On the common lot line between the two above referenced properties,
there is a drainage and utility easement and an ingress/egress
easement in favor of the City of Eagan. Please refer to the
enclosed documents.
The drainage and utility easement is in place for the existing
storm sewer underground and to also allow for overland drainage in
case the outlet of the pond is blocked. In order to allow for an
emergency overflow from the pond, the high point on the common lot
line must be the top of the curb on Murphy Parkway.
The ingress/egress easement was established to allow the City of
Eagan access to the storm pond behind these houses. It is centered
on the lot line, encroaching 7 1/2 feet into the properties on
either side. When you do the final grading on your lot, you must
allow a flat area of 7 1/2 feet on your side of the property to
allow for access to the pond as per the ingress/eqress easement.
The adjacent property is now doing their final grading and
installing a sprinkler system. They would like to cooperate with
you in establishing the grade on the common lot line.

easement by precluding the installation oP any fence, landscaping,
retaining wall, etc. that would obstruct the accessibility of our
maintenance personnel and equipment.
With the dedication of these access easements from the developer,
they have specifically requested that the City make every effort

associated with this Access Easement. Therefore, I would
appreciate it if you would put a special notation in your files
that, with the issuance of the building permit for these identified
lots, a copy of the Access Easement be given to the applicant.
