Dear idr. Hedges:
I am writing in regard to a zoning ordinance violation in your
community, the improper use of the residence at 4338 Metcalf
Drive for religious activities conducted by the Minnesota
Cambodian Buddhist Society. As a friend of several officers of
the organization, I was one of several Americans invited to a
meeting this week to discuss the problem. It was my (and the same
is true for the other Americans present) first knowledge oP the
problem. I was given the responsibility to convey to Eagan
officials the results of the meeting. I called Jim Sturm in
Planning and Paul Hauge, City Attorney. Mr. Hauge saggested I
outline our plans in a letter to you.
Apparently, the problem -- in the sense of objections from
neighbors -- has existed for a year or more. I am not sure I
understand all the history, but it is clear that there have been
complaints about parking and other issues. The Cambodians have
responded by renting other locations for the larger gatherings
that occur in connection with the three or four major religious
holidays of their faith. But because many of the people who might
come to the house, for purposes such as counseling and prayer
following the death of a loved one, are relatively new to our
ways, there is no way to insure they will always understand the
need to park only directly in front of the house, etc.
It is clear that the use of this location for this purpose is not
acceptable to nearby neighbors, and is a zoning violation. The
Cambodian Buddhist Society now understands this, and understands
that they must find a new location. It is reqrettable that they
did not involve some of their American friends in the issue
earlier. It is regrettable that they did not comprehend the
seriousness of the matter sooner. And it is clear that City staff
has been thorough in taking the usual steps to inform them of the
problem. In their defense it should be noted that they are new to
our culture. They often do not fu11y understand, though they will
usually act as if they do, to avoid giving offense to the
speaker. They intended no subterfuge in the use of this location,
having purchased it through a(Cambodian) real estate agent who
assured them it was an excellent location. In their country of

origin it is considered highly desirable to live near a temple,
so they had no clue that Americans would object or have rules
about such matters. And they have been through so much trauma and
loss that they sometimes react ta problems here by simply hoping
that the problems will go away if they mait long enough.
In the end, none of the reasons matter. The activities must move
to a suitable location. Steps are being taken to accomplish this
goal.
A committee is being formed, enlisting the aid of Minnesota's
religious leaders, people involved in refugee issues and others
who wish to insure that these people will have the opportunity to
practice their faith. Many have already agreed to join the
effort. You will receive a letter from them soon outlining the
steps to be taken. The goal is to move as quickly as is possible
to relocate where there will be na use conflicts. The Society has
substantial equity in the Metcalf Drive house and can bring
resources to the effort. But the goal is to solve the problem,
not merely displace it. So it is important that all necessary
steps be taken ta insure the next location is a proper one, with
no issues unresolved.
We appreciate the patience Eagan officials have exhibited in
dealing with this matter. We hope to assure you that a process ia
now underway that will resolve the problem. We have spoken to our
Cambodian friends about the necessity in the interim of being
especially careful to avoid causing further irritation to
neighbors. We hope you will bear with us while a happy ending to
this saga is engineered.

Dear Madam/Sir:
I am writing about the house at 4338 Metcalf Drive. The home is
considered a monastazy. Nearly every weekend some type of chureh
service is held at that address. I have seen a statue of Budha
be carried into this home.
This causes traffic problems on the street. Plus, some of the
drivers seem very inexperienced. There seems to be more than
one family living at this address.
As this home is in a residential zoning area, I feel they are
breaking some ordinance. A church would be considered some-
thing other than residential.
Please inform me as to what exactly are the laws, there are
several more homes in the area for sale, and Laotian are interested
in them as they want to be near their monastary. How many families
can live in one home? Many cars parked along the street on a
regular basis was one of the reasons we moved to the suburbs.
Should a child be hit by a car that is going or cominq to one
of these church services, I will be sure to hold the city part
responsible. Thank you for your consideration on this matter.

Dear Reverend Cheysathy:
The City of Eagan has received numerous complaints regarding
the residential house located at 4338 Metcalf Drive that is beinq
used as a church/temple. The City Code, intended to provide
for the health, safety and general welfare of all citizens, does
not allow this intense use in residential districts. The major
concern is the lack of adequate parking and the ability for emer-
gency vehicles to move throughout the area. Church/temples are
an approved use within the Public Facility (P.F.) district.
To gain a P.F. zoning, a full public hearing process and City
Council approval is necessary. Another alternative would be
requesting a temporary Special Permit for this temple use. This
would also require City Council approval.
If either one of these alternatives would be helpful to you,
contact the Eagan Planning Department at 454-8100 for further
information. The Planning Department will also be willing to
assist you in locating another site in an appropriate zoning
district.
In conclusion, using the single family home at 4338 Metcalf Drive
for this use is not allowed under Eagan City Ordinances. Please
discontinue this practice by [Vovember 24, 1986. The City does
and will enforce the Code to its fullest extent. We sincerely
hope you are able to find a suitable location for your group
gatherings.
