Stan Lexvold and I met at the site with the property owner, Scott Behnke, to discuss the
drainage problem at this site on Kirkwood Drive. There's approximately 10 cfs of water
in a 5-year rainfall event that drains along the street at his driveway, and the water
overtops the curb and goes down his driveway and is causing water damage to his house
and erosion in his backyard. We discussed a couple of options to correct this problem
with Mr. Behnke and all of these options have been discussed with him before because
this has been an ongoing problem. We convinced Mr. Behnke that raising the concrete
curb and gutter in the street would not help to resolve the drainage problem.
The properry owner has agreed to reconstruct his driveway by raising up the driveway
at the property line by about 4". This would create about 8" of ponding in the street and,
hopefully, that will keep the water from draining down his driveway. The property owner
plans to hire a mud jacking company to raise up four of the panels in his driveway and
then he will remove the two panels that are next to the curb and repour them with new
cancrete. The two panels next to the curb are cracked and they would be difficult to raise
by the mud jacking method.
The property owner has agreed to do this to correct the drainage problem, but then he
wants assurances that the City would add catch basins on Kirkwood Drive at the
upstream side of his driveway if this does not resolve the problem. We told the property
owner that the City would be more responsive towards adding the catch basins if the
problems still persisted after the driveway was raised up.

Our City Administrator, Mr. Tom Hedges, informed me that you had inquired as to the
background and status of the drainage problem being experienced by Mr. & Mrs. Scott
8ehnke who reside at 1074 Kirkwood Drive. 7om asked that I forward to you some
background information regarding this issue. Therefore, enclosed are copies of recent
correspondence to Mr. & Mrs. Behnke and/or their attorney Mr. James Fink, informing
them of alternatives and options that they can pursue to correct their current ongoing
drainage problems.
There has been a detailed engineering research/analysis study (91-RAS-3) that identified
the extent of drainage that must be designed for with any improvements. I am not
enclosing a copy of that lengthy report. However, it is certainly available for your review
if you have an interest in that level of detail.

Per this morning's discussion with Public Works Director Colbert, the Behnke's have been
offered one option by the City of Eagan to correct excessive water that flows onto their
properry from the street. That option has the City making the addition of a storm sewer
drain at the front of their property. That installation is to be at the Behnke's expense.
The City has also made its suggestions for internal improvements to offset the property's
continued exposure to water damage.
At this point, the Behnke's have not responded to the City's proposal. Mr. Behnke, in a
verbal exchange, has indicated he is unwilling to be responsible for the cost of the
additional storm sewer drain.

SUBJECT: 1074 KIRKWOOD DRIVE STORM SEWER PROBLEM
The Behnke's are experiencing a severe problem with excessive water on their property
and water erosion because their lot is situated on a curve at the bottom of a declining
street. The water is jumping the curve and flooding onto their property. Compounding
the problem is the fact that their house sits below grade on the lot. (Incidentally, the
proposal engineering approved for the lot had the house level with the street whereas the
house was actually buift below street level.)
Part of the solution to the problem has the City proposing to add a storm sewer drain just
past the start of the Behnke property line. That would eliminate the street water problem.
However, the City can only suggest to the home owner as to how to rectify the balance
of the problems that are caused by the excessive water that falls on the lot and erodes
the property due to the low grade of the house.
This is the extent of information I could seeure from engineering staff as of today's date.
I will follow up with Public Works Director Colbert on Monday, June 28, for any further
action that is taking place regarding the problem.

Per your request, i am forwarding to your attention a copy of the Research & Analysis
Study for the property referenced above. This report was prepared in response to the
concerns expressed by Mr. & Mrs. Behnke resulting frorn surface water flows across their
property.
After performing this Research & Analysis, a preliminary design was prepared to extend
a storm sewer system with two additional catch basins to be installed in the easterly
Kirkwood Drive gutter line just south of the Behnke's driveway. Formal bids were
competitively solicited on October 16, 1992, to determine a cost estimate to perform this
work. The lowest bid received amounted to approximately $11,500. There may be some
minor modifications to the design that could further reduce this cost estimate by
approximately $1,000-$2,000.
The installation of this additional storm sewer facility would intercept those storm water
flows prior to flowing down the Behnke's driveway and into or around their garage which
is the basis of their concern. It is felt that the insiallation of this improvement would
definitely benefit and improve the property at 1074 Kirkwood Drive. As such, the City
would be willing to proceed with this work and assess the costs associated with this.
improvement to Lot 7, Block 2, ChesMar East 1st Addition, if Mr. & Mrs. Behnke would
be willing to sign a Waiver of Hearing and a form agreeing to accept the assessments
associated with this project.

As can be seen by the building permit and related Certificate of Survey, Mr. Behnke
originally proposed to construct the garage 1.0' above the top of curb with the driveway
sloping towards the street. For some reason unknown to the City, the garage floor
elevation ended up being constructed approximately 1:8' below the curb elevation. This
has the effect of intercepting those flows that would normally have been contained within
the gutter and public boulevard area allowing it to create the problems that are currentiy
being experienced. As an alternative to the proposed storm sewer extension in Kirkwood
Drive, Mr. & Mrs. Behnke may pursue internal property improvements to address these
problems. However, they should be designed to take into consideration surface water
runoff ftows of approximately 30-35 cfs.
After you have reviewed this information, please let us know if Mr. & Mrs. Behnke would
like to have the City proceed with this work and the preparation of the related assessment
agreements.

Dear Mr. & Mrs. Behnke:
Recently, you submitted a petition requesting the installation of
speed limit signs regulating the traffic to 15 M.P.H. through your
subdivision. Please be informed that Minnesota State Law prohibits
any speed limit lower than 30 M.P.H. Consequently, we will not
be able to comply with your request for lowering of the speed limit.
You also requested the installation of two "children" siqns. The
City of Eagan has a policy restricting the installation of these
signs to just those locations where children are expected to congre-
gate on a continuing basis such as park, playgrounds, schools, etc.
While I recognize that there may be many children in your sub-
division, it is no different than all of the other residential
neighborhoods within the community. Therefore, if the City did
not strive to enforce the current policys "children" would be in-
stalled everywhere and this proliferation would detract from the
importance of the signs posted in those previously referenced areas.
In other words, if too many signs are installed at non-specific
locations, the traveling public would quickly learn to disregard
those types of signs wherever and whenever they may be installed.
I hope you can understand the City's position in trying to properly
control the installation of traffic regulatory signs in its com-
munity. I am sorry that this response is not the one that you had
hoped for when you took the initiative and effort in processing
the petition for our consideration. If you would like to discuss
the City's position in further detail, please feel free to contact
me and I will be happy to provide further information.
