The addi- tional infoxmation is provided to help clarify the assess[mnt situation as it pertairLs to your existing unplatted parcel as cm-pared with the proposed £inal plat for John- son lst Adclition. On Decmber 6, 1978, an application for a final plat was suTsnitted by David A. Johnson and Robert T. Johnson for the proposed Johnson lst Addition which incorporated Parcels 040-06 and.030-06 respectively. On March 27, 1979, the Advisory Planning Ccacmission approved the preliminasy plat. Chi April 3, 1979, the City Cotmcil formslly approved the prelimina*y plat subject to the oonditions placed by the Planning Camnission. On September 4, 1979, the City Council fornially approved the final plat for Johnson lst Addition. Based on the schedule as presented above, the City had assumed that the Johnson lst Addition was appropriately filed with Dakota Cotmty. Subsequently, in calculating the assessments associated with Project 259, we tAOk into wnsideration the Johnson lst Addition plat rather than tl:e individual implatted parcels. Suhsequently, the final assessmettt as levied Lmder Project 259 in September of 1980 atmtmted to $6,651.50. Because the final plat for the Johnson lst Addition is not recorded, this assessment was levied against Parcel 040-06 under the cNmership of Mr. Robert Johnsm.2b Proceed with the forntai filing of this plat with Dakota Cotmty long after the formal anpmval has been granted by City CoLmcil action, it would require a concurrence by both af- fected property aaners (David A. Johnson and Robert T. Johnson) whereby both par-;es would execute an agreenent waiving their rights to a hearing and authorize the spread of the existing assessnent in the mroLmt of $6;651.50 over Iot 1 and Lot 2, Block 1 in a ratio as detennined by both parties. In order to determine a fair and equitable suggestion for splitti.ng this existing assessanent among the newly created lots, the method of front footage was used. The total fmntage of both Lot 1 and Lot 2 adjacent to either Kin4's Road or Nicols Road a[rotmts to 579.27 feet. The proposed Lot 2 of the Johnson lst Addition incorporates 196.92 feet of this total fr.ontage. This results in 340 of the frontage being asso- ciatecl with Lot 2(030-06). Subsequently, if the existing assessmnts were split using this percentage ratio, Lot 2 would incur $2,261.15 and Lot 1 would be responsi- ble for $4,390.35 for the related benefit of street improvements associa`,.ed with Pro- ject 259 and/or WOOT Project SP-1925-13.
