Betty Bassett appeared on behalf of her request that the City Council
consider the redesignation oP the land use for four lots oxned by her ;n
Meadowland that have been, to date, approved for a four unit townhouse to be
used for a home for the handicapped. A number of questions were raised by
Mrs. Bassett and members of the City Council about the original intent of the
Unisource Planned Development for the use of that property and that more
recent approval was necessary regarding the Eagle's Nest Home for that loca-
tion. The chronology of events have been prepared Sy City Planner, Dale
Runkle, and uas reviewed by the staPP. Councilman Wachter suggested that
neighboring property owners be notified if there is a ehange in use. Mrs.
Hassett xas present and asked what the underlying zoning was. it was noted
that it currently is R-1. She stated that she could get 8 units of subsidized
housing and may use some units for handicapped and some for non-handieapped
persons. Councilman Smith stated that if the use is for partially handicapped
and non-handicapped, there would be a less dense use than originally antici-
pated. Mrs. Bassett states that action had to be taken on the use of the
property within the next two qears or that she xould lose the ownership o£ the
land. The issues appeared to be whether a 16 unit building with 8 handicapped
persons and 8 non-handicapped persons could be utilized in the location and iF
nat, what use could be made of the property. There xas diseussion concerning
a proposed amendaent to planned development. Smith moved, Egan seconded the
motion to direet the staff to work xith the owner and the developer of the
Planned Development to provide an amendment to the Planned Development and to
present the proposal at the next City Council meeting. All voted in favor.

The City Council then reviewed the recommendations of the Special
Assessment Committee meeting uhich had met on August 30, 1982, including the

1. Anderson, Maesaka, terg and Kyllo (John CroPt Acres) Assessment. IL
was requested by the fo^egoing persons that the assessment be ad,juste4
covering that portion of their property within Blaekhasrk Lake. Staff recom-
mended approval as did the Special Assessment Committee. Upon motion by
Smith, seconded Wachter, it was resolved to reduce the trunk area storm
assessment for the four foregoing parcels in accordance With the table
presented uith the packet to the City Council. All voted in Pavor.
2. Floyd IIryant, Deerwood Drive and Blaekhawk Road. APter discussion,
Smit`sm0vn_d Lo vacate the final Lrunk area storm sec+er assessment for the
Sryant property under Pro,jeet 0297 and order a new public heariag to be
scheduled for October 5, 1982 at 7:00 p.m. at City Hall. Wachter seconded the
motion, all voted yes.

These four individuals aze being gmuped together for discussion purposes because
of their collective objecticn tn their tnmk area stonn sewer assessment as describ-
ed in the letter enclosed on Page ?,_. Attached on Pages 3 through ?( are
location maps of the respective parceis for each of the individuals and the acrount
of their land that lies beneath the oontrolled water elevation of Blackhawk Iake as
established at 792.30. The Lake confirnurati.on as shown on these location maps is
not accurate and is for oonceptual oonfiguration only as vesified by the Dakota
CoLmty Auditor's Office. RYie staff overlaid the lot oonfiguraticn over a topograph-
ic map to detennine the actual limits af the controlled water elevatian at 792.30.
Ihis topographic werlay is available on Page 7 .
4he oollective objecticn by these property owners relates ta tte area belaa the con-
tsnlled water elevation being included in their net assessable acxeage. Recently,
Policy 82-3 was approved whidi provides for the elimination of land below a oontrol-
led water elevation fran area calculations. After recalculating the lot area and
providing the necessaiy creclit for the land belav the water area, on page ?, a
table was prepared delinear;+M the respective credits as requesterl by the objecting
pmperty aaness.

Because Policy 82-3 was being pmcessed sinwltaneously with the preparation of this
assessamt roll, it was not properly applied to these paroels in questicn. 'ihere"'
fore, the staff ooncurs with the pmperty owners' objecti.ons and recarnnands that
the appropriate credit be applied to the assessmeirts that were appmved at the final
assessment hearing held on July 20, 1982 in accordance with the table on Page

Dear Mr. Calbert:
This letter is to appeal our assessment.for the atorm sewer
improvement on Blackhawk Lake, ?
We, the undersigned are all property owners in Jon Croft Acres
(on Blackhawk Lake). We feel the algorithm for determining the
amount of assessment ( 3.4 cents per square foot on the first
16p500 sq ft of each acre in a given parcel) was applied unfairly
to the property in Jon Croft Acres.
As a result of conversations with Mr Colbert today, it appears
that'the area for assessment ia Jon Croft Acres included area
within the lake (under water), whereas other lakeshore property was
not assessed for lake area.
The lake area is up to nearly SOX of the assessed area on some property
(see attached plot map).
We contend that our assessment is:
1) Nat equitable (we only ask to be treated like other
property owners).
2) Unreasonable. (How can area under water benefit from
a storm sewer project).
Accordingly, we ask that our iespective areas to be assessed be
recalculated to exclude that area vhich is under water.
