On July 7, I received your letter dated June 23 summarizing our discussion we had on
June 15 regarding the erosion problem affecting Mr. Winkle's retaining wall at 1575
McCarthy Road. I appreciate receiving your letter as it ailows me an opportunity to clarify
some apparent misconceptions.
First of all, I cannot concur with your conclusion that "the problem at hand is indeed a
municipal water problem". It is recognized that the retaining wall constructed along the
common property line of the above-referenced properties has been adversely affected by
overland drainage flows and the resuftant erosion undermining the wall's foundation. It
should be recognized that this wall was constructed in a natural drainage ravine along a
steep slope which has a potential for erosion during significant rainfall events.
I had indicated that in anticipation of some street and storm sewer improvements being
performed in this subdivision in the near future, that the City would be.willing to place
some erosion control rip-rap on an interim basis to assist the property owners in dealing
with their current problem. We hoped that we would have been able to complete this
work by this date: However, we needed to receive authorization from Mr. Gervais to do
any work on his property. As of this date, we have not received that authorization and
are not sure when it will be granted.

This letter is in confirmation of the discussion we had on

We reviewed the situation of the existing drainage problem
and concluded that the problem at hand is indeed a municipal
water problem. You agreed that the city.of Eagan will lay
8- 12" "rip-rap" in drain area that exists to prevent further
erQSion. .
The actual time frame that this work was to be completed
was not detailed, however, it was agreed that the work would
be done as soon as possible to prevent any further damage
in the event of heavy rain.

On Wednesday, June 23, I met wfth Mr. Gervais and Mr. Tom Winkte, your neighbor at 1575 McCarthy Road,
to discuss what actions the City could do to help minimize and prevent further erosion along your east
property line adjacent to Mr. WinMe's retaining wall.
I had indicated that the City would be willing to pertorm some minor regrading to define a drainage swale
along with the placement of a filter fabric and some large rip-rap erosion control materials to minimize any
further erosion associated with excess surface water Nowing through this drainage way. I had indicated our
wiilingness and desire to perform this work as quickly as possible recognizing the heavy rafnfall season that
we are entering. I had also indicated that before we could proceed with this work, there should be a
temporary construction easemeM granted to the Ciry of Eagan to allow us to enter your property to pertorm
thls work. Enclosed with this letter are two original easement documents which should be signed, notarized
and retumed to my attention before we can proceed with scheduling and performing this work.
Per our telephone conversation on this day, you informed me that you want to pursue the resolutlon of a
property line discrepancy with you and Mr. WinMe as well as clarifying ownership of the property behind
your house to the north. While the City cannot assist in the resolution of those issues, we'll be happy to
provide whatever information we have that you may find helpful.

TEMPORARY CONSTRUCTION EASEMENT
This easement, made this day of June, 1993, between STEVEN
GERVAIS and SERENA GERVAIS, husband and wife, herein referred to as
"Landowners" and the CITY OF EAGAN, a municipal corporation organized
under the laws of the State of Minnesota, hereinafter referred to as
"City".
W I T N E S 8 E T H:
That the Landowners, in consideration of the sum of One Dollar
($1.00) and other good and valuable consideration, the receipt and
sufficiency of which is hereby acknowledged, do hereby grant and
convey unto the City, its successors and assigns, a temporary
construction easement for site grading and drainage purposes over,
under and across the following described premises, situated within
Dakota County, Minnesota, to-wit:
The East twenty-five (25) feet of Lot 19, Block 3,
Oslund Timberline Addition, according to the
recorded plat thereof.
The grant of the foregoing.temporary construction easement for
site grading and drainage purposes includes the right of the City,
its contractors, agents and servants to enter upon the premises at
all reasonable times to regrade and reshape the existing overland
drainage way to confine it within a seven (7) foot (more or less)
swale lined with filter fabric and twelve (12) inch minus rip-rap for
erosion control, and the further right to remove one tree
approximately six (6) inches in diameter, brush, undergrowth and
other obstructions. After completion of such construction and
grading, the City shall restore the premises to the condition in
which it was found prior to the commencement of such actions, save
only for the necessary removal of trees, brush, undergrowth and other
obstructions. All disturbed turf areas will be restored by the City
with sod and/or seed. This temporary construction easement shall
expire on September 1, 1993.
The Landowners, on behalf of their heirs and assigns, do covenant
with the City, its successors and assigns, that they are the owners
of the premises aforesaid and have good right to grant and convey the
easement herein to the City.
