credited to
the mortgage. ,
We will inspect the remaining property and the portion to be released upon receipt
of $75 and our determination that your loan payments and rea1, estate taxes are not
delinquen[. There is an additional charge of $50 payable upon our execution of
the partial release document.

11 This addendum to the agreement dated /6

between B& K Proper[ies Co., a partnership and the City of Eagan;
WHERLAS, the parties entered into a Development Contract dated
1979, covering Vienna Woods, cicy of Eagan, Dakota
County, Minnesota; and
WkIEREAS, the parties desire to amend said Development Contract relating
to assessment against the land within Vienna Woods; ?
NOW THBREI'ORE, the parties agree as follows:
1. All lots on the North side of Kings Road in Vienna Woods including
Lots 26 through 32, Block 2, and the land owcted by Richard Kreitz will be
assessed on a front foot basis for street improvemento for that por[ion of
the North side of Kings Road including curU and gutter at n residential
equivalent rate ancl i.n addition, sanitary sewer, water and storm sewer laterals.
The normal Clty policy will apply for storm sewer and water trunk assessments
on said lots.
2. All other lots in the suUdivision will be assessed on an equal per
lot basis for improvemente installeci by the City of Cagan except tha[ Lots 9,
10, and 11, Block 2 will not be assessed for strect improvements and such street
improvements will be assessed against ull lots currently owned by B 6 K Properties
Company.
3. Lots 9, 10, and 11, and Lots 26 through 32, Black 2, and the land owned
by Richard Kreitz will each be assessed 1/106th of the street improvementa for
that portion of the South one-half of Kings Road from the West line of Vienna
Woods to the East line of the Kreitz property.

Your letter of March 10, 1977 requested information on the above project and
has been discussed with the City Council. The following information is listed
in tlte same order as your questions:
1. Eagan requires storm sewer to be installed in accordance with its Master
P1an whenever therc is development. If new T.H. 36 were not being built,
portions of the storm sewer would be constructed with each development in the
area.
2. Cost estimates of the storm sewer system were initially prepared by the
Minnesota Highway Dept. Their estimates were checked by our staff and, after
a determination was made as to which parts were to be constructed by the Highway
Dept. and which were to be constructed by Eagan, the revised cost estimates
were used in our preliminary report dated December 15, 1976. Preliminary Report
preparation is normally charged on an hourly rate 1>asis for the amount of time
spent prepar.ing the report. No invoice has been submitted as the preliminary
work is sti11 being carried out.
There is no supervisory architect on this project. That portion to be con-
structed under the direction of the Ptinnesota Department of Transportation will
be handled by engi.neers irom NIDOT. That portion to be constructed by Eagan will
be designed and the construction contract administration handled by engineers
from our firm.
3. Interstate Highway 35E Interchange with Cedar Avenue is in the preliminary
design stage. An allowance for drainage of this area has been made in the
Master Plan. Details cannot be worked out until more information is received
from rIDOT.
4. A special benefit assessment is k proposed. The standard rates for Trunk
Storm Sewer Oversize are adopted annually by the Eagan Council based upon the
Storm Sewer Master Plan. Rates vary between Single Family Residential, Mu1ti-
family Residential and Commercial and Industrial. Weighting factors include

density of development and average runoff from various uses. Future needs are
forecast using the current zoniug and Land Use GuidePlan.
5. Yes, an equalization factor has been included based upon proposed land
uses.
6. A11 of the Highway Right-of-way will be tax exempt. Soint construction
wi11 insure that MDOT pays its fair share for storm drainage of this land. No
other tax exempt land is known.
7. Benefited property includes all land within the drainage area that con-
tributes runoff to the storm sewer system.
8. Right-of-way of the MDOT in this project is estimated at approximately
300 acres.

has submitted a permit application, has paid the sum of $111.00
dollars to the County of Dakota as required by Ordinance Number 114 and
has complied with all of the requirements of said Ordinance necessary
for obtaining this permit to temporarily cap the well described herein:
An abandoned well with a casing diameter of 4 inches and unknown depth.
The well has a pump stuck in it, the top of the drop pipe is at about 50
fee. A licensed well contractor was unable to remove the pump without
the use of a drill rig or larges equipment due to limited access. If at
any time the well becomes accessible through house reconstruction,
remodeling, demolition or if new technology becomes availabe the well
must be cleared of the obstruction and permanently sealed. The well
casing must extend above the basement floor and have a watertight vermin
proof cap installed. This permit must be renewed annually with no permit
fee.
THE WELL IS LOCATED IN THE MUNICIPALITY OF EAGAN AS FOLLOWS:

sible for $8,104.20 of your overall total street assessments which will reduce your

a result of the facts obtained I strongly recommend that
each member of the Eagan City Council reconsider his
earlier vote. At this date four actions are required. I'll
discuss each in turn.
Before proceeding further I'd like to comment on how much

works.. On some subjects you really dig in and ask challenging
questions. 2 was impressed by the discussion on garden '
plots, getting competitive bids on police cars and use of

I'm afraid you've come to take the need for Storm Sewer
projects for granted. Further I'm concerned that you
don't fully understand all the complex interrelated issues
involved in joint state-city multi-highway storm sewer
projects. Perhaps no one?not even a trained experienced

Thus, it appears to me that you are totally
on the recommendations of Mr. Rosene. With this tremendous
reliance on one source, expert though it may be, the usual formal checks and balances system found in go,vernment can
easily and imperceptably be eroded away. If that happens

recommendations may help prevent this problem from
developing in Eagan.

First, the February Council vote on project 186 must be re-
versed. You voted without full facts: You should not
approve a joint Eagan - State project. The need for an
Eagan sewer has not been demonstrated.

Second, the Council should appoint an independent Capital
Improvements evaluation committee.
Third, the Council should establish an independent and
separate Property Assessment Board.
Fourth, the Council should split its contracts for Civil
Engineering: one firm for studies and recommendations; a
second for approved project supervision.

1. No need for a massive storm sewer exists. The

"2-35E will be a rural-design freeway. As such,

use of depressions adjacent to the roadway for ponding
areas is anticipated. Some of these depressions are
indicated as pondinq areas in Eagan's, Apple Valley's
and Burnsville's overall drainage plans. We will attempt
to secure positive outlets to these,ponds where possible."

The Mn DOT noise Analysis Report on T.H. 36 says:
"The corridor through Eagan is bordered by mostly un_
developed land which presents a potential noise pro-
blem. Design barriers will account for the existing
residential areas, but projection of anticipated
development is impossible. The jurisdiction of land
zoning will be the only control of these adjoining
areas, and this lies with local officials. The areas
that lie adjacent to future T.H. 36 are presently
open and are being purchased for sparse residential
sites. Development of this nature is not compatible

and will cause noise sensitive areas after all road-
way is constructed. The solution is to zone areas
within the contours as other than residential. Commercial,
industrial or some open space type of zoning would be

What are the real "current.city rates?" They seem to vary
for the same type projects - perhaps on area served, perhaps
something else. We need some better definition. Thus
this independent Board would be charged to develop consistant,
across the board, Eagan-wide rates insuring equity for developers,

homeowners,,businessmen and the long time residents currently
trapped on large tracts of land with unbelievable confiscatory
assessments.
Recommendation 4- Split Cieil Engineering contracts; one firm
to do studies, preliminary design and make recommendations.
A different firm to supervise those projects after authoriza- ,
tion by the Council.
An alternative would be to prohibit the City Engineer from
being involved in any job recommended by his office.
Do not misunderstand me. My remarks are not intended to be
critical of Bob Rosene or any member of Bonestroo,'Rosene
Anderlick and Associates, Inc. I've found Bob to be a patient,
polite and responsible professional. I have nothing but
respect for Bob Rosene the personor 'Fl.k PrJeSSmnaI .Q?V vk&Qr.
However, his firm has a virtual monopoly in Eagan. Why?

"Architects and engineers traditionally have not bid
on design projects. Although the Board rules of Pro-
fessional Conduct d ?address the issue of competitive
bidding, architects and engineers have not participated
in competitive bidding."
So says the state board of Engineers. Police cars need bids -
but not city engineers. How do you explain that?
Without competition can anyone be sure that Eagan is getting
the most economical (cheapest) solution? Gentlemen: You've
said economics is "important" to you. Are you getting the
cheapest deal on civil engineerinq - or is cheaper not
always better?
The reason I meaikn this is because cost seemed a major
consideration on your storm sewer vote.
In conclusion, then I call upon vou, the Eagan Council to
individually and separately vote upon each of these re-
commendations:

At the Council meeting of Tuesday, April 19, 1977, Mr. David Lindo made a pres-
entation relative to the above. We have reviewed this presentation and have
the following coimnents relative to the items mentioned by him. They are answered
in the order presented.
1, Mr. Lindo does not have the only copy of the 1972 Storm Sewer Study.
Other copies are on file and each Council member has had this report available
to him. Because the report was published in 1972, all extra copes have been
given to various organizations and individuals. Mr. Lindo had been given the
use of the only extra copy which your Clerk, Mrs. Bolke, had available.
2. The costs quoted on the April 5, 1977 letter prepared by Mr. Lindo are
unfortunately very mixed up.
The 1972 Storm Sewer Report states that the average per acre assessment will
be $877.00. Since that time, inflation has increased this figure to approximate-
ly $1,140.00 per acre.
3. Mr. Lindo uses $845,000 for Eagan's share of this storm sewer system.
The $845,000 figure supplied by the Minnesota Highway Department gives credit to
Eagan in the amount of $273,000 for buying and excavating pond areas. This is
based on what the cost would be if the Highway Department were acquiring these
ponds. Because we do not anticipate that Eagan will have to pay for these natural
ponds, our figure of $572,000 for Eagan's share as used in our report is consider-
ed to be correct.
4. From the 1972 Storm Sewer Report, the total drainage area of Eagan is
estimated to be 21,905 acres. The total assessable area in Eagan is estimated
to be 14,893 acres. The difference between these two figures is Park land and
State Highway right-of-way. The total assessable area for this storm sewer proj-
ect is 530 acres and not 360 acres quoted by Mr. Lindo. For his figures, he has
in effect deducted the highway right-of-way twice by using 68% of the 530 acres
to obtain the 360 acre figure.

Your letter of March 10, 1977 requested information on the above project and
has been discussed with tlie City Council. The following information is listed
in the same order as your questions:
1. Eagan requires storm sewer to be installed in accordance with its Master
Plan whenever there is development. If new T.H. 36 coere not being built,
portions of the storm sewer would be constructed with each development in the
area.
2. Cost estimates of the storm sewer system were initiaZly prepared by the
Minnesota Highway Dept. Their estimates were checked by our staff and, after
a determination was made as to which parts were to be constructed by the Highway
Dept, and which were to be constructed by Eagan, the revised cost estimates
were used in our preliminary report dated December 15, 1976. .Preliminary Report
preparation is normally charged on an hourly rate basis for the amount of time
spent preparing the report. No invoice has been submitted as the preliminary
work is still being carried out.
There is no supervisor-y.arthitect on this project. That portion to be con-
structed under the direction of the Minnesota Department of Transportation will
be handled by engineers from NIDOT. That portion to be constructed by Eagan will
be designed and the construction contract administration handled by engineers
from our firm.
3. Interstate Highway 35E Interchange with Cedar Avenue is in the preliminary
design stage. An allocvance for drainage of this area has heen made in the
Master Plan. Details cannot be worked out until more information is received

7runk liighway 36 (Cedar Avenue) in Dakotu and Ilennepin Counties has been re-
vtewed as it relaCes to the City of Eagaii.
The City Council joins me in commendinl-, your staff for Clie preparation of an
ezcellent detailed impacc statement. All of the major impacts are we11 docu-
mented and sufficient detail is provided for a complete understanding of the
minor items of impact.
The Czty of Eagan agrees with the necessity to construct this improvement and
nrges that all possible effort be expended eo expedite its completion.
Of particular importance to our City are the followino. pointse
1. Traffic Control and Accidents:
Yart B of Section 1 sliows the marked increase in traffic accidents on
present Cedar Avenue from 1969 through 1972. Data corupiled by the Eagan Public
Safety Department shows an increase o£ ayproximately 30% more personal injury
and 10% more property damage accidents in 1973 over 1172 on Cedar Avenue.
llata has not yet been tabulated f.or 1974 but it will show significantly greater
increases.
2. Life of the Yresent T3ridge:
Tkie life of the present bridge is projected at 10 years. The closing of
this bridge prior to the opening o£ the new Cedar Avenue bxidge would be disas-
trous tu present and proposed development in Eagan. It would force the
traffic to use other routes aud the already overloaded I35W and Mendota bridges.
Secause the najor populaCion centers of Eagan are located in the western
portion near Cedar Avenue, t}ie resulking delays and the disruption of traffic
in other areas would be totally unacceptable.
3. Project Alternates:
Alternate C as proposed by the HiPhway Department has been included in
the Master Plan of Eagan since the early 1960`s. All of the land use planning,
major street system and utility system ilaster Plans have provided £oc this
corridor.
No other alternate is considereu feasible or acceptable.

Trail Systems have Ueen coordinated cJith the planning for the proposed recre-
ational trail and expaiision of the Fort Snelling Yark System.

sewer an1 of major streets liave all required the sale of ISunicipal lionds. All
of the payment schedules and ,^,rowth projeccions are gcared to an orderly con-
tinued P,rowth. If an adequate highcaay transportation networ:c is not provided,
ttie resuZting loss of developmznt can place a severe economic Uurden on the
present residents of this cocnnunity.
The present transportation dclays aze now placing an unfair burden on
the area residents by causing approxinately a 30 minute delay morning and
night during the rush hours. The loss of man hours and extra motor vehicle
fuel expended annually are staggerir.g and must he stopped.
6. Drainage Control:
The staff of the City of Eagan has coorked closely with ttie Highway De-
partment to integrate the highcaay drainage needs into tiie City I4aster Plan
for Storm i4ater Draina-ga. Continued caoperation will be extended throughout
the final design and construcCion phases to provide joine projects where
necessary Co accomplish the desired drainage contrel.
In summary, the City of Eaonn has planned for and has depended upon L'he con-
stniction of the proposed lrunk ]Iighway 36 to be a viCal link in the essential
highway transporta[ion network of tiiis area. Fie recownend that all possible
steps be taken to complete this higtiway as rapidly as possible.

As City Engineers for Eagaa, we have reviewed the "Draf-t Environmental Impact
Statement" on the construction of new 'i'runk Iiigliway 36 in Dakota and Hennepin
County as it pertains to the Citc of liayan. This report is very well prepared
and adequately covers tiie preliminary desion and environmental impact of this
project.
All tiagan iand use plauning, •r.oning, utility plans and storm water drainage
studies have anticipal'ed tne eventual construction of this freeway in the pro-
posed AlternaCe C locatiou. IL is stroi.igly recommended Chat Alternate C Ue
approved and construction ordered immediately.
No major coiiflicts witli existing development are anticipated. The following
points of interest are mentioned to illustrate the need for local community
staff participation in the final design phases of this project.
1. The existing rietcalf Junior High and the River Hills 9th Addition
single family residential area each occupy 40 acre tracts on the west side
of the proposed freeway just south of Co. Rd. 30. Consideration should be
given to berming for noise conCrol at these 2ocati.ons.
'L. The Lagan Ilaster Storm Seiaer P1an will require some modiiications to
fit the drainage needs uf the proposed Ilighway. The use of additional pond-
ing areas and the construction of some joint projects by the City and the
State Highway Department wi11 Ue necessary to carry out the proper drainage
control in an economical mannc:r. Certain revisions should be made to the
preliminary drainage plan shown on Pigure 55 of the Draft Impact Sta[ement.
3. Existing residential development near Slaters Lal:e will require
special attentiun to minimize the detrimentnl effect, of this construction on
that area. Local staff nay be able to assist in working with the local resi-
dents in this area.
4. The extension of sanitary sevrer and water main to serve certain
areas of Eagan west of the proposed i'reesiay wi11 require coordination in the
design and construction of bot?i the Freexaav and these utilities.

Subject: What's the rush?
How many fact:s and how muclltime should it take to
spend $939,400? That's hard to say. It depends, right?
If the subject is a re-forestation program, one to help
Eagan residents try to fix a real problem (dutch elm and
oak wiit) the Eagan City Council isn't interested. They
don't care if the state had a dollar matching program.
In other words the state would pay 50% of the program.
Other neighboring communities such as Burnsville partici-
pated in this program. But not Eagan.
On the other hand, if the subject is Storm Sewers for a
maybe, it might happen, storm of the century, this same
Council is instantly hooked. It says, "spend the money."
Why if we really hurry we'll save money. We'll get the
State to partially pay (30%) for a Eagan project we miqht
need some day. The State says it needs it NOW.
Hows this for a hurry. A document dated 15 December 1976,
"Preliminary Report on Cedar Avenue Drainage Improvement
Project 186 Eagan, Minnesota" was issued by the "City
Engineer." No need to wait for a"Fir.al" report. "Lets
hurry," says the Council. -
A not.ice dated 4 Jar.uary 1977 was sent to Eagan taxpayers
anr.ouncing that the City Council would have Project 186
as an aqenda item for a 1 February 1977 meeting. Is that
enough time to fact-find the general "Preliminary Report?"
On 1 February 1977, after a 30 minute presentation, B-2-N-G-0.
A winner! Makes one wonder doesn't it? Pretty fast action.
I've been trying to obtain any alternative plans, forecasts,
35E data, and lots more since then. Would you believe that
inPormation flotvs slow2r than water? I've concluded that
what Eagan really needs more than an oversized sewer is an
any sized information pipeline. Could it be that no infor-
mation exists,.

every case?)

I did not follow-up on the recommendations I made to
the Council earlier. However, I consider those recommen-
dations still open. Also some data being released to
the public inconsistant. Please advise if you require
anything further from me on them. If need be I'l1
entertain a nomination to the Assessment and/or Capital
Improvement Committee.
My notes for 5/26 show:
1) Currently undeveloped land, zoned commercial is
assessed commercial. If zoned as any other, then
later developed as commercial a special "connection"
charge is used to adjust the earlier assessment. It
is paid into the "Trunk fund" because projects
seldom come out as estimated. Therefore, previously
assessed parcels do not get ch&ges or credits for
these inaccuracies or later adjustments.
2) The "zoning map of City of Eagan" you provided is
not drawn to perfect scale. However, the outlet
pipe shown from Pond AP 18 is expected to use the
easement adjacent to my property. I alerted you to
my drain field location. The need for that pipe -
nor the one from AP 19 is as yet undetermined. In
my view no requirement exists. Again S stress that
the runoff from the residential property in this area
is insignificant when compared to Minnesota DOT
projects in the planning stages:
