As wa discussed last Friday (5/3/02), an entrance sign requires a Sign Permit to be
issued by the City. All signage must be located on private property. Also, the City
Sign Ordinance requires that xtl signage meet a minimuxn setback of 10' from all
property lines.
Signage located on a decorative feature, i.e. a wal] or fence, must meet the satback
requirement; however, the feature itself may be located up to the property line. For
example, signage located on a decorarive group of boulders must be at least 10' from
the property line while some of tha boulders snay be located nearer than 10' from the
property line.
If the sign is to be located on properry not owned by an association, the ovmer of the
properiy to contain the sign must he the applicant listed on the Sign Permit
Application. That properiy owner will also be responsible for the perpetual
maintenance of the sign and the feature to which the sign is aff`ixed.
This type of signage cannot exceed a total height of 7' with the sign azea or copy not
exceeding 4' in height. A Sigi Permit fee of $2.50 per square foot of sign azea, a
drawing of the sign, and a site plan indicating the location of the sign should he
submitted with the permit application. A pernut application form is enclosed for yow
use.

In official action taken by the Eagan City Council at their
December 19, 1989 regular City Council meeting, the Council
approved a reimbursement of $4,725 for parkland dedication fees
previously paid on the nine additional platted lots. Our Finance
Department will be issuing a check to Horne Development Corporation
for that amount within the next two weeks.
The City Council determined that your request for reimbursement of
an additional $675 for a setback variance and roadway easements is
not a reasonable expense. Such fees are a matter of policy and
practice in all developments and, therefore, would not be a
leqitimately reimbursable item.

Dear Mr. Fiorne:
As you may recall, on October 5, 1982, a foi-mal public hearing was held per-
taining to the above-referenced project. The final reassessment hearing was
then scheduled for November 9, 1982 at which ticcie, the final reassess[nQnt
hearing was oontinued until Decmber 21, 1982 based on your sutanittal of a
written objection pei-taining to benefit received on the above--referencecl par-
cels from Project 297-R.
In an effort to keep all assessments at the la,.rest possible cost, the City
dces not mutinely perform property appraisals/anal_ysis because of the addi-
tional msts neoessaxy to perfoxm this on a parcei by parcel basis. Hvw-
ever, because it is renu;reci that this property appraisal/analysis be per-
fornied in relationship tA any objection or challenge of a special assessment,
this thPn beooms an additional cost of the project, and as such, is to be
passed on to the benefitecl prrnr*-!-;es. We have subsequently received a cost
estir:iate to perfoxri a detailed appraisal of your property necessary to eon-
finn the benefit received frcan the assessments relatinq to this project.
The additional costs of this service will result in increasing your previous
pending assessrent by approximately $155.00 per lot within the King's ti'ood
Addition and appro}cinately $1,500.00 for the unplatted parcel No. 10-02100-
010-01 (26.89 acres).
Because of the time necessary to ccnplete this detailed proDerty appraisal,
it is rot anticipated that we will be able to proceed with the continued
final assessment hearing at the DecaNber 21st Council meeting. It is anti-
cipated that this final reassessim.nt hearing caill be continued until the
end of January or the first part of FebrilaYy in 1983. A specific date for
this semnd mntinuance will be discussed at the DecEnber 21st Council meet-
ing. In addition, I will send out a written reninder prior to this second
oontinued final reassessrrent hearing date.

In swnra-ry, although the final reassessment hearing date for Project 297-R
has been oontinued until necember 21st, it is anticipated that it will again
be oontinued until the latter part of January or the first part of February
in 1983. The pending special assessments for trunk area storni sewer for this
project will be increased by the amounts previously stated resultinq frcm the
additional costs incurred by the City to perform the extra work asso-
ciated with property appraisals.

b. The southerly 165 feet of lateral benefit frcm water main trurilc against
the east side of Outlot 3, as it presently Pxists cr as replatted, along
Pilot Knob Road installed imder Project #24 only if direct connection is
made tc, Pilot Kncb Road.
c. 128.1 feet of lateral benefit fran water main tsunilc against the south
side of Lot 6 lying adjacent tc> Ki.ngs Wood Road installed under Project
#131.
d. 100 feet of frontage adjacent to Pilot Knob Road for each of Lots 1 and
2, as they presently exist or as replatted, for water lateral benefits
obtained for each lot from the existing Pilot Knob Road trurilc water main
installed under Project #24 cnly if direct connectlon is made to Pilot
Knob Road.
3. Outlot 2, as it presently exists or as replatted, shall not be responsible

4. At such time as the water main is extended Westerly in Kings Wood Road,

waive objection to any technical defects in any proccedings relating to any assess-

RE: Improvement No. 80-5 (.Fish Lake Outlet) - Easement Acquisition
Dear ?4r. Horn;
As you are aware, we have had several discussions uvith you regarding the
proposed alignment for the storm sewer outlet for Fish Lake to Blackhawk
Lake. This alignment'is proposed to transgress your property in the
northwest corner through the low lying ponding area. As a result of our
many discussions with you, it has become apparant to the City of Eagan
that you are reluctant to convey an easement for this project across
your property. You have indicated that the only way such an easement
can be obtained is through condemnation or payment,in an amount that is
considered totally excessive by the City of Eagan.
Therefore, this letter is to in£orm you that the_City has received author-
ization to begin condemnation proceedings. Our City Attorney, Paul Hauge,
has been instructed to prepare the necessary legal documents to proceed
with these condemnation proceedings. In order for us to orepare a legal
description for the easement to be required under these condemnation pro-
ceedings it will be necessary for the City to enter your property to
perform detailed alignment surveys.
This letter is intended as notice to you under Minnesota Statute 117.041
for the City of Eagan to direct its surveyors to enter upon your property
for the purpose of making a survey of a proposed alignment for the storm
sewer outlet of Fish Lake. AQ.S.A. 117.041 reads as follows:
"For the purpose of making surveys and examinations reletive to any
proceedings under this chapter, it shall be lawful to enter upon any
land, doing no unnecessary damage."
This notice is being sent to you so that you are aware that surveyors will
be entering within the next few weeks, and I will therefore ask that you
let me know, in writing, of ax?y particular requests that you wish to make
prior to that time. This response is requested to be received prior to
PeTarch lL„ 1980.

In accordance with our discussions with you relative to the above project, we
have laid out the alternate outlet from Pond JP-5 into Blackhawk Lake to avoid
the requirement of an easement from Mr. James Horne.
This alternate alignment will require a aignificantly greater amount of extra
digging as well as a longer line. It is estimated that the construction cost
will be increased approximately $34,000 for this alternate alignment as com-
pared with the original planned alignment. Either alignment will provide the
proper outlet.
As now planned, the installatio? of the outlet to Pond JP-5 can be conetructed
and operated in such a manner that the water level will not be raised in this
pond at this time. Fish Lake can be drained through this line with the water
elevation raised no more than its current elevation. If possible, the easement
should be obtained from Mr. Horne either through negotiation or through con-
demnation to allow this construction project to proceed immediately. Certain
trees have already been killed by the high water around Fish Lake. However,
it is hoped that some of the larger trees can be saved by prompt lowering of
the pond. Certainly, more damage will occur from spring runoff if the project
is not expedited.

As you are aware, we have had many conversations in the past regarding the
proposed alignment for the storm sewer outlet for.Fish Lake, under the above
referenced improvement. This improvement aroposes this storm sewer align-
ment to transgress across the northwest corner of your property located in
the NE ?, r of Section 21. During our most recent discussion, I indicated to
you that I would return to you certain information as to the impact on your
property of various heights of ponding requirements in your northwest corner.
Attached to this letter is a color coded map showing the area incoxporated
by three dif£erent elevations, which are as follows:
1. Elevation $25.0 (white) = 0.90 acres
2. Elevation 828.0 (blue & white) = 1.94 acres
3. Elevation 831.0 (yellow,blue & white) = 3-57 acres
These area ealculations are for that portion located within your boundary
limits only. I am also forwarding to you a copy of the proposed alternate
alignment for this Fish Lake storm sewer outlet which would by-pass your
property around your northwest corner.
I would like to assure you in writing, by way of this letter, that the City
has no intentions nor need to acquire any ponding easements at any elevation
at this time. The only easements that we are officially requesting at this
time is a 10 foot permanent easement to allow the necessary pipe and shallow
ditching, and sufficient construction easements (50 feet) to allow the instal-
lation of this improvement through your property. The outlet control structure
from Fish Lake ean be effectively restricted to insure that no ponding will
take place on your property, by way of the hydraulic gradient differential
between Fish Lake and your low lying property. If at all possible Jim, I
would appreciate it if you could review this information and arrange for an
additional meeting so that I might discuss with you the information contained
in this letter, the impact on your property, and the easement acquisition offer
for this improvement.

ment of the levy of assessments for certain lateral benefits frcm trunk water main

that they can sign this Agrecnent without consent of any other person.
_ 2. Special assessments shall be levied at the tiTne of oonnection by the
City of Eagan at the rates then in exi.stence for lateral benefits fran water main
oovering the follaving property:
a. The Easterly 256.76 feet of the north side of Outlot 3, as it present-
ly exists or as replatted, along King's Wood Road installed under Pro-
ject #131.
