This letter is a follow up from our last discussion from last week regarding ( 5,
1, Blackhawk Ponds) address is 1638 Murphy Parkway, Eagan MNSS122. I wo` uld
like the city of Eagan to deed over the front portion of my yazd, we both agreed that
this portion has no use or value to the city, but it would give me a 30 ft. front yard like
the rest of my neighbors. The closing of this home will be on April 11, 1991. If there
is any way in which we could resolve this prior to closing I would greatly appreciate it.
I would be happy to attend any council meetings if you need me to.

property is through a public hearing process held before the City Council. Enclosed is an
application for that process, which is scheduled through the City's engineering department.

This letter is also intended to act as written notice that all signage for the hom?at 4122
Pennsylvania Avenue in the Stafford Place Addition must be removed immediately: kingle-
family zoning districts do not allow advertising signs other than one 4 x 4 for-sale or for-rent
sign. The use of a model home is also not a permitted function in a single-family district.

APPLICATION SUMMARY: An application has been submitted requesting Variances
from the south and west property lines to allow a home to be constructed 15 feet from
those property ]ines. This unique lot is the first ]ot on the right side of Murphy Parkway
as you enter the Blackhawk Pond addition.
COMMENTS: The lot in question has several distinctive characteristics that include
substantial mature vegetation, severe slopes, and an entire south property line abutting a
?MnDot freeway right-of-way. The City code requires a minimum 50 foot setback from an
interstate right-of-way. Adhering to this setback would require a considerable and
unnecessary amount of grading which would result in the loss of significant mature
vegetation, some of which is oak trees.
The southern property line essentially acts as a side yard and, as proposed, the home
wou]d exceed the normal setback requirement of 10 feet. The home would also be over
200 feet from the shoulder of the freeway.
The west property line wil] act as the front yard. The established setback along Murphy
Parkway is 30 feet and the proposed location maintains that setback.
The Variance is only due to the MnDot right-of-way that provides access to the
subdivision. The distance to the curb will be consistent with all other homes along that
street. If approved, this Variance shall be subject to the following:
1. Snow fencing shall be installed in accordance to the proposed site plan exhibit to
ensure that the construction limit would be adhered to and that the trees would be
protected prior to any grading or construction on this lot.
2. All applicable ordinances shall be adhered to.
