Dear Mr. Winkle:
During the past several weeks, we have reviewed with you your
concerns and potential claims associated with damage to your
landscape retaining wall along your west property line associated
with excessive runoff from the street and adjacent properties
within the Timberline Addition. You have indicated that the
existing storm sewer system does not adequately handle the
excessive flows associated with these high intensity rainfall
events. Subsequently, I have requested our Public Works Street
Maintenance Division to investigate the effectiveness of the catch
basins and to perform corrective modifications as necessary to
maximize their inlet capacity.
However, the storm sewer system in this area, as well as throughout
the City of Eagan, is not designed to accommodate the excess
surface water runoff associated with these high intensity rainfall
events that we have experienced several times this past year. When
these rainfall events exceed the design of the storm sewer system,
the excess surface water runoff will continue to proceed down hill
alonq overland routes. Any development of property, including
landscaping improvements, should take into consideration the
potential of significant surface water runoff along common property
lines for those infrequent high intensity rainfall events.

In your particular situation, while you and the property owner to
your west have properly provided for this surface water runoff to
be confined to your common property line, there did not appear to
be adequate protection to prevent erosion from undermining the
foundation of your retaining wall. If large boulders and "rip-rap"
were to be placed along the base of your retaining wall, it would
provide significant increased protection from similar situations
in the future.
I am enclosing a copy of a 2-foot contour topographic map which was
prepared in 1964 which shows the natural topography in this general
area as well as your particular lot. As can be seen, your house
was constructed in one of the significant drainage ways of this
subdivision. Subsequently, careful site planning and landscaping
must take into consideration the anticipation of excess overland
runoff from the higher elevations to your south and east.
The City of Eagan does not have a policy or the financial resources
to provide monetary assistance to property owners who have incurred
damage associated with these high intensity rainfall events.
However, we do have knowledgeable staff in the Engineering Division
who can provide technical assistance in helping to minimize similar
future occurrences.
I regret that we are not able to provide the degree of assistance
or involvement that you have requested. Hopefully, the maintenance
modifications to the catch basin inlet facilities and your
protective measure should help to minimize a similar reoccurrence.

Sorry to be so late in a response to your letter regarding the
neighbor who is storing an automobile and camper on his property.
I forwarded your letter to our Police Captain in charge of opera-
tions and after an investigation was made on the property, it
was learned that both tne automobile and camper are set back
far enough from public right-o£-way that there is no violation
of "storage on public prope-rty." Also, the vehicle is properly
licensed and, therefore, the resident has the right to store
both the vehicle and the tent camper according to City ordinance.
Sorry I was unable to be of more assistance to you regarding
this problem. If any conditions should change that you feel
could cause an ordinance violation, feel free to contact me at
any time.

On July 7, I received your letter dated June 23 summarizing our discussion we had on
June 15 regarding the erosion problem affecting Mr. Winkle's retaining wall at 1575
McCarthy Road. I appreciate receiving your letter as it allows me an opportunity to clarify
some apparent misconceptions.
First of all, I cannot concur with your conclusion that "the problem at hand is indeed a
municipal water problem". It is recognized that the retaining wall constructed along the
common property line of the above-referenced properties has been adversely affected by
overland drainage flows and the resultant erosion undermining the wall's foundation. It
should be recognized that this wall was constructed in a natural drainage ravine along a
steep slope which has a potential for erosion during significant rainfall events.
1 had indicated that in anticipation of some street and storm sewer improvements being
performed in this subdivision in the near future, that the City would be willing to place
some erosion control rip-rap on an interim basis to assist the property owners in dealing
with their current problem. We hoped that we would have been able to complete this
work by this date. However, we needed to receive authorization from Mr. Gervais to do
any work on his property. As of this date, we have not received that authorization and
are not sure when it will be granted.

June 15, 1993 regarding the water problem at the residence

water problem. You agreed that the city of Eagan will lay

First of all, let me apologize for the ongoing frustration that you are experiencing with the
drainage probiem along your west property line. After reviewing the area of concern, I
am aware of the problems that you continue to incur and the extensive improvements that
you have made in an attempt to mitigate the impact on your properry.
Approximately two years ago, you and I had discussed similar concerns regarding the
impact that excess runoff is having to your property. Enclosed is a copy of a letter dated
August 23, 1990, addressing that earlier issue.
After having personally inspected your property and the damage that resulted from the
most recent rainstorm of September 15, it is apparent that something more needs to be
done to prevent future problems. First of all, I would like to reassure you that the
probability of receiving another significant rainfall of that magnitude within the next 6
months is so remote it's difficult to justify an expenditure by either the City or yourself
without properly evaluating a permanent solution.
As I indicated in our recent phone conversations, the City of Eagan has retained a
consultant engineering firm to perform a detailed hydrologic and hydraulic analysis of your
whole development along with your specific drainage problem as a part of the proposed
street reconstruction program scheduled for 1993. It is hoped that this evaluation will be
completed by year's end. At that time, you should be able to determine the proper
method of restoration, properly taking into account the calculated excess surface water
runoff generated from a 100-year storm event and planned City improvements, if any.

When this storm sewer system was originally instalied privately by the developer, I am
sure it was done without the extensive detailed hydrologic analysis that can be performed
today. The recent improvements in landscaping to you and your neighbor's property
were obviously not designed to handle or take into account the volume of water that you
experience with these high intensity rainfall events.
I want to assure you that we will be specifically attuned to your concerns as we evaluate
the development for any proposed improvements. We will make sure that you are
informed and involved in the final analysis so that you can then anticipate and determine
what can and should be done to restore and stabilize your property.
