Enclosed please find copies of Steve Schwanke's correspondence of
early 1986 concerning Nicols and Silver Bell Roads. As I indicated
on the phone and as the letters point out, the possibility of a
road connecting the west side of Cedar A.vemie with Nicols Road is
a concept only. The only thing which is certain is that if it were
to be built, it would pass under the freeway parallel to the
railroad tracks through the same underpa.ss. Beyond that, nothing
is certain.
At the present time, any such road is only a possibility for the
future. No decisions about alignment have been made nor would they
be made until such time as development activity creates the need.
At that time, design decisions woulci include which rights-of-way
and alignments to use and what size such a road would be.
Moreover, if such a road were to be developed, it would require
public hearings in which all affect:ed property owners would be
noticed.

This letter is in response to our telephone conversation of the
other day and as a follow-up to a December 10, 1985 letter
regarding outside storage at the Seneca Waste Treatment Plant
meterin9 station located on Nicols Road.
On November 12, 1985, Mr. Lester Spencer of 3786 Nicols Road,
contacted the City of Eagan regarding the outside storage of
miscellaneous material at the above sited metering station of the
Seneca Waste Treatment Plant. Pursuant to several negotiating
sessions, you agreed to clear the site of all outside storage by
June 1, 1986. A site review conducted on June 25, 1986 revealed
that all materials stored outside on the metering plant premises
had been removed and the site restored to a clean and orderly
fashion.
i would like to take this opportunity to thank you for your
cooperation regarding this matter and for an attitude that is
concerned about maintaining the quality of life in Eagan's
neighborhoods. You are to be commended for making a special
effort to resolve a difficult issue that had many extenuating

Dear Steve: _
We want to take this time to -thank you for all your efforts in
working with the Seneca Metro Waste Plant personnel in getting
them to clean up their metering station site, located on Nicols
Road just north of the junction of Nicols and Silver Bell Road.
For over two years, we and the Spencers, have tried appealing to
various people at the Seneca plant to clean up the site. It wasn't
until we went through city hall channels (Mayor Bea Blomquist to
Dale Runkle to you) did we finally see resolution.
The lot is now completely cleaned up and is quite a pleasing site.
Many of the people who regularly walk, jog, or bike on Nicols Road
have commented on the welcomed improvement of the site.

On March 19, 1985, the Metropolitan Council notified the Corps of Engineers
that we had "no comment" on the Section 404 permit application. Based on your
letter, staff did additional research and recommended that a second letter be
sent to the Corps of Engineers recorr¢nending against this permit. I have
enclosed a copy of my letter of May 20, 1985 that has been sent to the Corps of
Engineers.

On Mar. 19, 1985, a statement of "no comment" was sent to the Corps
pertaining to the above referenced Section 404 permit review. Since
that time, the Metropolitan Council has re-evaluated its position in
light of facts it was unaware of at the time of review, specifically,
the fact that Harnack Creek is a trout stream and that the fill could
damage Nicol's Meadow Fen, one of the few in the Metropolitan Area,
unique to the Minnesota River Valley.
The Council has several current policies and some under revision that
apply to this project and that direct staff to negatively review this
project. The policies are:
Water Resources Chapter No. 14:
... give priority to non-structural flood protection mea-
sures that preserve natural resources and minimize increases
in flood flow peaks or annual runoff. Such natural features
as wetlands..should be maintained in their natural state to
enable them to perform their natural drainage, storage and
wildlife functions...
Protection Open Space Chapter (currently an inactive chapter
to be combined with new Water Resources chapter) No. 17:
Alterations which would inhibit the role of wetlands in the
hydrologic system or an ecological system should not be
allowed 6y the unit of government having jurisdiction.
Protection Open Space Chapter No. 44:
Alterations or developments adversely affecting land con-
taining unique or endangered species should be prohibited by
the unit of government having jurisdictional responsibili-
ties.

Water Resources Management, Part 2, draws on the results of
the Council's Section 208 water quality studies, which found
dramatic water quality and quantity benefits of wetlands,
No. 58:
Watershed management plans should give preference to non-
structural management practices and should make every effort
to retain existing wetiands, drainaaeways...in a condition
that will allow natural drainage, storage and infiltration
processes to operate freely.
In short, trout streams and calcareous fens are two truly valu-
able natural resources that the Council wants to see protected.
Our history of reviews contain numerous cormnents against develop-
ments that impact these types of resources, most recently per-
taining to two separate proposals that wc+uld have impacted the
Savage Fen. We, therefore, ask the Corps not to issue this
permit.
Also, I would like to clarify the Council's review of this pro-
ject relative to the Eagan comprehensive plan, since it appears
some clarification is needed. When we first reviewed the plan,
the city was in the process of adopting a shoreland ordinance and
incorporating environmental protection elements into its new sub-
division regula±ions. The Council has not reviewed these ordi-
nances, so it is impossible to tell if this project is conSistent
with them. We review local comprehensive plans based on Council
policies and do not consider zoning or site plans on an individ-
ual basis. As such, we commented that the project was consis-
tent, as we knew at the time, with the land use element of the
comprehensive plan. However, environmental ordinances can over-
lay zoning ordinances and can override zoning on an individuat
site basis. Since we have not seen the environmental overlays,
we cannot say that this site is unaffected by them. I hope this
places our original cortments in the proper context.
