During the past few weeks, City staff has been working with the
Heinen Company who is planning an 8,000 square foot office and
warehouse facility at 3329 Mike Collins Drive.
The record plans prepared by your office do not specifically
reference a sewer service to the above-referenced parcels by
stationing in plan view or a riser in profile. There is some
symbol in plan view which references or indicates a riser
was/should have been constructed. I would like you to research
your records for any correspondence, etc., which requests that a
service not be constructed. Televising records do not show a
sanitary service to these lots.
Attached for your information is a copy of a letter from The Heinen
Company which City staff is preparing a response to.

I am writing you to state our extreme discontent with sewer access
conditons located at the above address.
It is our intention to construct an 8,000 square foot office and
warehouse facility on this site. The work required for connection of
sewer and water to the site is, in our opinion, excessive.
The main sewer line is located 35 feet below street level, and it
would seem that the City of Eagan did not have the foresight to put in
place a sewer tapping for the parcel on which we would like to build.
Since the City did not put this tapping in the sewer line, which is
located in the middle of Mike Collins Or., it will coat our firm an
additional $10,420.00 to dig down 35 feet and install a tapping for
sewer access which should already have been there.
In addition to this, you are requiring us to install a manhole riser
in our lateral connection for no apparent reason hut for the convenience
of the City. The installatiott of this portion will add an additional
$1,050.00 to our construction costs. To our knowledge, this is
neither an ordinance or a policy, nor was it required of any other
facility on Mike Collins Dr.
It is our contention that we are paying an amount of $2,052.00 to the
City of Eagan for "Sewer Access Charges", and the City is making it
our responsibility to make that access. What is the sewer access
charge for?
We have not disputed any requirements thus far in the permitting
process, and are willing to abide by any ordinances or policies that
are in effect to date, however with the unusual costs we are being
forced to absorh, we feel the need to ask the City to either waive tAe
Sewer Access Charge, absorb some of the tremendous financial burden
which we must carry, or, at the very least, waive or pay for the
manhole riser, which is for the convenience of the City, and currently
does not seem to be an ordinanae or written policy.
If need be, we ask that we be placed on the agenda to disauss our
position with the City Council.
Please let me know what can be done to rectify this matter as soon as
possible.

We have completed our review of the plans and speci5cations which were subtnitted in
pursuit of obtaining a building permit for the above-referenced project. The comments
listed below have been limited in scope to selected areas of special concern and are not
intended to comprise a comp]ete and exhaustive report. It is our hope that this report will
be of benefit to you in achieving a project that complies with the various state and local
codes, laws, and ordinances.
Because the code requires the project to be built in conformance with the apprwed
plans and specifications, the structural specifications must specify the appropriate
Uniform Building Code standards applicable to the project. Wherever other
nationally recognized standards have been adopted (or amended) by reference in a
building code standard, such other standards, when speciSed in the construction
documents, should be cross-referenced to the specific UBC standards.
2. Each sheet of the electrical drawings must be signed and certified as required by
Minnesota Rules, part 1800.4200.
3. Provide recycling space in accordance with Minnesota Rules, part 1305.1775. Please
note that such space must also comply with Article 11.201 (d) of the fire code.
4. Verify that the gas meter will be placed at least three feet from any source of ignition.
See Minnesota Rules, part 1346.2211. Verify that the gas regulator vent piping will
terminate a minimum of six feet away from openings into the building; see Minnesota
Rules, part 1346.2508 (g) 4.
5. In accordance with UBC, section 501, the occupancy of the vehicle wash area is
classified as a Group B, Division 1 occupancy and the warehouse and office areas are
classified as a Group B, Division 2 occupancy. Thus, as required by section 503 of the

building code, provide a one-hour fire-resistive occupanry separation with protected
openings between the Bl and B2 areas of the building.
6. Given an occupant load factor of 16 for Conference Room No. 203 (UBC Table 33-
A), this room may exit through onlv one intervening room which provides a d'uect,
obvious, and unobstructed means of travel to an exit corridor, ebt enclosure or until
an egress is provided from the building; see UBC 3303 (e).
7. The top of the handrails shall be placed not less than 34 inches nor more than 38
inches above the nosing of the treads; see UBC 3306 (j).
8. Verify that at least one water fountain will be handicapped accessible with the spout
within 33 inches of the floor; see UBC 511 (c).
9. Verify that sizes and clearances for handicapped accessible sanitation facilities,
including but not limited to 18„ ma)dmum urina] height, grab bar heights, etc., comply
with Minnesota Rules, parts 1340.0500 and 1340.0600.
10. Post live ]oads; comply with UBC 2304 (e).
11. In accordance with UBC section 1701, the actual construction of the proposed building
is classified as type II-N, although type V-N construction would be permitted by code.
12. Show how, in the vehicle wash area, compliance with ventilation requirements will be
achieved; see Minnesota Rules parts 1305.1900 and 7670.0450.
13. Verify that door lOlA contains safety glass; see UBC 5406 (d).
14. The building drain must be vented within 25 feet of the inflammable waste trap; see
Minnesota Rules, pan 4715.1120.

In response to your letter of November 27, 1991 regarding the
above project, I have made the following revisions:
1. Reference to applicable codes have been noted on Drawings.
2. Electrical Drawings have been properly certified.
3. Recycling space has been noted on Drawings.
4. See Mechanical Drawings.
5. Wall separating Bl and B2 areas has been modified by adding
a layer of 5/8" firecode gypsum board to each side to give a
one-hour fire-resistive rating. See detail 2/A8.
6. A future rated corridor for egreas from second floor Confer-
ence Room #203 has been shown on the ?rawings. Heinen
Company now has only seven employees, so the occupant load
of this room will not exceed the ten person limit until the
second floor is finished.
7. Handrail dimensions have been noted on Drawings. See 4/A9
and 5/A9.
8. Height of water fountain has been noted on Drawings. See
1/A12.
9. Locations of handicapped accessible sanitation facilities
