CIVIL-STRUCTURAL ENGINEERWG
At your request I visited subject site. I understand the
building was destroyed by fire last December. The debries has
been removed. You gave me a set of house plans. You plan to
construct a new house using the old basement and foundation as
much as is feasible. You asked me to indicate necessary repairs
for the concrete block walls, and therefore, my comments will be
limited to this part of the work. My visit.was made August 23,
1989.
The remaining basement is a walkout to the rear. It consists of
footings, 12 inch thick concrete block basement walls, and
concrete slab on grade. The house measures approximately 38 feet
by 24 feet plus an attached garage 24 feet by 30 feet.
Some concrete blocks have cracks in the webs. These blocks shall
be removed. Also, it is possihle that other hlocks have cracked
webs. To inspect all the blocks would require removal of the
wall which you are trying to save. I am recommending that you
spot check the bottom course. You can cut holes in the interior
face shell at the basement floor level. Holes to be 4 inches
wide by the height of the block and spaced 4 feet on center
horizontally. First hole may be 4 feet from end of building.
It is my opinion that the existing walls may have lost some
strength due to the fire, that any blocks with cracked webs
should be removed, that the walls may be repaired as indicated
below, and that the wall when repaired as indicated will have
adequate strength.
Repairs shall consist of the following:
1. Provide temporary bracing as necessary.
2. Cut inspection holes as indicated above, clean out the hole,
and inspect concrete blocks at bottom of wall.
3. Remove top 2 courses (3 courses at garage end) of concrete
block. Inspect blocks exposed at top of wall.

4. Remove any broken blocks or blocks with cracked webs.
5. Excavate earth from exterior of wall and straighten wall as
much as practicable. Fill cores and allow to cure before
backfilling. See item #7.
6. Install vertical reinforcement in wall. Reinforcement to be
#4 deformed bars grade 60 extending from footing to top of
wall. Bars to be located vertically in the wall, 4 feet on
center, near the inside face of the block? and in core
containi.ng the inspection hole. Also, one #4 bar to be
located at corners and at each end of walls.
7. Add additional conc;rete block courses to make clear wall
height not more than 7'-4" (7'-8" in garage). Provide bond
beam with 2#4 bars continuous at top course and at brick
shelf.
8. Cores with reinforcement to be filled solid with concrete
f'c=3,000 psi. Rear wall concrete blocks below basement
floor to be filled solid with concrete. Remove debries from
cores before filling.
9. I presume you will provide adequate floor diaphragm and
column footings.
10. Mortar joints containing cracks to be tuckpointed by
removing old mortar and installing new mortar f'c=1,500 psi.
New mortar to be pressed tight.

RE: `'4010 MICA TRAIL - WM GOINS PROPERTY
As you are aware, the Goins' residence had a fire on December 6,
1988. Since that time, the house has been boarded up and remains
in that condition. The Goins' have hired a public adjustor to deal
with their insurance company. The insurance settlement has not yet
been resolved.
With spring coming, neighbors are complaining. It looks like a
dangerous, or hazardous, building. This department has contacted

On April 12, 1989 a letter was sent to United Claims Service,
copying American Family Insurance Company and Mrs. Wm. Goins,
advising what action should be taken with this building (copy
attached). The Goins have until Tuesday, April 18, to respond to
this notice of their intent to reconstruct, or demolish, this
building. Unless such request is made, along with a timetable for
completion, City staff is requesting that this item appear on the
6:30 Department Head Business at the Tuesday night City Council
meeting to issue an order to abate this nuisance.

Dear Mr. Packkala:
The City of Eagan has determined that the Goins' building, as a
result of the fire damages, constitutes a hazard to public safety and
health.
The owners or agents of the owners of the building should apply to
the City for a building pezmit oc a demolition permit. Unless such
permit request is made by Tuesday, April 18, 1989, along with a time
table for completion, the City staff will request that the City
Council issue an order to abate th3s nuisance.
Pursuant to Minnesota Statutes S463.15 et seq., the City Council may
order the owner of the hazardous bnilding to correct the hazardous
condition or to raze or remove the building. if the owner does not
comply, the City will remove the hazardous building and place a lien
against the zeal estate on which the buildinq is located.

I atopped by your home with a member of the Eagan City Adminiatrative Staff on
July 31, 1986. I would like to thank you for your efforta in cleaning up the
property ae we had previously discusaed. I obviously hape that it will not be
necessary for ue to respond to similar complainta in the future.
The City hae also received complaints regarding the parking of your bus in the
backyard of your property. When you permitted me to walk through your
property with you, I obaerved that this bue wae properly licensed and I
understand it is operable as you had juet taken it out of state. This vehicle
ehould not be parked for extended periods of time on a City street. At this
time, I am not aware of an ordinance prohibition that would prevent you from
keeping the bus on your property. You are not being required to move it.
However, if you have some alternative location where you might store the
vehicle, I'm sure it would be appreciated by the neighbors.

It has come to the attention of the City of Eagan that you are presently
atoring unlicensed, unregistered or inoperable motor vehicles or appliances,
household furnishings or components of one of these or other refuse
constituting a health or safety hazard upon your property. Such storage is a
violation of Eagan brd'inance 10.51, JUNK CARS, FURNITURE, HOUSEHOLD
FURNISHINGS AND APPLIANCES STORED ON PRIVATE PROPERTY.
Section 10.51, reads as follows:
"It is unlawful to park or store any unlicenaed, unregistered or
inoperable motor vehicle, household furnishings, or appliances, or parts
or components thereof on any property, public or private, unless housed
within a lawfully erected building. Any violation of this section is
declared to be a nuisance and upon seven days written notice to the
owner, as ahown by the records in the office of the County Auditor, of
private premises on which such material is found, the City may remove the
same and certify the cost of such removai as any other epecial
assessment."
Section 10.21, reads as follows:
Subd. 1. "It is the primary responsibility of any owner or occupant of any
lot or parcel of land to maintain any weeds or grase growing thereon at a
height of not more than six inches; to remove all public health or safety
hazards therefrom; to install or repair water service linea thereon; and
to treat or remove insect-infested or diseased treea thereon."

Subd. 2. "If any such owner or occupant fails to assume the primary
responsibility described in Subdivision 1 of this Section, and after
notice given by the City Administrator has not within seven days of such

thus incurred shall be a lien upon such real eatate. The City Clerk-
Treasurer shall certify to the County Auditor of Dakota County a statement
of the amount of the cost incurred by the City. Such amount together with
interest shall be entered as a apecial assessment against such lot or
parcel of land and be collected in the same manner as real estate taxes."
This letter should be considered a notice to remove all unlicensed,
unregistered or inoperable motor vehicles, household furnishings, or
appliancea, or parta or components thereof on your property not housed within
a lawfully erected building or health or safety hazards or weeds or grass in
excess of 6 inches in height within seven days or the City shall remove those
articles and assess the cost to you. If, upon the expiration of the seven day
period of time, these articles have not been removed, the City will also cite
you for violation of Ordinance 10.51 and Ordinance 10.21, a misdemeanor under
the Code.

CITY OF EAGAN
IN THE MATTER OF THE HAZARDOUS BUILDING (ONE STORY WOOD FRAME
SINGLE FAMILY DWELLING) LOCATED AT 4010 MICA TRAIL.
Legally described as Lot 1, Block 11, CEDAR GROVE 5TH_ADDITIO?.
TO:
1. Pursuant to Minnesota Statutes, S§463.15 to 463.61 the
Council of the City of Eagan, having duly considered the matter,
finds the above describen building to be a hazardous building for the
following reasons:
a. The building has been severely damaged by fire.
b. The foundation walls lack structural integrity.
c. The supporting metal beams lack structural integcity.
d. The wood framework lacks structural integrity.
e. The floor, walls and rafters have suffered considerable
damage and are beyond repair,
f. The plumbing system, mechanical system and electrical
system are inoperable.
g. The home is in danger of collapsing.
h. The floor that remains is hanging and in danger of
collapsing.
i. There is a free access to the building and childten and
others have been entering the building.
j. The yard and building are strewn with rubbish and trash.
k. The west three-quarters of the building adjoining the lower
garage and upper family room is beyond the possibility of
economic repair.

2. Pursuant to the foregoing findings and in accordance with
Minnesota Statutes, S§463.15 to 463.261, the Council hereby orders
the record owners of the above hazardous building to repair and make
such buildin9 safe and not detrimental to the public health, welfare
and safety by makinq the following necessary repairs.
a. Secure the access to the premises.
b. Remove all junk, debris and trash from the area.
c. Repair the east one-quarter of the building consisting of
the lower garage and upper family room to comply with all
provisions of the Eagan Building Code.
3. Pursuant to the foregoing findings and in accordance with
Minnesota Statutes, S§463.15 to 463.261, the Council hereby orders
the record owners of the above hazardous building or his (their)
representative to raze and remove the west three-quarters of the
building adjoining the lower garage and upper family room within
forty-five (45) days of the service of this Order. The Council
further orders that all personal property or fixtures that may
unreasonably interfere with the razing and removal of the building
shall be removed within forty-five (45) days, and if not so removed
by the owner, the City of Eagan may remove and sell such personal
property oz fixtures at public auction in accordance with law.
4. The Council furthex ozdexs that unless such corrective action
is taken or an answer is served upon the City of Eagan and filed in
the office of the Clerk of District Court of Dakota County,

Minnesota, within twenty (20) days f rom the date of the service of
this Order, a motion for summary enforcement of this Order will be
made to the District Court of Dakota County.
5. The Council further orders that if the City is compelled to
take any corrective action herein, all necessary costs expended by
the City will be assessed against the real estate concerned and
collected in accordance with Minnesota Statutes, 5463.22.
6, The mayor, clerk, city attoxney and other officers and
employees of the City are authorized and directed to take such
action, prepare, sign and serve such papers as are necessary to
comply with this Order and to assess the costs thereof against the
real estate described above for collection along with taxes.

The City of Eagan has the right under Minnesota Statutes 5463.15 et
seq. to abate a hazardous building (see memo to Mike Dougherty dated
April 10 in file and letter to Mike Packkala also in file).
The procedural requirements of the statute are as follows:
1. The Council orders the owner of the buildinq to correct the
hazardous condition or to raze the building.
2. The order shall be in writing, recite the grounds thereforet
specify the necessary repairs and provide a reasonable time for
compliance. it shall also state that a motion for summary enforcement
of the order will be made to the District Court unless corrected
action is taken or an Answer filed within 20 days of service.
3. The order should be served upon the owner of record or the owner's
agent and upon the occupying tenant and any lien holders of record.
If the owner cannot be found, the order shall be served upon the
owner by posting it at the main entrance to the building and by fouc
weeks' publication.

The City of Eagan has determined that the Goins' building, as a
result of the fire damages, constitutes a hazard to public safety and
health.
The owners or agents of the owners of the building should apply to
the City for a building permit or a demolition petmit. Unless such
permit request is made by Tuesday, April 181 1989, along with a time
table for completion, the City staff will request that the City
Council issue an order to abate this nuisance.
Pursuant to Minnesota Statutes §463.15 et seq., the City Council may
order the owner of the hazardous buildin9 to corzect the hazardous
condition or to raze oz remove the building. If the owner does not
comply, the City will remove the hazardous builda.ng and place a lien
against the zeal estate on which the building is located.

no health officer has been appointed by the City of Eagan. I am attempting to
determine whether there is an individual who who could fill this capacity at
the County level. In the alternative, the City could contract with an
individual to act as health officer for this purpose. I will attempt to
advise you as to whether there is anyone at the County level that can fulfill
this position prior to the City Council meeting on July 15, 1986.

As you know, the City of Eagan has again received a complaint regarding the
Goina residence for junk violations. The initial complaint was with regards
to unregistered or inoperable vehicles. A notice pursuant to Eagan Ordinance
10.51 was served and, with one exception, these vehicles were removed. Upon
examination of the property by Kevin Eide, Sgt. Greg Johnson and Steve
Schwanke, significant additional junk violationa were observed. A second
notice was issued on June 23, 1986 and as we have not been able to obtain
actual service upon a resident there, we have been asked by the Police
Department as how to proceed.
We would recommend that you sign the attached notice which would be served by
first class mail, certified mail, and an attempt of personal service would be
made. If no one is home after several attempts of personal service, then the
notice would be posted on the premisea.
In addition, similar relief to that available under the Eagan Ordinance is
also provided under Minn. Stat. 145.22 for the abatement of nuisance, source
of filth or source of sickness. The nuisance, aource of filth or source of
sickness must be identified by the health officer. We would recommend that
the Eagan Health Officer review the property and we would go through the same
procesa of service for that notice. We would recownend the additional effort
of having the Health Officer examine the property because epecific atatutory
authority is provided to post the notice if personal service cannot be
obtained.
Upon the completion of ten days from posting of the notice signed by the
Health Officer, the City could then proceed to clean up the property. The
coet incurred can be assessed pursuant to Minn. Stat. 145.23.

Finally, we have learned that Thorp Loan and Thrift has a mortgage on the
property and we will contact Thorp and advise them that we believe the
property is abandoned and ask them to take posaesaion to the property and
clean it up. This may avoid the necessity of the City taking action to clean
up the property.

I made an on-site inspection at the above address today
and was pleased to find considerable progress had been made.
The old fence had been removed and a new one ccmpatible
with the neighbor to the south had been installed and paint-
ed in a matching color. An overhead garage door had been
installed on the opening on the tuck under garage, the fas-
cia board at the roofline of the addition had been put in
place and painted, and a large share of the backyard debris
which included many storm windows, automobile engine parts,
and used oil tanks, had disappeared. Mr. Goins assured
me that he would continue to improve his property.

to you concerning your property at 4010 Mica Trail. This letter is to
advise you that the condition of your property constitutes a public nuisance
and is in violation of Minnesota Statutes, Section 609.74 and the City of
Eagan Junk Ordinance. Furthermore, your building permit originally issued
August 6, 1974 has expired pursuant to the provisions of Ordinance No. 36
and a new permit must be obtained before you may complete the needed work.
Please contact the City Building Inspector, Dale Peterson at 1/454-8100 within
5 days of receipt of this letter to inform him as to what you intend to do to
r.ermedy the existing nuisance and the timeta6le for completion. Your failure
to act promptly to remedy these problems will leave the City no alternative
but to bring charges against you for the violations. Each day that the
nuisance exists is a separate violation, punishable by a maximum fine of
9300.00 and/or 90 days in jail or both.

I[ has come to the attention of the City of Eagan that you are preaently
etoring four unlicenaed, unregistered or inoperable motor vehiclea upon your
property. Such storage is a violation of Eagan Ordinance 10.51, JUNK CARS.
Section 10.51, in the relevan[ portion reade ae followe:
"It is unlawful to park or etore any unlicensed, unregietered or
inoperable mo[or vehicle...on any property, public or private, unlesa
housed within a lavfully erected buildiug. Any violation of thie aectian
is declared to be a nuisance and upon aeven daye written notice to the
ovner, as ehown by the records in the office of the County Auditor, of
private premiaes on which euch material is found, the City may remove the
same and certify the coet of auch removal ae any other epecial
asaessmeut."
An inoperable vehicle is defined in Ordinance Section 2.70 as lacking a vital
courponent part. In other worde, the vehicle lacka a par[ which is eseential
to the mechanical functioning of the vehicle such as the motor, drive train or
wheele.
Thie letter should he considered a notice to remove all unliceneed,
unregistered or inoperable motor vehiclea on your property not houaed within a
lavfully erected building within aeven daye or the City ahallremove thoae
vehicles and asseae the cost to you. If, upon the expiration of the eeven day
period of time, theae vehiclea have not been removed, the City will also cite
you for violation of Ordinance 10.51, a miademeanor under the Code.

At your request I visited subject site. I understand the
building was destroyed by fire last December. The debries has
been removed. You gave me a set of house plans. You plan to
construct a new house using the old basement and foundation as
much as is feasible. You asked me to indicate necessarp repairs
for the concrete block walls, and therefore, my comments will be
limited to this part of the work. My visit.was made August 23,
1989.
The remaining basement is a walkout to the rear. It consists of
footings, 12 inch thick concrete block basement walls, and
concrete slab on gx-ade. The house measures approximately 38 feet
by 24 feet plus an attached garage 24 feet by 30 feet.
Some concrete blocks have cracks in the webs. These blocks shall
be removed. Also, it is possible that other blocks have cracked
webs. To inspect all the blocks would require removal of the
wall which you are trying to save. I am recommending that you
spot; check the bottom course. You can cut holes in the interior
face shell at the basement floor level. Holes to be 4 inches
wide by the height of the block and spaced 4 feet on center
horizontally. First hole may be 4 feet from end of building.
It is my opinion that the existing walls may have lost some
strength due to the fire, that any blocks with cracked webs
should be removed, that the walls may be repaired as indicated
below, and that the wall when repaired as indicated will have
adequate strength.
Repairs shall consist of the following:
]. Provide temporary bracing as necessary.
2. Cut inspection holes as indicated above, clean out the hole,
and inspect concrete blocks at bottom of wall.,
3. Remove top 2 courses (3 courses at garage end) of concrete
block. Inspect blocks exposed at top of wall.

height not more than 7'-4" !(7'-8" in garage). Prov.ide bond
beam with 2#4 bars continuous at top course and at brick

8. Cores with reinforcement tolbe filled solid with concrete
f'c=3,000 psi. Rear wall concrete blocks below basement
floor to be filled solid with concrete. Remove debries from
cores berore filling. I

Dear Ms Larson:
At your request, I inspected the fire damage that had occurred at
the referenced address.
The house was a single story, wood framed structure, with a walk
out basement to the East. The house was constructed at two
different times. The South end of the house was the original
construction. To the North of the original structure a 24' by 24'
addition was placed. This addition consisted of a garage at the
lower, walk out basement level, and living space above the garage.
The fire had started in the South portion of the house at the lower
level. This portion of the house had a steel beam extending from
the south to the r.orth, this steel beam sugported the first floor
joists, and extended. from the south wall to steel columns and then
to what was the original north wall of the fiouse. This steel beam
was not fire damaged, 6ut it was twisted when the first floor joists
extending toi the west of the beam failed. The block basement walls
of the South portion of the house were not damaged by the fire,
and they can be reused. The basement concrete slab could not be
observed at the South portion of the house because of the debris,
but it is anticipated that this concrete floor was not damaged by
the fire. In addition the steel columns at the sppQ;, portion of the
house were not damaged.

The roof, the upper wood stud walls, and the first floor of the
South portion of the house must be torn down, and reconstructed.
The West basement wall must be temporarily braced at the first
floor level until the new first floor is i? place. This bracing should
be placed as soon as practical if the basement wall is to be reused.
The North portion of the house had severe fire damage to the roof,
and some of the interior walls. The East, West, and North exterior
walls of the North portion of the house were not damaged, and can
6e reused. The roof of the North portion of the house will be
required to be removed, and reconstructed. Only a small portion of
the first floor wood joists of the North portion of the house were
fire damaged. The condition of the wood flooring and subflooring
could be water damaged, and this should be investigated when the
debris is removed.
The garage level of the North Portion of the house was undamaged.
A steel beam thai extended from the East to the West wall, and
supported the first floor was undamaged. The concrete slab at the
garage floor was undamaged, and the block walls at the garage
level were not damaged by the fire.
The West, and North Garage block walls were in poor condition.
The workmanship was extremely poor. Weak, and cracked mortar
joints were very evident throughout these walls.. Because of the
structural condition of these walls it wili be necessary to
strengthen them prior to the recons[ruction of the North portion of
the house. These walls should also be temporarily braced as soon
as possible.

grossly oorTtamirsated soils had been rainoved. This amounted to be
approximately 2? to 3 cubic yaxrls of soil, which has beea stockpiled on site
and will be properly disposed of in aooox+danoe with applicable MPCA, Ooimty
and mmicipal rules, by Sunrise Constnuction when weather conditions perm;t
such activity.
Mie excavation was done by the builder (Sonny ICate, Smrise Construction) at
wz' requast and mcets our requirements at this time.

At the pretrial hearing on May 3, 1984, you entered a plea of guilty to the
charge of violation -of the Eagan Ordinances that relate to public protection
and junk. The Court agreed not to accept this plea and will disroiss the
case at the end of a one-year period if certain conditions are complied with.
Those conditions are as follows:
1. That the water tank you intend to utilize as a storage tank for solar heat
will be buried prior to June 7, 1984.
2. The addition to your home previously commenced will be finished prior to
June 7, 1984.
3. The frames for the greenhouse you intend to construct will be used to
actually construct a greenhouse prior to June 7, 1984, or, prior to that
date, these frames will be stored inside a structure.
4. The material that you have on your property for the construction of a deck
shall be used for the construction of a deck prior to June 7, 1984, or, in the
alternative, they will be stored inside a structure.
5. You will remove any remaining materials in your back yard prior to June
7, 1984.
6. You will remove the existing fence and replace it with a newly constructed
fence prior to June 7, 1984.
7. You will remove the gravel (which you intend to use for the construction of
a concrete floor) and perform the necessary seeding and landscape work, which
work will be commenced prior to June 7, 1984, but will not necessarily be
completed before that date.

8. You do not have any other junk ordinance type violations within the next
one year.
We did not discuss this matter at pretrial, but it is my understanding that
Dale Peterson may have discussed with you the necessity of obtaining permits
for the construction of some of the projects that you have outlined and you
should comply with all City permit requirements.
Judge Kalina has advised you that, in the event any of these conditions cannot
be complied with prior to June 7, 1984, you are directed to appear at 9:00 at
the Eagan Courthouse to provide the Court with an explanation. Please under-
stand that you should make every effort to comply with these conditions prior
to lune 7 as the Court would have the discretion at that time to accept your
plea of guilty and sentence you if it felt appropriate. Surely, in the event
that one or more of these conditions cannot be complied with on June 7, 1984,
but can be complied with very shortly thereafter, the Court might well provide
some additional time for you to complete this work.
I would like to thank you for your cooperation in resolving this matter and I
hope that this will end the differences that the City has had with you over
the last years.
