On November 1, 1977, the DisCrict Court af+tion concerning the Mattdamus Ac ion
brought by Mr, and Mrs. Fendrick to spli( Lot 14, Block 3, bresr Ridge???ition)
into two separate lots of approxi.mately 1,g00 square feet each, was heard befo4e
Judge Lenertz in Dakota County District Court. We spent most of the day in
trial on the case, and it would have extended a great deal longer if we'd not
heen able to agree upon the admission of quite a few documents, etc. I called
Alyce Bo1ke and Dale Peterson, and two neighboring property owners also testi-
fied on our behalf, including Bob Swenson, who has been active in the neighbor-
hood group in Crest Ridge Addition for several years. Bob had contrihuted a
goa3 deal of material and assistance some months prior to the trial and wanted
to continue being active in it.
Unfortunately, the water problems which were quite important in that area
according to our building inspector and our engineer, are correctible, and
one neighboring property owner also testified to that effect.
You might recall that the City Council acted both under the hardship provisions
of Ordinance 10 and Ordinance 52 in denying the request, and the Council's action
was a 4 to 1 vote. A motion made at that same Council meeting to grant approval
of a plat if submitted lost on.a 2 to 3 vote.
It was our contention that at the hearing, the only hardship shown by the
applicant was the fact that he was not able to split the lot into two
separate parcels and also he indicated that he did not want to maintain the
undeveloped West half of the lot,
Judge Lenertz called me on November 14 and stated he would rule in favor of
Eagan and dismiss the Fendricks' petition. I have prepared all the papers
to dispose of the case and forwarded them to the court and am enclosing a
copy of the Findings of Fact, Conclusion of Law, and Order for Judgment.
A copy of this letter is also being sent to Bob Swenson with a thank you to
both him and his wife and the other neighbors o w re most cooperative in
successfully concluding the case. ,
