VAN OVERBEKE City Cierk On July 7, I received your letter dated June 23 summarizing our discussion we had on June 15 regarding the erosion problem affecting Mr. Winkle's retaining wall at 1575 McCarthy Road. I appreciate receiving your letter as it ailows me an opportunity to clarify some apparent misconceptions. First of all, I cannot concur with your conclusion that "the problem at hand is indeed a municipal water problem". It is recognized that the retaining wall constructed along the common property line of the above-referenced properties has been adversely affected by overland drainage flows and the resuftant erosion undermining the wall's foundation. It should be recognized that this wall was constructed in a natural drainage ravine along a steep slope which has a potential for erosion during significant rainfall events. I had indicated that in anticipation of some street and storm sewer improvements being performed in this subdivision in the near future, that the City would be.willing to place some erosion control rip-rap on an interim basis to assist the property owners in dealing with their current problem. We hoped that we would have been able to complete this work by this date: However, we needed to receive authorization from Mr. Gervais to do any work on his property.
