The City recently noticed your yard is approaching its finai grade in order to
accommodate sod. As you may be aware, the City of Eagan has an ingress/egress
easement along the sideyard as shown in the attached letter dated April 7, 1994 to David
Price of McDonald Construction. David Price stated that the easement was graded
according to the City's request a couple of weeks ago. However, it appears to have
recently changed. Therefore, the City is requesting that you have this 12' area benched
in allowing for City vehicles aiong the property line prior to the sodding of your yard.
It is not anticipated that this area would be used often, but does need the access if
necessary.

As you may be aware, Lot 14, Block 1, Biackhawk Ponds has a 12, ingress and egress
easement as shown on the attachment. Prior to home construction the City had an
access benched in in order to allow city vehicles access to utilkies for the purpose of
maintenance. The City is requesting that you have this area restored now that the home
construction is complete. This can be done in conjunction with the final grading of Lot
14, but must be a level area 12, wide and free of trees, fences or other landscape
materials. This area can be sodded and maintained by the properry owners as a yard
since it is not anticipated to get much use.

Recently, the City Engineering Division has negotiated an "access"
easement affecting the above-referenced lots to provide adequate
access for ingress and egress by our maintenance personnel for the
existing utilities located within utility easements dedicated for
the above-referenced lots.
This Access Easement providesfurther restrictions on the use of the
easement by precluding the installation of any fence, landscaping,
retaining wall, etc. that would obstruct the accessibility of our
maintenance personnel and equipment.
With the dedication of these access easements from the developer,
they have specifically requested that the City make every effort
to inform future owners of these lots of the restrictive conditions
associated with this Access Easement. Therefore, I would
appreciate it if you would put a special notation in your files
that, with the issuance of the building permit for these identified
lots, a copy of the Access Easement be given to the applicant.
Your anticipated cooperation in complying with this request will
be greatly appreciated by the developer and the Public Works
Department in helping to inform our future citizens of issues that
directly aPfect one of their major investments.

Dear Tom,
Enclosed are the executed and notarized Access Easements for Lot
14, Block 1, Blackhawk Pond. In my letter dated July 17, 1989, I
also requested that the City of Eagan vacate the existing easement
on Lots 12 and 13, Block 1, in conjunction with the filing of the
easement on Lot 14, Block 1, Blackhawk Pond.
I also requested that the City of Eagan make every effort to inform
the future homeowners of the access easement on Lot 14, Block 1
and Lots 24 and 25, Block 1, possibly by noting it when the
building permit is executed. Meritor Development Corporation will
also make every effort to inform the future homeowners of the
existing access easements.
If it is the City of Eagan's intention to conform to these
requests, please proceed with the filing of the easement and then
verify these requests in the form of a letter.
If it is not the intention of the City to conform to these
requests, please hold the easement agreement and call me so we can

corporation, herein referred to as "Landowner" and the CITY OF
EAGAN, a municipal corporation, organized under the laws of the

That the Landowner, in consideration of the sum of One Dol.lar

Dear Paul:
In accordance with your letter of July 17th, enclosed please find
the legal documents that must be executed in order to properly
convey the access easement over the, above-referenced lot as
previously discussed. In consideration for executing and
dedicating this access easement as described, the City of Eagan
hereby provides assurances that the property owners of Lots 12 and
13, Block 1 will be able to install fence along their common lot
line without any objections from the City of Eagan. If, at some
future date, the City finds it necessary to remove this fence to
perform necessary maintenance and/or repair work, the City will
assume all costs associated.for restoring the property to an equal
or better condition prior to the initiation of such maintenance
activities.
When properly executed and notarized, please return them to my
attention for proper recording at the County. At that time, the
City will reschedule consideration for adjustment to the final
assessment roll for Project 534 (Blackhawk Ponds-Watermain) as
previously discussed in my letter of July 23, 1989.
