Betty Bassett appeared on behalP of her request that the City Council
consider the redesignation of the land use for Pour lots owned by her in
Meadoxland that have beez, to date, approved for a four unit townhouse to be
used for a home for the handicapped. A number of questions were raised by
Mrs. Bassett and members of the City Council about the original intent of the
Unisource Planned Development for the use of that property and that more
recent approval was necessary regarding the Eagle's Nest Home for that loca-
tion. The chronology of events have been prepared Sy City Planner, Dale
Runkle, and uas reviewed by the stafP. Councilman Waehter suggested that
neighboring property owners be notified if there is a change in use. Mrs.
Bassett cras present and asked what the underlying zoning was. It was noted
that it currently is R-1. She stated that she could get 8 units of subsidized
housing and may use some units for handicapped and some for non-handicapped
persons. Councilman Smith stated that if the use is for partially handicapped
and non-handicapped, there would be a less dense use than originally antici-
pated. Mrs. Bassett states that aetion had to be taken on the use of the
property xithin the next two years or that she would lose the ownership of the
land. The issues appeared to be Nhether a 16 unit building with 8 handicapped
persons and 8 non-handicapped persons could be utilized in the location and if
not, what use could be made oP the property. There xas discussion concerning
a proposed amendment to planned development. Smith moved, Egan seconded the
motion to direct the stafP to work with the owner and the developer oP the
Planned Development to provide an amendment to the Planned Development and to
present the proposal at the next City Council meeting. All voted in favor.

The C3ty Council then reviewed the recommendations oP the Special
Assessment Committee meeting whieh had met on August 30, 1982, including the

1. tAnderson, Maesaka, Berg and Kyllo (John Croft Acres) Assessment. It
was requested^by the fo^egoing persons that the assessment be ad,justed
covering that portion of their property within Blackhawk Lake. Staff recom-
mended approval as did the Special Assessment Committee. Upon motion by
Smith, seconded Wachter, it was resolved to reduce the trunk area storm
assessment for the four fo^egoing parcels in accordance with the table
presented crith the packet to the City Council. All voted in favor.
2. Floyd Bryant, Deerwood Drive and Blackhawk Road. After discussion,
Smith moved to vacate the final trunk area storm sewer assessment for the
Bryant property under Projeet 0297 and order a new public hearing to be
scheduled for October 5, 1982 at 7:00 p.m. at City Hall. Wachter seconded the
motion, a11 voted yes.

ed in the letter enclosed on Page ?,_. Attached on Pages 3 through (e are
location maps of the respective parcels for each of the individuals and the amoLmt
of their land that lies beneath the mntrolled urater elevation of Blackhawk Lake as
established at 792.30. The Lake oonfiguration as shaan on these location maps is
not accurate and is for conoeptual wnfiguration only as verified by the Dakota
Coimty Auditor's Office. The staff overlaid the lot configuraticn over a topograph-
ic map tO detPrmine the actual limits af the mntrolled water elevation at 792.30.

The aollective objectian by these pmperty owners relates to tle area belaa the oon-
trolled water elevation being included in their net assessable acreage., Recently,
Policy 82-3 was appmved whidi provides for the elimination of land beZaa a oontsnl-
led water elevation fran area calculations. After recalculati.ng the lot area and
provi.ding the necessaxy credit for the land belaa the water area, on paqe ?, a
table was prepared delineating the respective credits as rem.iested by the objecting
ProPertY owners.

Dear Mr. Colbert:
This letter is to appeal our assessment.far the storm sewer
improvement ou Blackhawk Lake. ?
We, the undersigned are all property owners in Jon Croft Acres
(on Blackhawk Lake). We feel the algorithm for determining the
amount of assessment ( 3.4 cents per square foot on the first
16p500 sq ft of each acre in a given parcel) was applied unfairly
to the property in Jon Croft Acres.
As a result of conversations with Mr Colbert today, it appears
that'the area for assessment in Jon Croft Acres included area
vithin the lake (under water), whereas other lakeshore property vas
aot assessed for lake area.
The lake area is up to nearly SOX of the assessed area on some property
(see attached plot map).
We contend that our assessment is:
1) Not equitable (we only ask to be treated like other
property owners).
2) Unreasonable. (Hov can area under vater benefit from
a storm sewer project).
Accordingly, we ask that our respective areas to be assessed be
recalculated to exclude that area which is under water.
