1. Grantor, for itself, its heirs, successors and assigns,
agrees that the following are prohibited, without prior written
consdent of the Grantee, on the Subject Property:
A. Constructing,. installing, storinq or maintaining
anything made by man, including but not limited to
buildings, structures, fences, walkways, clothesline
poles, and playground equipment.
B. Parking of recreational vehicles.
C. Vegetable gardens.
D. Storage of firewood.
E. Clear-cutting or removal of native vegetation.
2. Grantor, its heirs, euccessors and assiqns, may establish
and maincain a lawn in the conservation easement area, as well as
other plant material which is approved in advance in writing by the
Director of the Eagan Park Department.

3. Grantor, for itself, its heirs, successots and assigns,
further grants the Grantee the right, after giving the owner or
occupant reasonable notice, to entec upon the Subject Property at
any time to enforce compliance with the terms of this instrument.
4. Grantee shall construct an8 maintain the slopes and fflls
necessary for the construction of a road to Blackhawk Park adjacent
to subject property in addition to any rataining walls necessary for
said roa9 as described in the construction plan attached hereto as
Exhibit "B". Further, grantee shall provide and maintain existing,
as well as proposed, plant materials as described in the landscape
plan attached hereto as Exhibit 'C". Grantee shall be responsible
for erosion control within the easement area.
