Dear Mr. Twaddell:
As a result of a neighborhood meeting held in your home on
Sunday, January 4, 1987, and attended by Mayor Blomquist, a list
of questions was presented to this office for review and comment.
The following represents the questions as given to this office by
Mayor Blomquist and answers as prepared by the City Staff.
Question 1: Would the City consider designating a part of the
Zilka property that is located southeast of I-35E and Cliff Road
as parkland?
Answer: The neiqhborhood park for the northeast 1/4 of Section
32, which includes many of the Ridgecliff Additions and other
developments adjacent to Galaxie Road south of Cliff Road, has
been satisfied with the development of Ridgecliff Park. The
City's Master Park Plan Policy is to dedicate 10 acres as active
neighborhood park which was satisfied in the development of
Ridgecliff Park. It is not anticipated that any additional land
will be acquired for parkland, including the Zilka property, in
this general area.
Question 2: What are the commercial uses for a limited business
zoning district?
Answer: Permitted uses in a limited business district include
the following: 1) municipal buildings where the use conducted is
customarily considered to be an office use; 2) professional
offices, banks, and savings and loans; 3) offices of a general
nature where the operations do not include retail sales or
warehousing from the site; 4) clinics for human care; 5)
institutional uses: library, swimming pool, church, public
schools, religious ce.nters, health centers and community
building; 6) funeral homes and mortuaries; and 7) amusement
devices not to exceed three machines at one license location and
which shall not be located within 200 feet of another license
location. There are conditional uses for a number of uses which

ace outlined on the attachment referred to as Addendum 1 and
taken from the City's land use regulations which is the 2oning
Ordinance.
Question 3: Would the City consider rezoning the property?
Answer: The present zoning is agricultural. Typically, a city
council will not initiate a rezoning unless the city has
ownership of the property such as a tract of land that is rezoned
to a public facilities for a park, a fire station, or some other
municipal use.
Question 4: Does the City Council feel the Zilka property should
be allowed as a commercial development? Further, what is the
total acreage for this parcel?
Answer: The City Council has not considered any specific
development plans for this property to date. However, the zoning
and comprehensive guide plan designation do designate commercial
use for the entire property. The total acreage is approximately
+/- 20 acres.
Question 5: Is there a stipulation on parcel 010-01 (as outlined
in red on the attached section map) that will not allow that
property to be sold and developed as commercial property?
Answer: The City Attorney has reviewed the Ridgecliff Addition
Declaration of Covenants, a copy is attached for yout review, and
there was no inclusion of fhat parcel in these covenants.
However, the City Attorney has reviewed the title to that parcel
of property and the title specifically states that parcel 010-01
must be developed for a residential use. The specific
residential use has not been determined to date. There is also
some question as to which lots were impacted 6y the Ridgecliff
Addition covenants and the City Attorney has outlined in yellow
those areas that are covered by the covenants and restrictions as
presented. Please refet to that attachment.
Question 6: What is the Comprehensive Guide Plan designation for
the'Zilka property?
Answer: That property was designated for a limited business;
however, the City is giving consideration to a comp guide plan
update which would redesignate the property as CBD (Commercial
Planned Development). This type of designation will provide more
flexibility to the City and adjacent neighborhoods during the
development process.

Question 7: Is an EIS required for the 20-acre site and are
there other environmental permits necessary when development
occurs?
Answer: An EAW (Environmental Assessment Worksheet) would not be
required unless minimum/mandatory thresholds or requirements are
met such as a 300,000 square-foot building. An EIS
(Environmental Impact Statement) is generally required if a
building is in excess of 700,000 square feet. It is not antici-
pated that this development will generate a need for either an
EAW or EIS. However, this assumption is based on the fact that
the City has not received any development plans for that parcel.
According to the Plartning Department, there may be some Minnesota
Pollution Control Agency requirements depending upon the proposed
project.
Question 8: Will sound barriers be required and, if so, will
MnDOT construct the structure at State or Federal Cost?
Answer: According to Federal transportation requirements, noise
bartiers are only constructed adjacent to freeways when a
residential development exists prior to the construction of the
freeway. If noise bartiers were to be constructed on the Zilka
property, it would be at the expense of the developer.
Question 9: Is the City monitoring the clutter of advertising
signs at the intersection of Blackhawk and Cliff Roads?
Answer: The City is presently reviewing its temporary
advertising sign ordinance and is planning to adopt City policy
that will severely restrict the numbet of temporary advertising
signs by the designation of directional signs (according to City
standards) throughout the community. Temporary advertising signs
are allowed only at Blackhawk and Cliff Road if a sign permit
exists on the sign. Otherwise, the sign should be removed by the
owner or the City Inspection Department. Mr. Doug Reid, Acting
Chief Building Inspector, will review those signs to determine if
certain signs are in non-compliance.
Question 10: If roads are upgraded, who pays for improvements?
Answer: Normally, iE an interior collector road is widened or
improved, the benefitted properties are assessed. In order to be
assessed, a residential property owner must have direct access to
the roadway and receive some type of benefit from the
improvement.

or altered on any lot nearer to any street than the
minimum building setback lines unless similarly
approved. Approval shall be as provided in Paragraph
13 hereof. No dwelling shall be permitted on any lot unless the
ground floor area of the main structure, exclusive of
one-story open porches and garages, has a ground floor
area of not less than 800 square feet in the case of

the case of a dwelling of more than one story.
4. No building shall be located nearer than 25 feet to a
front lot line, nor nearer than 20 feet to any side
street line, nor nearer than 9 feet to any interior

not be nearer than 4 feet to any interior lot line.
For the purpose oE this covenant, eaves and steps
shall not be considered as part of a building,
provided, however, that this shall not be construed to
permit any portion of a building on a lot to encroach
upon another lot.
5. No sign of any kind shall be displayed to the public
view on any lot except one professional sign of not
more than one square foot, one sign of not more than
five square feet advertising the property for sale or
rent, or signs used by a builder or the original
developer, U. S. Home Corporation, to advertise the
property during the construction and sales period.
6. No animals, livestock or poultry of any kind shall be
raised, bred or kept on any lot, except that dogs,
cats or other household pets may be kept, provided
they are not kept, bred, or maintained for any commer-
cial purposes. No part of the individual lots, boule-
vards or parks shall be used at any time for the
storage or abandonment of junked automobiles'or other
motor equipment.
7. No lot shall be used or maintained as a dumping ground
for rubbish, trash, garbage or other waste. Garbage,
rubbish and trash shall not be kept on said premises
except in sanitary containers. All incinerators or
other equipment used or kept for the storage or dispo-
sal of such material shall be kept in a clean and
sanitary condition.
8. Except as approved by the Architectural Control
Committee, no sod, soil or gravel shall be sold or
removed from the premises in this subdivision and all
soil or gravel available;from any excavation for the
construction or alteration of a residence or any
appurtenance on any lot and by whomsoever owned shall
be hauled and disposed of at other points within the
boundaries of the subdivision at the disctetion of the
Architectural Control Committee.
9. No lot shall be re-subdivided into nor shall any
dwelling be erected or placed on any lot having an
area of less than 7,500 square feet. In the event any
lot is so subdivided, the restrictions contained
herein shall apply to the lot lines of said lot as
re-subdivided.
10. Easements for installation and maintenance of utilities
and drainage facilities are reserved as shown on the
tecorded plat and over the rear five feet of each lot.
Within these easements no structure, planting or other
material shall be placed or permitted to remain which
may damage or interfere with the installation and

maintenance of utilities or which may change the
direction of flow or drainage channels in the
easement, or which may obstruct or retard the flow
of water through drainage channels in the easements.
The easement area of each lot and all improvements in
it shall be maintained continuously by the owner of
the lot, except for those improvements for which a
public authority or utility company is responsible.
11. No noxious or offensive activity shall be carried on
upon any lot nor shall anything be done thereon whcih
may be or may become an annoyance or nuisance to the
neighborhood.
12. No structure of a temporary character, trailer,
basement, tent, shack, garage, barn or other building
shall be used on any lot at any time as a residence,
either temporarily or permanently.
13. The Architectural Control Committee is composed of
Gary W. Thompson and Robert Carlson. The Committee
may designate a representative to act for it. Zn the
event of the death or resignation of any member of the
Committee, the remaining member shall have full
authority to designate a successor. Neither the mem-
bers of the Committee nor its designated represen-
tative shall be entitled to any compensation for
services performed pursuant to this covenant. At any
time, the then record owners of a majority of- the lots
in said subdivision shall have the power, throUgh a
duly recorded instrument, to change the membership of
the Committee or restore to it any af its powers and
duties, The Committee's approval or disapproval as
required in these covenants shall be in writing, and,
in the event the Committee or its designated represen-
tative fails to approve or disapprove within thirty
days after plans and specifications have been sub-
mitted to it, or in any event if no suit to enjoin the
construction has been commenced prior to the comple-
tion thereof, approval will not be required and the
related covenants shall be deemed to have been fully
complied with,
14. No live trees shall be removed, damaged or altered in
appearance except for initial construction of single
family homes, attached garages and initial establish-
ment of private yard areas by the original developer,
U. S. Home Corporation, its successors and assigns.
Nothing in this provision, however, shall prevent
careful removal of dead or diseased limbs of said
trees.
15. These restrictions and covenants are to run with the
land and shall be binding upon all parties and all
persons claiming under them for a period of thirty
years from the date these covenants are recorded,
after which time said restrictions and covenants shall
be automatically extended for successive periods of
ten years unless an instrument signed by a majority of
the then owners of the lots has been recorded agreeing
to change said covenants in whole or in part.

16. If there shall be a violation or an attempt to violate
any of these covenants or restrictions, it shall be
lawful for any other person or persons owning any real
estate situated in this subdivision to prosecute any
proceedings at law or in equity against the person or
persons violating or attempting to violate any such
covenant or restriction, and either to prevent him or
them from so doing or to recover damages or other dues
far such violation.
17. Invalidation of any of these covenants oc restrictions
by judgment or ceurt order shall in nowise affect any
of the other provisions which shall remain in full
force and effect.
