Following the call to order and pledge of allegiance, introduction of Mr.
Wayne Sames, recently appointed Commission member to fill the position
formerly held by Tom Ketchum, is in order. It would then be for
the Commission to approve the Agenda, the Minutes of the "c _ _n"-
of January 8th, 1987 and acceptance of the Community t nt r~ C`uud ° <<>`_;a
collected on the tour of January 10th, 1987.
COMMISSION ORGANIZATION
The February meeting of the Advisory Parks and Recreation Commission
traditionally been the meeting in which the Commission organizes for e
ensuing year. Election of the Chairperson, Vice Chair, Secretasay,
followed by appointments to the various committees of the Cc its ;ion, is in
order. The Commission may wish to evaluate the necessity of these four
committees, adding or deleting as they feel appropriate.

Enclosed with the packet, is a communication from the City Council r
certain policies and procedures the Council wishes to clairify. Tom
City Administrator, will be at the Advisory Commmission meeting to ex. 1 in
this further.

MEMO TO: ADVISORY PARKS AND RECREATION COMMISSION

HE: BOULDER RIDGE
On Wednesday evening, January 28th, members of the Development ',-,c '.ee met
with Mr. Tom Gasler to review this proposed preliminary plat. livan,
Landscape Architect/Parks Planner has prepared three alternativ_ based
on a shortened cul-de-sac and reduction of living units to six, n 1- area
adjacent to the park. Staff's assessment indicates this revised plan is
workable. Staff will review these alternatives with the Advisory Commission
on Thursday evening.
Mr. Gasler also presented a second alternative on Wednesday eveniz-_:. This
alternative further shortened the cul-de-sac to a li-r 'th of approxi°r1'L,<,"'.y 200+
feet, and with a private road to the six residents. ~,'_,lternCt ,..s to be
reviewed by City Staff and the Engineering Department, r.ti,, so will deg: err]:.rle it's
feasibility. It's advantages to the park system, are th_4.t it saves additional
green space, and reduces grading of the site. However, the shorter road
length makes matching with road grades to County Road #30 an issue. Staff is
hopeful that it will have done an analysis on this second alternative prior to
the Commission meeting for presentation.
ISSUES TO BE RESOLVED
It is Staff's opinion this revised preliminary plat, as it relates to parks,
is acceptable. The second alternative presented Wednesday evening may also be
acceptable.
An issue that has yet to be addressed, relates to the cul-de-sac in general.
This cul-de-sac is proposed to be a private street to be maintained by the
Home Owners Association, however the Staff's park plan envisions publ%c~
of this street for access to the park. Mr. Gasler has concerns f,-)r tip _s, ~,.s
it raises an issue of liability for the Homeowners Association. FircD , ~Ihe
City's perspective, the Homeowners may not maintain the private road in a
condition suitable for public use. It appears that the alternative would be
for this cul-de-sac to be a public street, of narrower width and/or a variance
for set backs for the residential units.
FOR COMMISSION ACTION

along une northern portion of this s site connecting to PiloS, Knob
Roa& This easement also serves both parcels to he north, one of
which contains a single-family home. The church itself is proposed
to be built in four phase as the congregation grows. Parking to
expansion will be required with each phase. The main hexagonal
sanctuary is proposed with the final phase of construction and will

along the est tide of good Road. An internal lateral distribution

limited number o lots and the remote location of any additional

GRADING AND DRAINAGE: The general slope of this property provides
for surface drainage directly into Hay Lake on the north side of
this plat. ` h existing topography of this parcel results in a 13%
lope from the south towards Hay Lake, requiring cuts and fills over
the entire site to bench the cul-de-sac and adjacent house pads for
ultimate development. Y § plan submitted showed the garage
being located on the uphill side of the houses. In order to
minimize the gr<Ackr_ng impact, potential encroachment in Hay Lake and
to minimize excess driveways, it is recommended that the lots on the
adjacent north side of the cul-de-sac Lake have the garages
boated on the lower: elevation of the building pad.
All front yard drainage and street surface water runoff will be
directed to two I'ee'$ y installed catch basins at the intersection

with Dodd Road and connect to the existing storm sewer outlet for
Hai Lake. The ultimate outlet will be the Minnesota River upcml
completion of the Holland Lake trunk storm sewer outlet presently
under construction and s chedUi for completion prior to full
development of this addition.

intercept the east curb line of Dodd Road drainage prior to crossing

Extensive erosion control measures will have to be implemented to

proposed erosion control fences, it is recommended that a temporary
diversion dike be constructed and maintained concentrating runoff
into a tesnrpora.ry sedimentation basin. n. on the north, side of Lot I_
until permanent vegetation restoration has 'beea completed.
EASEMENTS, EMEN S, RIGHT-OF-WAY AND PERMIT : Forty toot halt right-of-way
requirement for Dodd Road is being provided with the platting of
this property. A pondding easement shall be dedicated on the p cat
incorporating the 911.0 elevation. In addition to the common lot
tine drainage and utility easements required with plat, this additional utility easement of sufficient width -;hall be provided
for the sanitary sewer lateral from Patrick Circle is connection
with the existing trunk sanitary sewer along the common lot line of

area have been previously levied over this parcel. However, they
were levied at the agricultural/single family rate and not at the
proposed commercial rate. Therefore, this development will be
responsible for the additional assessment obligations associated
with the higher intensity use of this property.

zoning rate for this entire parcel. No additional trunk area storm
sewer is anticipated.
Due to the fact that this development has never been assessed for
the benefits received from the existing sanitary sewer line along
the south and west boundaries, it shall assume those financial
obligations as a condition of final plat approval.
Although this development has previously been assessed for the
lateral benefit from the trunk water main along Coachman Road, it
has not paid its related assessment obligation for the lateral
benefit from the trunk water main along Yankee Doodle Road.
Therefore, it is appropriate that this additional financial
obligation be a condition o final plat approval.
Previous ssesse ents associated with Coachman Road street and
trailway improvements were reduced based on appeal by the
property owner based on a claim of reduced benefits to the previous:
lot configuration and undeveloped state. Therefore, it is
recommended that the inflationary adjustment of the unassessed
balance become the responsibility and obligation of this development

Since the submission of the preliminary plat by Deis Companies, he
applicants have decided to change architects and designers of the
shopping center project. Staff has met with Wayne Bishop to review
the concerns and iss a regarding this particular site p tar: i in
this preliminary meeting held ors January 1 .2, i is the staff's
fu.nderstandi..n that the architects ~~~i.1y.l b revising the access and
circulation to the cen! ei~ and start to address the RE` concerns of the
City 'stn staff in regard to the overall site plan. These concerns are
as fol_loVYsm
1. To address the Denmark side of the shopping center and try to
architecturally treat it so that it will not become the back
wall of the shopping center.
2~ In review of the courtyard and open space between Phase I and
Prase tI there is no entrance from the outside. Staff is
suggesting that the applicants look at shi, sting the entrance
which is south to the courtyard area where the landscaping and
attractive open space- is being proposed.

center or cirang the existing- center to conform with what is
now being proposed,

being proposed versus what has been approved in the Permit. in
.staff's review the applicants are proposing one adc:itional_ curb c=ut
from Denmark Avenue and one additional curb cud: on Dxckwood Drive.
If. these are to be allowed, they should be reviewed p ~
and approved by
the pollution Control Agency. Secondly, they `own Centre project was
approved for the construction of 532,480 'gross square feet, in the
calculations for Town Centre '7 1st through 8th Additions consist of
apprMinlate.i.y 653,000 square feet or an excess of 120,000 square
feet of car{:pus retail area. It is staff's understanding that either
the project would have € o be cut back by this 25,000 square feet: or

Centre €0 - 8th Addition, staff is requesting more detailed

the way to the Minnesota Rive through downstream facilities.
Pond JP-66 shall be final graded to its finishei contours to

Also, the equalizer culvert underneath DucCawcsod Drive connecting JP-
66 to Pond OP-67 on the south ;side shall be extended and made fully

STREETS CIRCULATION: The site plan submitted does not show
existing or potential future driveway accesses for the prolperty
acres Town Centre Drive, Duckwood Drive or enniar Avenue. A
review should be performed to evaluate comp tabilzty of this
development's C re t proposed accesses in relationship to the existing and
proposed future driveways adjacent to the perimeter of this
development,
All driveway entrances onto local City streets shall have a minimum

1. Designation on Preliminary Plat.
Where a proposed park, trailway, ponding or , ! -ej,

plat. Such area or area- shall also be dedicated to the
City by the subdivider if the Council requests such dedica-
tion under the remaining provisions of this Subdivision.
2. Park Land Dedication. Said dedi-
cated land shall be in an amount determined to be reasonable
by the Council. Said land must be [ ;able and acoe ;-=a

3. Dedication Credits for Construction.
Dedication credit shall not be granted for the construction
of recreational facilities unless a specific agreement
granting credit is approved by the Council.
4. Dedic:i on of Ponding Areas. Pond-
ing areas, needed as a part of the overall City Storm Drain-
age Plan, shall be dedicated in fee or easement at the
option of the City and in a form acceptable to the City.
However, no credit shall be given for park dedication unless
said area meets the criteria for public parks as stated in
the City's Comprehensive Plan and the City's Park Dedication
Resolution and is approved as such by the Council. Said
dedication of land or easement shall be in a form approved
by the Council.
5. Land in Excess of Dedication
Requirements. Where land proposed for public use exceeds
the amount legally and reasonably required by the City and
the subdivider will not dedicate the additional amount, the
Council shall have a maximum of four (4) months from the
date of preliminary plat approval by the Council to proceed
with an option or purchase of said additional amount. Where
a purchase is not initiated, the plat shall be revised t
permit another use and the processing of the plat shall
continue.
6. Timing of Dedication. If a new
subdivision is designed to be platted into more than one
addition, all park or other public use lands contemplated
under this Section for each phase of the subdivision, except

RE; MUELLER PARK/SCHOOL SITE DEVELOPMENT
BACKGROUND
School District d#196 and the City of Eagan acquired twenty-eight (28) acres
for a school/park site adjacent to Westcott Road, known as the Mueller parcel.
This acquisition was completed in early 1986. In anticipation of a successful
school bond referendum on March 10th, 1987, the school district and City staff
have been preparing for eventual platting and development of this p °cel. In
conjunction with the platting and site development, staff hav : . r i a
draft agreement covering development, maintenance, and usage of t
parcel. A copy of that draft agreement is attached.
SITE PLAN
A preliminary site plan has been proposed for the twenty-eight (28) acre
parcel, under the presumption that the City and the School District can be
mutual beneficiaries of a joint development program. The proposed plan
envisions an elementary school building, which replicates the
Elementary School structure. Access to the school/site will be fx >~ri_ a. p,e
road accessing Westcott Road. This double ar,~c., provides for
smooth flow of school and bus traffic to the 'building. Parking fcaci] nt
road access to the playfields can also serve "park amenities". The ~tayfi:~ld;
include soccer and two (2) ballfields. A hard court play surface and
playground equipment area are also provided. Department staff envisions
connecting trails throughout the park site, as well as the development and
establishment of a picnic area.
City staff will review the preliminary site plan for the twenty-eight (28)
acre parcel at the Commission meeting.
DRAFT AGREEMENT
A draft agreement, dated February 2, 1987, has been prepared by School
District Staff and the Director of Parks and Recreation. The intent of this
site agreement is to cover issues relative to the joint development and
maintenance of this site, as if it were one parcel.
At this time, a decision as to the necessity and the desirability for a
division of the property has not been concluded. It appears however, that a
division will be necessary for the purpose of identifying assessments.
Nevertheless, it is the intent of the City and the School District to jointly
develop the property without using property discriptions. Consequently, the
necessity of this agreement.

SPECIFY OF AGREEMENT
Articles one (1) through three (3) speak to the juris7-1'.^tic~ n I o th-
property. School District #196 has jurisdictton o.< e 1. or <~rtv °o.r°
the purposes of scheduling activities during the normal school -r
4s30 P.M. Eagan retains sole jurisdiction for scheduling recre_tion
activities and programs at other times. Usage of the facilities during other
times are to be coordinated with the other agencies. This agreement
recognizes that School District #196 has scheduled evening activates i.e.,
P.T.A., Band Concerts, etc., and that the City of Eagan has maintenance
issues, which need to be done during daytime hours.
Section #4 of this agreement identifies responsibilities for the cost fc.-
development items for the school district. Basically, the district will Clo
all site grading necessary to construct the school building, as well as the
athletic fields. The City shall be responsible for certain development items,
including trails, player benches, landscaping and installation of aglime for
the softball fields. These items are covered under Section #5 of this
agreement.
Section #6 and #7 relate to the responsibilities `"car --"n'.
District #196 will be responsible for maintaining th lt, x
lot, road access, and ground maintenance immediately ad~~t to t~: vchool
facility.
City maintenance responsibility shall include the turf and grounds
maintenance for fields, including the mowing, seeding, sodding, and
fertilization of the ballfield areas. The City shall be responsibl for
maintaining the playground facilities, any park furn"eshings, the li ,rid
striping of the athletic fields, and maintr of tree and nu materials.
Article #8 reflects a split in the cost for platting and preliminary plat feel
for the entire twenty-eight (28) acre parcel, as well as any incidental legal
and engineering costs associated with this process.
Article #9 identifies that the School District is responsible for costs
associated with utilities, including electrical, and sewer and water into the
site.
Article #10 identifies associated construction fees directly related to the
school building, including a building permit fee, and SAC and WAC charges.

need for these locker/shower rooms. Staff believes there is merit in this
because of the proximity of soccer fields on Blue Cross/Blue Shield property,
along with the soccer field on the existing park. Adjacent tennis courts and
full court basketball also makes the locker room/shower facilities a usable
addition to the building. Obviously, Blue Cross/Blue Shield employees would
benefit from the availability of the showers and expanded opportunities
associated with tennis courts, walking/jogging trails, and basketball cour'-.«
Mr. Storbakken indicated Blue ;r ; ~/..>1ue Shield's willingness to parti-t_,)at,c
in the financial construction of these additions. The degree to which that
financial participation is based on the assumption that the City would also
make use of these facilities. Although exclusive use by Blue Cross/Blue
Shield has not been excluded as a possibility, it is staff's opinion that this
would eliminate several options for recreational programming for the City, and
not in it's best interests.
APPROVAL PRUGI~SS
If the Advisory Commission approves the concept of adding shower room
facilities, Staff will direct the architects to refind the cost estimate
further. Mr. Storbakken will then seek approval from the Board of Directors
at Blue Cross/Blue Shield for participation in this building program.
Simultaneously, the City Council will also be requested to approve.

BACKGROUND
The Advisory Parks & Recreation Commission and City Council have previ oti.-'_y
reviewed and established a fee structure for the rental of Trapp Farm r
Pavilion and shelter buildings. An attachment to this memo reviews e
process on how staff will implement this fee structure and rental procedure.
At issue, however, is the City's policy relative to the permitted use of beer,
wine and alcoholic spirits for the City's new picnic facilities.
Staff would like the Advisory Commission to provide some direction to the
department in the administration and use of these facilities which provides
for controls and the use of these beverages with picnic reservations.
CITY ORDINANCE
A brief review of the City Ordinance that addresses beer, liquor and wine in
the City's parks & recreation areas reveals the following: Beer means non-
intoxicating malt liquor, not in excess of 3.2% alcoholic. Liquor means ethyl
alcohol in distilled, fermented, spiritous and malt beverages in excess of
3.2% alcohol. Wine means wine not exceeding 14% alcohol. Fur-tlaer, "it 's
unlawful to bring wine, liquor or beer into a City park or ree*~~ ~ in
kegs, barrels, or case lot quantities except where author
permit by the City Council or Parks Director."
(Does the reading of the above quote mean that while it is unlawful to bring
beer, wine, or liquor into the City in kegs, barrels, or case lot quantities
except where authorized, it is permitted to bring beer, wine, or liquor into
the City as long as it is not in kegs, barrels, or case lots?)

ENFORCEMENT
Generally, kegs and barrels are readily identified and oon., < :`_;1,
enforcement is able to disperse "keg parties" in a City parr q~its~ za.ilr.
However, there are gray areas. For example, case lots is an interpr<<-ive
expression which may mean different things to different people. A case of
beer may be excessive for two to six people, but is it excessive for seven to
eight people? The distinction between 3.2% and strong beer also requires some
interpretation, at least from a casual appearance.
CURRENT PRACTICES/EXPERIENCES AT aATTHT, "TIC FAC ITTES
Each year department staff addresses the issue of beer consumption at
orthview Athletic Fields with softball team managers. The direction given
includes that a team shall not have beer in kegs or glass bottles. Teams are
prohibited from drinking beer on the bench during participation in the sport.
It is recognized that spectators and players who have finished their
remain in the spectator areas often with b^er. A tear -f 12-15 pI
often have a cooler of beer and likely a ca;-:e, in the ,`uinity of
lot or picnic area. Generally speaking, btl_~r has no' - 'i proble:
past two or three softball seasons.
FOR COMMISSION DISCUSSION
Staff is requesting that the Advisory Commission provide some direct Lon to
staff relative to the permitting and permission of the use of a,lc~~`nulic
beverages with picnic reservations at Trapp Farm Park, pavilion a.ni )the
facilities.
The Commission could; A) not allow the use of beer, liquor, and/or wine. B)
Allow by written permit only (as provided in the City Ordinance) or authorized
by City Council and/or the Director of Parks & Recreation or authorization,
(C) allow only for certain circumstances to be identified by the Commission
and/or Council.
FOR COMMISSION ACTION

At my request, Tom Angus has staked the proposed normal and high wat~rA
elevations for Pond JP - 8 in Patrick Eagan Park. The purpose of t.h±s star ,1.r
was to help the Advisory Parks and Recreation Commission, as will aj Stzlff, to
determine and assess the impact of these ;proposed pond elevations upon 'City
parkland. The other day, I had an opportunity to see the st a ng rm ?a 1
field. Frankly, from my observations, the proposed 930 high water levaticc"
is going to make even more of a severe impact on the park than I ''had fir-at
envisioned.
The Advisory Parks and Recreation Commission has taken a keen in t1,.!s
project from the very beginning. I certain that after they the
staking, their reaction will be very similar to mine, which is on of great
concern. The Commission understands that the storm waiter has to go ;cmepiac e
and that both JP - 8 and JP - 9 are part of the overall storm sewez~ pi ---n.
However, I don't believe anyone fully realized the i.Tapact on the park wh n
these two ponds were proposed for ponding. While I recognize the 930
elevation is a once-in-a 100 year occurrence, concern of the Commission is
going to be "yes, but look how often we get the 100 year storm, and how often
can we expect the water to go above the normal water elevation". I a sur
the Commission will have other questions relating to what alternatives flgl t
be available. Alternatives such as increasing/decreasing pipe sizing,
upstream ponding, etc. should be considered. I do not believe `Lhat we should
dismiss any alternative, because it is "toga expensive". Increa: led costs in
construction must be weighed against the potential for increased costs for
this park development. That is, while it may cost us more to increase a pipe
size to carry out the water faster, it may be more economical, in the long
run, when the time comes to develop the park.
At such time when you complete the review of the project and the relijiir•ary
engineering studies are completed, review by the Advisory Parks and Recreation
Commission can be scheduled. Please remember that the Advisory Comwi3jion
meets only the first Thursday of the month, and this should be cord; -dered in
your schedule.

Carnelian Park is programmed to receive site improvements, bet,iax t,ra wLth the

planning meeting is scheduled for February 10th, 7:30 P.M. at L'he Egan
Municipal Center, 3830 Pilot Knob Road. Members of the Advisory Parks, and

explain the park planning process, existing site constraints, and proposed
time line for planning and construction. Input from the neighborhood
residents concerning the amenities that they would like to see, as well as
