As requested, a site visit was made on october 23, 2006 at 3:36 P.M.
to evaluate subgrade soils for construction of a single family
residence. A construction plan grepared by Sehr Drafting & Aesign was
available for review at the site. bur surficial geelogy references
indaaate that the site lies within a(T2) region of Middle Terrace
deposits, sand, gravelly sand, loamy sand; overiain by thin deposits o£
silt, laam, er organic sediment. May be covezed by thick artificial
fill where heavily developed. It is our understanding that no
subsurface soils exploration has not been conducted as part of the
planned aonstrvction.
At the tirne of the inspection, a structure which previously occupied
the site had been removed and foundation excavation fcr khe new
construction partially completed within the southwest. Soils withiri the
excavation ranged from a sandp loam in the north/northcaest and to a
rnedium sand in the southeast. A zone of arganics and horizon "B" soils
running from the mid-point oE the west footing line to the southeast
cnrner had been excavated t a depth of 2' in the ssest to 6" zn the
east. The base of the sub-cut consisted of a dark horizan "S" soil
estending to the mid-point of the pad. Being granular in content, with
no vegetation and beiow 5 percent organfc content, the materia] is
acceptable for construction. A isolated area of darker sandy loam the
northwest section af the pad is acceptabYe and does not require
additional excavation.
To evaluate the strength of the soils, a 5/8th inch diameter smeoth
proBe was used to penetrate soils at random across the base of the
excavation. With full body weight applied, the probes indicated
penetration consistent with soils of average consa3idatiqn, with the
exception of the granular soils in the southeast, were the probes
indicated loose Iower strength soils. fi o assess snil conditions at
depth, a P 5f8th inch diameter fluted handauqer probe was puE down at
the low point of the excavation near the west footing line. The prohe
indicated a thin zane of granular horizon "B" underizin by brown
medium/fine sand at depth. At 2" feet below the base of the excavation
base soiis were fully saturated but stable.

To assess the relative Ioadbearing capacity of the soils, 3 dynamic
cone penetrometer tests uere conducted at random or within areas
indicating increased probe penetration. The dynamic cone penetcnmeter
(DCP), uses a eight kilogram (17.6 pound) hammer to drive a 20
mi2lirneter diameter conical point into the soil, with the penetrati.on
recorded in millimeters per blow. From the DCP readings, a per blow,
penetration average was recorded and a N-value derived. This N-value,
is an empirical reiationship ue have established to eguate the dynamic
cone data to the more fami3iar blows per foat (BPF) standard
penetration soiF boring tesi.

Based on our ohservations and the completed DCP tests, sails at the
base of the excavati,o:i are generally acceptable and mect or exceed a
target bearing capacity of 2000 PSF, aith the exception of the granular
soils with the southeast. It is onr understandzng that these soils
repre5eslt the northeast sectian of the garage and rnay supQoct a common
Wall section between the hause and garage. It is recvm¢nended that any
footings bearing oR theses soil be configured to a reinforced spread
footing design minimum of 22 to 24 inchss.
Our observatipns and subsequent soil evaluation on this date are
lirnited in scope to soil conditions obaerved within the excavation, and
ta the depths achieved by shallow probes and dynamic cone penetrometer
tests. We therefore, are unable to assess soil conditions at the
elevatians which may be encountered by soil barings conducted as part
of a standard subsurface geotechnical investigatipn.

On or about March 12, 1998 you, Lane Wegner and Jerry Wobschall had a discussion in the Finance
Department conceming charges to be made against your property if you conned to the City's sanitary sewer
system. On a compieted application of which R is beleived you have a copy of, the City proposed a lateral
benefd sanitary sewer charge in the amount of $2,130.00 for the connection. You also happened to be in the
City offices on April 2 and met with Jerry Wobschall and discussed this particular charge.
As long as the property retains its current boundaries and there are no olher connections there would be no
other charges for the sanitary sewer Iaterai that exists in Nicois Road. Should there be a future improvemem
for any City utility that affects the property, that impnrement would be the subjed to its own hearing. Any
assessments proposed under such a future projed would have to considered on their own merits. in the review
of your parcel ft was noted that it has not been charged for storm sewer trunk. A charge for stortn sewer trunk
could be imposed as a cond'Rion for a boundary change or as a result of a Trunk Storm Sewer improvement.
The City has not received any petitions for any type of improvement that would affect your propeAy.

While in the Cfty offices you mentioned to Jerty that you had signed something when Nicols Road was being
reconstrucled. The project and contract fiies were searched and a Waiver of Trespass was found that has your

The City is in receipt of your signed Waiver of Hearing No. 505, dated June 2, 1995. The purpose
of this correspondence is to darify an unfortunate situation that has occurred in the processing of the
above mentioned Waiver of Hearing.
Inadvertently, I prepazed the improper Waiver of Hearing Form that was transmitted to you. The
forxn that you were requested to initiate was a"standazd" Waiver of Assessment Form that the City
uses for situations where property owners aze requesting a particular improvement to be immediately
assessed to their property. This is clearly not the situation we aze dealing with at this time, and please
accept my apology for any inconvenience this oversight on my part may create for you.
Attached is a request form that accurately depicts the situation with which we are currently dealing.
The form requests additional improvements over and above what were identified under Project No.
681. The Waiver contains an estimate of the lump sum cost for the installation of concrete curb and
gutter and an additional catch basin as req_uested by Mr. Lester Spencer. You will note since the
Waiver contains an estimate of the cost, the final cost will not be tabulated until the project is
completed and the Final Assessment Roll is prepared. At that time, the property owner has the option
of paying all or a portion of the assessment or allowing the requested improvements to be assessed
over a period of years and an interest rate as deternvned at the Final Assessment Public Fiearing.

5ince April of this year, you have had numerous meetings with different members of City staff
regarding the above-referenced 'unprovements. At this point, it may be helpful to summarize the
City's understanding of your specific request relative to these improvements.
On May 15, 1995, the Eagan City Council considered your request to modify the scope of the
proposed project to include the instaUation of concrete curb and gutter along your frontage adjacent
ca Nicols Road• 1'uu also stated you were entided to a?5-foot comec lot credit for the concrete curb
and gutter installation based on a previous street assessment for Silver Bell Road.
This infocmation was presented to the Eagan City Council for iheir consideration and the City Council
directed staff to prepaze a special assessment authorization for the tntal cost of the concrete curb and
gutter installat'son without a 75-foot comer lot credit to the properry. The City Council was not
willing to modify the scope ofthe improvement to include the installation of concrete curb and gutter
unless you agreed to pay 100% oFthe costs associated with that installation
Subsequent to the Council action on this item, special a i ssmenc authorization No. 505 was executed
by the Fee title owner of the property in which you Ceside. This special assessment authorization
estimated the cost of the unprovements to be approximately $3,250. Since the preparation of the
authorization, the Ciry has taken competitive bids on the improvement, and the estimated cost of ihe
concreee curb and gutter installation adjacent to your properry is estimated to be at approximately
$7,000• This cost is significandy greater than the original estimates as provided you by the City. This
infomiation has been shared with you and you are still willing to proceed with the installation of the
concrete curb and gutter.

on November 12, 1985, Mr. Lester Spencer of 3786 Nicols Road,
contacted the City of Eagan regarding the outside storage of
miscellaneous material at the above sited metering station of the
Seneca Waste Treatment Plant. Pursuant to several negotiating
sessions, you agreed to clear the site of all outside storage by
June 1, 1986. A site review conducted on June 25, 1986 revealed
that all materials stored outside on the metering plant premises
had been removed and the site restored to a clean and orderly
fashion.
I would like to take this opportunity to thank you for your
cooperation regarding this matter and for an attitude that is
concerned about maintaining the quality of life in Eagan's
neighborhoods. You are to be commended for making a special
effort to resolve a difficult issue that had many extenuating

Dear Steve:
We want to take this time to thank you for all your efforts in
working with the Seneca Metro Waste Plant personnel in getting
them to clean up their metering statSon site, located on Nicols
Road just north of the junction of Nicols and Silver Bell Road.
For over two years, we and the Spencers, have tried appealing to
various people at the Seneca plant to clean up the site. It wasn't
until we went through city hall channels (Mayor 8ea Blomquist to
Dale Runkle to you) did we finally see resolution. '
The lot is now completely cleaned up and is quite a pleasing site.
Many of the people who regularly walk, jog, or bike on Nicols Road
have commented on the welcomed improvement of the site.

Dear Mr. Spencer:
I am wtiting to confirm our telephone conversation of December 4,
1985, regarding outside storage at the Seneca Waste Treatment
Plant Metering Station located on Nicols Road.
On November 12, 1985, you contacted the City of Eagan regarding
the outside storage of "motors, barrels, liquid storage tanks,
pick-up boxes and campers, and other miscellaneous material" at
the above cited metering station of the Seneca Waste Treatment
P1ant. As indicated to you at the time, outside storage is not a
permitted activity at a facility such as the metering station,
and clearly is not conducive to the welfare and atmosphere of a
single family residential neighborhood such as yours. Outside
storage may occur only where a conditional use permit is applied
for, and granted by, the Eaqan City Council.
In telephone conversations with Mr. Bill Moeller of the Seneca
Treatment Plant, it is not their intention to irritate neighbors,
degrade the surrounding area, or violate City ordinauces by
storing material outside the metering station. Mr. Moeller
contends, however, that at the present time the treatment plant
lacks sufficient space for inside storage and appropriate
facilities wi11 not be ready for occupancy until June 1986.
Thus, while outside storage is not permitted at the site and
clearly blights the surrounding neighborhood, Seneca will not
have sufficent storage facilities until June 1986.
To bridge this matter of potential conflict, you and Mr. Bill
Moeller, who represents the Seneca Waste Treatment Plant,
regarding this issue, have reached the following agreement:
1. By June 1, 1986, all outside storage at the metering
station located on Nicols Road wi11 cease with material
presently stored at this site removed and the area restored
to acceptable standards per City regulations;
2. From now to June 1, 1986, Seneca officials will make
every effort to maintain the site in att orderly manner and
to remove excessively repugnan*_ material.

and with Metro over the years and so far we have seen no
results.

by properly cvnstructing the driveway entranoe, that the drainage could
be oontained within the street gutterline. However, he will not acoept
this proposed oorrection and indicated that he will be having his attAr-
ney aontact the City.

and/or his attorney take place.
It should be noted that we muld nat find any evidence of erosion problems
across Mr. Sperioer's property as he has claimed.

In July, 1979 we filed a claim against the City
of Eagan on behalf of Lester Spencer as a result of
your negligence in arranging for the draining of
surface waters in the vicinity of Highway 13 and
Cedar Avenue.
At the time of filing the claim We did not have
a close estimate of the amount of damages. Mr. Spencer
has now determined that his damages are $2500.00.

1'hat plaintif£s are the owners of the following described
proper•ty located in the City of Eagan, Dakota County, Minnesota:
That part of Gevernment Lot Eight (8), Section
Eighteen (18), Township Twenty-severi (27), North
of Range Twenty-three (23), West of the 4th
Principal Meridian, described as follows, to-wit:
Beyin:ing on the East line of said Government
Lot Eight (8), at a point Forty-four (44) feet
North of the SoutYieast corner thereof, said point
being at the intersection of the East line of said
Government Lot Eight (8) with the Northeasterly
line of Cedar Avenue Road (so called); thence
Northwesterly along the Northeasterly line of said
Cedar Avenue Road to a point on said Northeasterly
line of said Cedar Avenue Road, whicti point is
three hundred and twenty-two (322) feet North-
westerly from the point of beginning; thence North-
easterly to a point on the East line of said Govern-
ment Lot Eight (S), which point is three hundred
(300) feet North of the point of beginning; thence
South along the East line of said Government Lot
Eight (8), a distance of three hundred (300) feet
to the place or puint of beginning, all according
to the Government Survey thereof.

That on and after January 1, 1978 the de£endants caused
the natural drainage on the plaintiffs' property to be changed in
the vicinity of the intersection of Cedar Avenue and Highway 13
plat known as Michael Sill Addition.
III.
That the aforesaid negligent and intentional acts of
the defendants have caused the land of the plaintiffs to be
damaged in the amount of Five Thousand and no/100 ($5,000.00)
Dollars.
WHEREFORE, plaintiffs demand judgment against defendants,
and each of them, in the amount of Fi•re Thousand and no/100
($5,000.00) Dollars, together with their costs and disbursements
herein.
