The following represents the questions as given to this office by Mayor Blomquist and answers as prepared by the City Staff. Question 1: Would the City consider designating a part of the Zilka property that is located southeast of I-35E and Cliff Road as parkland? Answer: The neiqhborhood park for the northeast 1/4 of Section 32, which includes many of the Ridgecliff Additions and other developments adjacent to Galaxie Road south of Cliff Road, has been satisfied with the development of Ridgecliff Park. The City's Master Park Plan Policy is to dedicate 10 acres as active neighborhood park which was satisfied in the development of Ridgecliff Park. It is not anticipated that any additional land will be acquired for parkland, including the Zilka property, in this general area. Question 2: What are the commercial uses for a limited business zoning district? Answer: Permitted uses in a limited business district include the following: 1) municipal buildings where the use conducted is customarily considered to be an office use; 2) professional offices, banks, and savings and loans; 3) offices of a general nature where the operations do not include retail sales or warehousing from the site; 4) clinics for human care; 5) institutional uses: library, swimming pool, church, public schools, religious ce.nters, health centers and community building; 6) funeral homes and mortuaries; and 7) amusement devices not to exceed three machines at one license location and which shall not be located within 200 feet of another license location. Question 3: Would the City consider rezoning the property? Answer: The present zoning is agricultural. Typically, a city council will not initiate a rezoning unless the city has ownership of the property such as a tract of land that is rezoned to a public facilities for a park, a fire station, or some other municipal use. Question 4: Does the City Council feel the Zilka property should be allowed as a commercial development? Further, what is the total acreage for this parcel? Answer: The City Council has not considered any specific development plans for this property to date. However, the zoning and comprehensive guide plan designation do designate commercial use for the entire property. The total acreage is approximately +/- 20 acres. Question 5: Is there a stipulation on parcel 010-01 (as outlined in red on the attached section map) that will not allow that property to be sold and developed as commercial property? Answer: The City Attorney has reviewed the Ridgecliff Addition Declaration of Covenants, a copy is attached for yout review, and there was no inclusion of fhat parcel in these covenants. However, the City Attorney has reviewed the title to that parcel of property and the title specifically states that parcel 010-01 must be developed for a residential use. The specific residential use has not been determined to date. There is also some question as to which lots were impacted 6y the Ridgecliff Addition covenants and the City Attorney has outlined in yellow those areas that are covered by the covenants and restrictions as presented. Please refet to that attachment. Question 6: What is the Comprehensive Guide Plan designation for the'Zilka property? Answer: That property was designated for a limited business; however, the City is giving consideration to a comp guide plan update which would redesignate the property as CBD (Commercial Planned Development). This type of designation will provide more flexibility to the City and adjacent neighborhoods during the development process. LETTER TO MR TWADDELL JANUARY 13, 1987 PAGE THREE Question 7: Is an EIS required for the 20-acre site and are there other environmental permits necessary when development occurs? Answer: An EAW (Environmental Assessment Worksheet) would not be required unless minimum/mandatory thresholds or requirements are met such as a 300,000 square-foot building. An EIS (Environmental Impact Statement) is generally required if a building is in excess of 700,000 square feet. It is not antici- pated that this development will generate a need for either an EAW or EIS. However, this assumption is based on the fact that the City has not received any development plans for that parcel. According to the Plartning Department, there may be some Minnesota Pollution Control Agency requirements depending upon the proposed project. Question 8: Will sound barriers be required and, if so, will MnDOT construct the structure at State or Federal Cost? Answer: According to Federal transportation requirements, noise bartiers are only constructed adjacent to freeways when a residential development exists prior to the construction of the freeway. If noise bartiers were to be constructed on the Zilka property, it would be at the expense of the developer. Question 9: Is the City monitoring the clutter of advertising signs at the intersection of Blackhawk and Cliff Roads? Answer: The City is presently reviewing its temporary advertising sign ordinance and is planning to adopt City policy that will severely restrict the numbet of temporary advertising signs by the designation of directional signs (according to City standards) throughout the community. Temporary advertising signs are allowed only at Blackhawk and Cliff Road if a sign permit exists on the sign. Otherwise, the sign should be removed by the owner or the City Inspection Department. Mr. Doug Reid, Acting Chief Building Inspector, will review those signs to determine if certain signs are in non-compliance. Question 10: If roads are upgraded, who pays for improvements? Answer: Normally, iE an interior collector road is widened or improved, the benefitted properties are assessed. In order to be assessed, a residential property owner must have direct access to the roadway and receive some type of benefit from the improvement.
