corpcr.aeion ("Grantoc"), and the CITY Of EA6AN, a Minnesota
municipal corporation ("Grantee•).
The Grantor, fdr good and valuable considecation paid by the
Grantee, the receipt and sufficiency of which is hereby_
acknowledged, grants to the Grantee a permanent road construction
ar.d conservation easemen " as that term is defined 3n this
instrument, over, under and across the pcemises described in the
attached Exhibit "A" ("SubjeCt Property"). 1. Grantor, for itself, its heirs, successors and assigns,
agrees that the following are prohibited, without prior written
consdent of the Gcantee, on the Subject Property:
A. Constructing, installing, storing or maintaining
anything made hy man, including but not limit=d to
buildings, structures, fences, walkways, clothesline
poles, and playground equipment.
B. Parking of recreational vehicles.
C. Vegetable gacdens.
D. Storage of firewood.
E. Clear-cutting or removal of native vegetation.
2. Grantor, its heirs, successors and assigns, may establish
and maintain a lawn in the conservation easement area, as well as
other plant material which is approved in advance in Nriting by the
Dicector of the Eagan Park Department.

3. Grantoc, for itself, its heirs, successors and assigns,
further grants the Grantee the right, after giving the owner or
occupant reasonable notice, to enter upon the Subject Property at
any time to enforce compliance with the terms of this instrument.
9. Grantee shall construct and maintain the slopes and fills
necessacy for the construction of a road to Blackhawk Park adjacent
to subject propecty in addition to any retaining walls necessary for
said roa9 as described in the construction plan attached hereto as
Exhibit "8". Further, grantee shall provide and maintain existing,
as well as proposed, plant matecials as described in the landscape
plan attached hereto as Exhibit "C". Grantee shall be responsible
for erosion control within the easement area.
5. This Easement is supplementacy to the platted drainage an9
utility easement and does not supersede or replace it.
